It applies when a person may have a substance abuse impairment and may need help under the Marchman Act.

The Baker Act is about mental health. Addiction is handled under a different law, the Marchman Act. The Marchman Act criteria for involuntary admission are in Fla. Stat. § 397.675. Some crises involve both mental illness and substance use, so the two laws can overlap.

When people say “Baker Act yourself,” they usually mean voluntary admission. Here, you ask for help rather than having someone else start the process. The law also allows others to start an involuntary examination, which is a different path with different rules.

How Does a Marchman Act Petition Differ From Voluntary Treatment?

Yes, an adult can seek voluntary admission. Under Fla. Stat. § 394.4625, a facility may receive an adult who applies by express and informed consent. The adult must show evidence of mental illness and be suitable for treatment. The adult must also be found competent to give that consent.

Involuntary examination works differently. Under Fla. Stat. § 394.463, a person may be taken to a receiving facility for involuntary examination only if there is reason to believe they have a mental illness and, because of that illness, they meet further criteria, such as refusing a voluntary examination after its purpose was explained.

People often seek voluntary help during severe depression, thoughts of suicide, or a loss of control. Some want a safe place during a crisis. Voluntary admission and involuntary examination carry different timelines and rights. Knowing which one applies shapes every decision that follows.

What Happens Step by Step After You Ask for Help

The process usually moves through four stages:

Contact. You or someone you trust contacts a receiving facility or crisis provider and describes what is happening.

Evaluation. Facility staff assess your condition and your ability to give informed consent.

Decision. The facility decides on admission and treatment. A voluntary patient, or a relative, friend, or attorney of the patient, can request discharge at any time after admission, orally or in writing, and the patient must be discharged within 24 hours of the request, unless the request is rescinded or the patient is transferred to involuntary status. The facility may extend the 24 hours when necessary for adequate discharge planning, but not beyond 3 days, excluding weekends and holidays. The reasons should be recorded in your clinical record.

Treatment and planning. If you stay, the team works on treatment and a discharge plan. This may include follow-up care after you leave.

Before you agree to treatment, you have rights. Under Florida law, before giving express and informed consent, the patient, or the patient’s guardian where applicable, must receive an explanation in plain language of the reason for admission, the proposed treatment, its purpose, the common risks, benefits, and side effects, the specific dosage range for the medication when applicable, alternative treatment options, the approximate length of care, the potential effects of stopping treatment, and how treatment will be monitored. Any consent to treatment can be revoked, orally or in writing.

Ask questions before you sign anything. Ask what each form means and how long you may be held.

How Long Can a Baker Act Hold Last?

For an involuntary examination, the initial period is up to 72 hours. The Florida Courts Baker Act guide describes this 72-hour examination period. At the end of it, the person may be released, may enter voluntary treatment, or the facility may seek involuntary placement.

Voluntary patients have their own timing rules. Under Fla. Stat. § 394.4625, a patient or a relative, friend, or attorney can ask for discharge at any time after admission. The patient must be discharged within 24 hours of the request. The request can be rescinded, or the patient may be moved to involuntary status.

The facility may extend that 24-hour period for discharge planning. The extension cannot go beyond 3 days, not counting weekends and holidays.

If a voluntary patient asks to leave and meets the criteria for involuntary placement, the facility must act fast. The administrator must file a petition within 2 court working days after the request. If no petition is filed in that time, the patient must be discharged.

These deadlines are short. Many people don’t realize how quickly the rules change once they ask to leave.

Your Rights, Records, and Wrongful Baker Act Concerns

A person receiving mental health services keeps important rights. Under Fla. Stat. § 394.459, a patient’s individual dignity must be respected at all times. A patient may communicate freely and privately with people outside the facility. One exception applies when a qualified professional finds that communication is likely to be harmful to the person or others in a manner directly related to the patient’s clinical well-being, the clinical well-being of other patients, or the general safety of staff.

For involuntary holds, the facility must give prompt notice of where you are. Under Fla. Stat. § 394.4599, that notice goes to a guardian, attorney, representative, or other contact within 24 hours after arrival.

Clinical records are confidential. Under Fla. Stat. § 394.4615, a voluntary admission must document that you were offered the option to share information with an attorney or other emergency contact within 24 hours.

Some people later believe the Baker Act was used wrongly. Whether a claim exists depends on the facts. A lawyer can review the records, the timeline, and the reasons given for the hold.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

When Marchman Act or Guardianship Questions Come Up

Marchman Act questions often arise when addiction drives the crisis. Under Fla. Stat. § 397.68112, for an adult respondent, a petition for involuntary treatment services may be filed by the respondent’s spouse or legal guardian, any relative, a service provider, or an adult who has direct personal knowledge of the respondent’s substance abuse impairment and his or her prior course of assessment and treatment. A Marchman petition is a separate court process from a facility stay.

Courts have also held that a Marchman respondent has a constitutional right to counsel. In Hillsborough County v. Albrechta, the Second District Court of Appeal reached that conclusion because due process is involved.

Guardianship questions arise when a person cannot make decisions safely. An emergency temporary guardian may be appointed only with a specific finding of imminent danger. Under Fla. Stat. § 744.3031, that authority expires 90 days after appointment or when a guardian is appointed, whichever occurs first, unless it is extended for an additional 90 days upon a showing that the emergency conditions still exist.

Limited, plenary, and mental health guardianships are longer-term options. Each one depends on the person’s specific needs and the court’s findings.

These paths can connect. A facility stay may lead to questions about addiction, decision-making, or guardianship. Each question needs its own review.

Why Families Contact Robinson Casey

Robinson Casey focuses on Marchman Act petitions and guardianship matters for families in South Florida and statewide.
