It lets a court order assessment, stabilization, and treatment when the legal criteria are met.

Opioids are one substance the Act can reach. The Flagler County Clerk’s mental health page explains that the Act covers illegal drugs, prescription drugs, and alcohol.

Florida also allows voluntary admission. A person who wants help can apply to a service provider directly, as Fla. Stat. § 397.601 provides. An involuntary petition starts a court case. Under Florida law, a person who wishes to enter treatment for substance abuse may apply to a service provider for voluntary admission. Within the financial and space capabilities of the service provider, the person must be admitted when sufficient evidence exists that they are impaired by substance abuse and their medical and behavioral conditions are not beyond the safe management capabilities of the service provider.

For the full framework, see our involuntary commitment for addiction guide.

What a Marchman Act Petition Must Contain

A petition must name the respondent and the petitioner. These required items come from Fla. Stat. § 397.68141.

So a spouse should be ready to state the marriage plainly. Write a short timeline before any consultation. List dates, specific events, who saw them, and any treatment already tried. Clear facts make the petition easier to review.

What a Petition Has to Show About Opioid Use

A petition must give reasons to believe the person is substance abuse impaired. It must also show that the impairment has caused a loss of self-control. The criteria appear in Fla. Stat. § 397.675.

The person must also meet one of two tests. Either the impairment blocks their ability to see the need for help, or there is substantial likelihood they have inflicted, threatened, or are likely to inflict physical harm on themselves or another, or their neglect poses a real and present threat of substantial harm that family or services cannot avoid. Harm can fall on the person or on someone else. Refusing help alone is not evidence of impaired judgment, under the same statute.

A petition may include a report from a qualified professional who examined the person within 30 days before filing. If no assessment happened, the petition must say so, per § 397.68141.

Vague concerns are not enough. In D.H. v. K.J.R., the court stated that the petition did not establish a good faith reason to believe D.H. met the statutory criteria for involuntary assessment and stabilization, and that the trial court erred in entering the ex parte order. For fentanyl and stimulant cases, see our Marchman Act guide on fentanyl and stimulant use.

How the Petition Process Generally Works

A petition is filed with the clerk of the court in the county where the person is located. The clerk may not charge a fee for filing it, under Fla. Stat. § 397.681.

Location matters. In J.P. v. J.N., the court explained that the filing of the petition in the wrong county did not divest the circuit court in Putnam County of jurisdiction.

The court must set a hearing within 10 court working days unless a continuance is granted, per § 397.68151. In an emergency, the court may enter an assessment order based on the petition, under § 397.6818.

The person named has the right to counsel at every stage. At the hearing, the court must hear and review the results of the clinical assessment completed by a qualified professional, under § 397.6957, and the report must be filed with the clerk by the close of business the day before the hearing. The conditions must be proved by clear and convincing evidence, and an order may last up to 90 days, per § 397.697.

The petitioner carries the burden of proof. In J.C. v. State, the court stated: “In doing so, the court failed to follow the applicable statute by essentially functioning as the absent petitioner.” In C.W.R.K. v. Stewart Marchman Act Behavioral Healthcare, the trial court failed to follow the governing statute when, in the absence of the petitioner, it called and questioned the health care professional who executed the involuntary services certificate.

The Emotional and Financial Pressures on a Spouse

Many spouses describe fear, exhaustion, and guilt as a partner’s opioid use gets worse. You may feel you should handle it alone. Those feelings are understandable, and they can make a hard decision harder.

The strain is practical too. Work gets missed. Bills are shared. Children or other dependents may live in the home. Some spouses spend nights watching for danger.

Filing is a serious legal step. It can affect your household and your relationship with the person named. Filing is one option, not a required first step. A calm conversation about the facts can help you weigh it.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk With Robinson Casey Before Deciding Next Steps

A spouse can check eligibility before making any filing decision.
