It can apply when that person cannot or will not seek help on their own. Voluntary treatment starts with the person’s own agreement. An involuntary process starts with a petition and runs through a court.

Florida courts hear involuntary treatment petitions for people who are substance abuse impaired, and the petition is filed with the clerk of court in the county where the person is located. The person must also have lost the power of self-control over substance use. Under § 397.68141(1)(c), the petition must give the reason the petitioner believes the person has inflicted or is likely to inflict physical harm on himself, herself or others unless the court orders services. Or it must give the reason the petitioner believes the person’s refusal of care rests on judgment so impaired by substance abuse that the person cannot appreciate the need for care or make a rational decision about it.

Each concern needs specific facts behind it. For more background, read the involuntary commitment guide.

What a Relative Needs to Document Before Filing

Start a dated log now. Each entry should give the date, the place, what you saw or heard, and who else was present. Dated facts are easier to check than general statements like “he’s always drinking.”

Gather records you can lawfully obtain:

Emergency room, hospital, or detox records

Police or EMS reports

Pharmacy or prescription history, where lawfully available

Any prior assessment or treatment records

List each treatment attempt with its date, the provider, and how it ended. Identify witnesses who saw the same behavior, such as a neighbor, employer, or other family member.

The petition must name the respondent and the petitioner. It must state their relationship, the respondent’s attorney if known, and the factual reasons for the concern, as Fla. Stat. § 397.68141 requires. A report from a qualified professional who examined the person within 30 days before filing may accompany the petition. If the person was not assessed or refused assessment, the petition must say so.

Organize your papers for the attorney’s review. The evidence guide explains what to collect. Avoid making threats, and don’t sign papers you haven’t reviewed.

How the Process Works, Step by Step

A petition moves from the clerk’s office to a court hearing on a set schedule.

Consultation. You review your relationship to the person, your concerns, and your documents.

Eligibility review. The attorney checks the statute’s who-may-file rules against your facts.

Filing. The petition goes to the clerk of court in the county where the person is located.
