The law covers substance use in general. Richard J. Casey III, Esq. is the responsible lawyer for this page.

What a Marchman Act Petition Is, and What It Is Not

A Marchman Act petition is a request to a Florida court for an assessment and a treatment decision under Chapter 397. It starts a court process. It is not a sentence, a cure, or a promise that the person will stop using.

Florida law limits who may file for an adult. A spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the person’s impairment and prior course of assessment and treatment may file (who may file a petition). The petition must name the person and the petitioner. It must also state the facts behind the request (what a petition must contain).

For the broader process, read our involuntary commitment for addiction guide.

If your relative's fentanyl or stimulant use has become hard to predict and they refuse help, we can talk through whether a Marchman petition fits your family's facts. Opioids like fentanyl and stimulants like methamphetamine and cocaine can affect the body and behavior in different ways. Fentanyl is also especially dangerous because it can be hidden in other drugs. These facts shape the medical plan. They do not change the legal test. Our opioid, heroin, cocaine and methamphetamine guides give drug-specific background.

How the Court Looks at the Person’s Condition

The court’s decision centers on the person’s condition. It asks whether substance use has taken away self-control and created a serious risk. The risk can be to the person’s own safety or to others.

If that inability comes from substance use, it can support a petition. The statute also covers someone who is likely to neglect themselves in a way that poses a real and present threat of substantial harm, and where it is not apparent that such harm may be avoided through the help of willing, able, and responsible family members or friends or the provision of other services. Fla. Stat. § 397.675 reads: “(b) Without care or treatment, is likely to suffer from neglect or refuse to care for himself or herself; that such neglect or refusal poses a real and present threat of substantial harm to his or her well-being; and that it is not apparent that such harm may be avoided through the help of willing, able, and responsible family members or friends or the provision of other services, or there is substantial likelihood that the person has inflicted, or threatened to or attempted to inflict, or, unless admitted, is likely to inflict, physical harm on himself, herself, or another.”

Assessment carries weight. A petition may include a report from a qualified professional who examined the person within 30 days before filing. If the person refused evaluation, the petition must say so (petition contents).

The court may order drug tests, and testimony is taken under oath (hearing rules). Clear dates, specific incidents and changes in sleep, work or money help describe the condition. The court may order services only if the conditions are proved by clear and convincing evidence (court orders for services).

What a Petition Can Do for a Family

A petition can start a process that may lead to an assessment and, if the statute’s standards are met, court-ordered treatment. It cannot control the outcome.

The petition is filed with the clerk in the county where the person is located (filing rules). The court must schedule a hearing within 10 court working days unless a continuance is granted (hearing setting).

A respondent who cannot afford private counsel has the right to court-appointed counsel, and if the court believes the respondent needs or desires a lawyer, the court shall appoint one without regard to the respondent’s wishes (right to counsel).

If the service provider believes a person nearing release still meets the criteria for involuntary services, a renewal petition must be filed with the court before the court-ordered services period ends; the service provider can file it, or the person who filed the original petition can file it if it comes with supporting documentation from the service provider (renewal rules). The court keeps oversight during the order.

What a Marchman Act Petition Cannot Do

A petition cannot cure addiction. A court order does not promise sobriety, recovery or any particular result. The person must be released when the conditions that justified treatment no longer exist (renewal rules).

A petition does not resolve criminal charges, custody disputes or other legal problems. Those matters need separate attention.

A petition is not a guardianship. A guardianship is a different court case with different goals and different rules. Families should not treat the two as interchangeable.

Location matters. A petition goes where the person is physically located when filed. In one Fifth District case, a Marchman petition was filed in the wrong county. The court held that the filing did not remove the circuit court’s jurisdiction, and the remedy was transfer, not dismissal (J.P. v. J.N.).

The petitioner must also present the case. In the Fifth District, a court may not step in and question the health care professional when the petitioner is absent (C.W.R.K. v. Stewart Marchman Act Behavioral Healthcare).

Mixed Use, Medical Danger and What Comes First

Medical safety comes first. A court petition does not replace emergency care. If someone has overdosed or is in medical danger, call 911 now.

Withdrawal from opioids or stimulants can be medically serious. Naloxone is a medication that can reverse an opioid overdose. Many families keep it on hand, and it is worth asking a medical provider about it.

Mixed use of fentanyl and a stimulant can make the medical picture harder to read. A medical evaluation should come before or alongside any court step when health is at risk.

Emergency court tools exist. In an emergency, the court may enter an ex parte assessment order based on the petition alone, without appointing an attorney first. A service provider may not hold the person for more than 72 hours of observation, except in listed situations (emergency order rules).

Most families face a safety question before a legal one. Safety and medical evaluation come first. The timing of the petition follows from that.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talking With a Marchman Act Attorney About Your Family’s Situation

A Marchman petition may fit when a relative’s fentanyl or stimulant use has become unpredictable and they refuse help.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Who can file a Marchman Act petition in Florida?

For an adult, a spouse, legal guardian, relative, service provider, or someone with direct knowledge of the impairment may file.
