Under Florida law, a person may be taken to a receiving facility if there is reason to believe they have a mental illness and, because of it, meet the statute’s criteria.

The law defines mental illness narrowly. Under Florida’s definition of mental illness, the term leaves out a developmental disability as defined in chapter 393, intoxication, conditions manifested only by dementia or traumatic brain injury, antisocial behavior, and substance abuse. That’s why substance use cases usually follow a different law.

Not every hold starts with a judge. The Florida Courts Baker Act guide describes the ways an examination can begin. One is an ex parte order, which a judge signs based on sworn facts without the other side present.

Baker Act vs. Marchman Act: Which Law Applies

The Baker Act covers mental illness. The Marchman Act covers substance abuse impairment. Some cases involve both, so the facts decide which law fits.

Baker Act (Chapter 394): the person has a mental illness and is held at a receiving facility for examination.

Marchman Act (Chapter 397): the person is substance abuse impaired, or has a substance use disorder with a co-occurring mental health disorder. They must have lost the power of self-control over substance use and have inflicted or be likely to inflict physical harm on themselves or another.

Who may petition: for an adult, a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge.

Where to file: the county where the person is located. The clerk may not charge a filing fee.

A Marchman respondent has the right to counsel at every stage of the case. A respondent who can’t afford a private lawyer may get one appointed. The Second District has held this right is constitutional because due process is involved. Hillsborough County v. Albrechta For more on these petitions, see Marchman Act petitions.

Baker Act (Chapter 394) Timeline: Typical Steps for Families

An initial Baker Act examination lasts up to 72 hours. The Highlands County Clerk’s Baker Act overview explains the period and its possible outcomes.

Here is what usually happens:

Ex parte order, if used. The order is valid only until the person is delivered to the facility or until the time stated in it. Without a stated time limit, it lasts 7 days after it is signed.

Arrival and notice. A receiving facility may use the emergency contact information on the officer’s report only to inform the listed emergency contacts of the person’s whereabouts. That notice comes within 24 hours of arrival.

Examination. The facility evaluates the person during the hold.

Outcome. The possible results include release, voluntary treatment, or a petition for involuntary placement.

Discharge planning. Any discharge plan must address follow-up appointments, how to get medicines, living arrangements, and transportation. Staff must try to involve a family member or legal guardian.

Families should also know the law bars knowingly and willfully giving false information to obtain an involuntary admission.

When a Baker Act Situation Leads to Longer Court Decisions

A Baker Act hold is short. A longer court process needs its own petition. Guardianship starts with a petition to determine incapacity, which must be verified and must state the facts behind the belief that the person is incapacitated.

When a petition for determination of incapacity has been filed and the court specifically finds imminent danger that the person’s physical or mental health or safety will be seriously impaired, or that the person’s property is in danger of being wasted, misappropriated, or lost, unless immediate action is taken, the court may appoint an emergency temporary guardian before a guardian is appointed. The danger must threaten the person’s health or safety, or their property. Fla. Stat. § 744.3031 The person and their attorney get at least 24 hours’ notice of the hearing, unless the petitioner demonstrates that substantial harm to the alleged incapacitated person would occur if the 24-hour notice is given. That authority ends after 90 days or when a guardian is appointed, whichever comes first, but it may be extended for an additional 90 days upon a showing that the emergency conditions still exist.

Each one gives the court a different scope of authority, so the right fit turns on the person’s needs.

When substance use drives the concern, the Marchman Act is the court route. In the Fifth District, a trial judge may not call and question the clinician to supply the petitioner’s case when the petitioner is absent. J.J.J. v. D.G. Later statute changes may affect the issue.

Questions to Gather Before Deciding on a Next Step

Start by collecting facts, dates, and papers. Clear records make the next conversation faster and more useful.

Gather these items:

The facility name, arrival date, and time

Any court order, notice, or paperwork you received

Names and phone numbers of the person’s doctors

The name of any current guardian, guardian advocate, or health care surrogate

A written timeline of recent events, treatment, and substance use history

Any evaluation summary or medication list

Ask the facility these questions:

What is the discharge plan, and when is it expected?

Which follow-up appointments and medicines are listed?

Has any petition been filed with the court?

Knowing who holds legal authority now matters. A Marchman petition also limits who may file it. Each matter turns on its own facts.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How Robinson Casey Handles Marchman Act and Guardianship Matters

Robinson Casey focuses on Marchman Act petitions and guardianship matters for families in Miami-Dade, South Florida, and statewide.

The practice covers:

Marchman Act petitions and involuntary commitment for addiction

Guardianship, including plenary, limited, and mental health guardianship

Emergency temporary guardianship when urgent protection is needed

Richard J.
