A short definition helps you focus on what the paper asks of you. Matching the heading to one step keeps your next questions clear. For an overview of the firm’s Marchman Act and guardianship work, read the Marchman Act attorney guide.

The Baker Act in Plain Terms: Florida’s Involuntary Mental Health Examination Law

The Baker Act lets Florida examine a person who may have a mental illness, even without their consent. It sits in Chapter 394, Part I of the Florida Statutes. Under § 394.463, a person may be taken to a receiving facility if there is reason to believe they have a mental illness. Because of that illness, they must have refused voluntary examination after conscientious explanation and disclosure of the purpose of the examination, or be unable to determine for themselves whether examination is necessary, and must also meet the other criteria the section sets out.

The statute gives “mental illness” a set meaning. Under § 394.455, it is an impairment of mental or emotional processes. That impairment must substantially interfere with the ordinary demands of living. The same definition excludes intoxication, developmental disability, and conditions shown only by dementia, traumatic brain injury, antisocial behavior, or substance abuse.

An involuntary exam can start in more than one way. The Florida courts’ Baker Act criteria guide notes that one route is an ex parte order based on an affidavit. Law enforcement may also take a person who appears to meet the criteria for involuntary examination into custody and deliver them to a facility, as § 394.463 allows.

In that case, the firm may refer the matter to another lawyer or firm.

The 72-Hour Examination Period and What Happens During It

The Baker Act examination period lasts up to 72 hours, according to the Highlands County Clerk. The 72-hour period also appears in the minor-notice rules of § 394.4599.

When the window ends, the person’s status may change. The Highlands clerk lists release, voluntary treatment, or a filing for involuntary placement. The 72 hours are a time limit on the exam window, not a full case timeline. The next step depends on the facts of each case.

Family notice matters. The person also has the right to communicate freely and privately with people outside the facility, unless a qualified professional determines that such communication is likely to be harmful to the person or others in a manner directly related to the person’s clinical well-being, the clinical well-being of other patients, or the general safety of staff, under § 394.459.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Who must be told when someone is held?

The facility must give prompt notice of the person’s whereabouts to the guardian, guardian advocate, health care surrogate or proxy, attorney, representative, or other emergency contact, by telephone or in person within 24 hours after arrival. If the person is in another state, look to that state’s law.

For families in South Florida and Miami-Dade County, the Florida rules in this guide apply.
