Casey III, Esq. · Published October 21, 2026

That window is the first step, not the whole process. What follows turns on what the examination finds and whether a court gets involved. This guide walks through the Baker Act time frame in order and shows how it differs from the Marchman Act, which covers substance use.

How Long Does a Baker Act Hold Last?

An initial Baker Act hold lasts up to 72 hours. That is the examination period, and it is the first step in the process.

A person may be taken to a receiving facility for involuntary examination if there is reason to believe they have a mental illness. Their illness must also cause them to meet the statutory criteria. Fla. Stat. § 394.463 sets out those criteria. One criterion is that the person refused voluntary examination after a clear explanation of its purpose.

The clock is tied to arrival. When a person for whom an involuntary examination has been initiated is first treated at a hospital for an emergency medical condition, the examination period starts when they arrive there and ends when the attending physician documents that the emergency medical condition exists. The same section governs that rule.

They do not come from what a family member remembers being told. Ask the facility for dates in writing, and note them as you receive them.

Get a free consultation

Get a free consultation

When Was the Baker Act Passed?

The history note of Fla. Stat. § 394.469 cites s. 10, ch. 71-131. That history note sits at the end of Fla. Stat. § 394.469. The statute has been amended several times since, so the current text controls.

When a patient is found to no longer meet the criteria for involuntary placement, the administrator shall discharge the patient, unless the patient is under a criminal charge, in which case the patient is transferred to the custody of the appropriate law enforcement officer; transfer the patient to voluntary status on his or her own authority or at the patient’s request, unless the patient is under criminal charge or adjudicated incapacitated; or place an improved patient, except one under a criminal charge, on convalescent status in the care of a community facility. The Florida Department of Children and Families describes the Baker Act’s involuntary-examination criteria for families and the public.

This section governs discharge and transfer once a patient is found to no longer meet the criteria for involuntary placement; the rights a patient keeps while held are covered by § 394.459. A person receiving mental health treatment keeps constitutional rights, but if the person is adjudicated incapacitated, his or her rights may be limited to the same extent the rights of any incapacitated person are limited by law. Patients may also communicate privately with people outside the facility. Under Fla. Stat. § 394.459(5)(a), each person receiving services in a facility providing mental health services under this part has the right to communicate freely and privately with persons outside the facility unless a qualified professional determines that such communication is likely to be harmful to the person or others in a manner directly related to the person’s clinical well-being, the clinical well-being of other patients, or the general safety of staff. Fla. Stat. § 394.459 covers those rights.

What Happens at the End of a 72-Hour Hold?

It cannot simply keep the person because the time ran out.

When a patient is found to no longer meet the criteria for involuntary placement, the facility administrator must discharge the patient, transfer the patient to voluntary status, or place an improved patient on convalescent status, subject to certain exceptions, such as a pending criminal charge. The administrator may instead transfer the patient to voluntary status on the patient’s own authority or at the patient’s request, unless the patient is under a criminal charge or adjudicated incapacitated. An improved patient may also be placed on convalescent status.

Further involuntary treatment requires a court process. A patient may be retained by the facility that examined them until the court hearing, but only upon the recommendation of the facility administrator and after the notice and hearing procedures are followed. A patient recommended only for involuntary outpatient services who has been stabilized and no longer meets the examination criteria must be released while awaiting the hearing. Testimony at that hearing must be given under oath, and the proceedings must be recorded.

Families often ask who makes the recommendation and what the examining professionals report. Notice of release goes to the patient’s guardian or representative, to any person who signed a certificate admitting the patient to the receiving facility, and to any court that ordered the patient’s evaluation. No particular result can be predicted. Each outcome turns on the examination findings and the statutory criteria.

What Is the 3-Month Rule in Mental Health Law?

Searchers often ask about a “3-month rule.” The Baker Act’s periods are tied to the examination, the hearing, and court orders instead.

Longer involuntary services come from a court order after a hearing under § 394.467. An involuntary outpatient services order stays in effect until it expires. It can also end earlier if the service provider finds the patient no longer meets the criteria.

That rule protects the patient’s time in a facility.

Which period applies depends on the facts of the case.

What to Do When a Family Member Is in a Mental Health Crisis

In an emergency, call 911 first. After that, keep a clear record of who has been told what and when.

The facility must give prompt notice of the person’s whereabouts. Under Fla. Stat. § 394.4599, that notice goes to the guardian, guardian advocate, health care surrogate or proxy, attorney or representative, or other emergency contact identified through electronic databases, within 24 hours after arrival. Each contact attempt must be documented in the clinical record.

Who serves as the representative matters too. If the patient has no guardian, the patient is asked to name a representative. If the patient cannot, the facility chooses from a set order. The order starts with a health care surrogate the patient picked earlier. It then moves to the spouse, an adult child, a parent, an adult next of kin, and an adult friend, except for good cause documented in the patient’s clinical record. Fla. Stat. § 394.4597 sets that order.

Some people cannot serve as representative. These include the professional who started the examination by certificate and facility employees. Keep a simple log of the date, time, and name of each person you speak with. Copy any papers you receive.

How Baker Act Time Frames Differ From Marchman Act Timelines

The Baker Act covers mental illness, and the Marchman Act covers substance use. The two statutes use different tests and different timelines.

Florida’s definition of mental illness leaves out intoxication and substance abuse. It explains why the same family crisis can fall under different chapters.

The Marchman Act jurisdiction provision says the courts have jurisdiction over involuntary treatment petitions for substance abuse impaired persons.

A Baker Act case can move into Chapter 397. If a court finds that a person instead meets the criteria for involuntary admission or treatment under Fla. Stat. § 397.675, it may order the person admitted for involuntary assessment under § 397.6757. All further proceedings then follow Chapter 397, as § 394.467 provides.

Venue also matters. In the J.P. v. J.N. opinion, the Fifth District held that a Marchman petition filed in the wrong county did not take away the circuit court’s jurisdiction. The problem was venue. The Second District has also held that a Marchman respondent has a constitutional right to counsel, as Hillsborough County v. Albrechta explains.
