Casey III, Esq. · Published October 24, 2026

A Florida court needs facts showing that a person is impaired by substance use, has lost self-control over that use, and either cannot make a rational choice about care or poses a real risk of harm. That is the core of what proof you need.

If you’re asking what proof do I need to get someone into treatment Florida judges will consider, this guide walks through each piece in plain words. It also covers the evidence families usually gather and who can present it.

Florida’s civil process for this is the Marchman Act. This guide explains the general framework. It doesn’t decide any particular family’s case.

Why the Question of Proof Comes Up for Families

Families ask about proof because they want to know whether a judge will act on what they’ve already seen at home.

Most families reach this point after a long stretch. You may have watched drinking or drug use take over daily life. You may have asked, pleaded, and set limits, and still seen no real change.

Now you want a lawful path. You also want to know what a judge would actually need to hear.

Feelings matter, but a court doesn’t act on worry alone. It looks for facts it can test. So the real question is what you can show, in what form, and who can say it under oath.

If your loved one keeps refusing help and their substance use puts them or others at risk, our team can talk through your options with you. The process starts with a petition filed with the clerk of court. It does not start with an arrest or a criminal charge.

Some people also have a mental health condition alongside substance use. MedlinePlus notes that these co-occurring conditions often happen together and are usually treated at the same time. Florida’s criteria address this case too, under Fla. Stat. § 397.675.

For the full overview of involuntary commitment for addiction in Florida, see our pillar guide on that topic.

The Core Elements a Court Looks For

Substance abuse impairment. The petitioner needs a good faith reason to believe the person is impaired by substance use. See Fla. Stat. § 397.675.

Loss of self-control. Because of that impairment, the person has lost the power of self-control over substance use.

Refusal or inability to decide. The person cannot appreciate the need for services and make a rational choice. Or, without care, the person is likely to neglect themselves in a way that poses a real and present threat of substantial harm, and it is not apparent that such harm may be avoided through the help of willing, able, and responsible family members or friends or the provision of other services.

Risk of harm. There is a substantial likelihood the person has inflicted, threatened, or attempted physical harm on self or others, or is likely to do so unless admitted.

One point surprises many families. The statute says mere refusal to receive services does not, by itself, show lack of judgment.

Another common mistake is stating conclusions without facts. “He’s out of control” is a label. The petition must give the reason for each belief, as Fla. Stat. § 397.68141 requires.

Types of Evidence Families Usually Gather

The most useful proof is specific, dated, and firsthand.

Start with a simple record. For each incident, write down the date, what happened, who saw it, and what the person said or did next. Keep the notes factual. Avoid guessing what the person was thinking.

Common examples include:

Missed work, school, or bills tied to substance use, with dates

Unsafe driving, falls, fires, or medical emergencies, and who responded

Threats or statements of self-harm, using the person’s words when you can recall them

Prior treatment attempts, detox stays, emergency room visits, or police contacts, where you know of them

Names of people with firsthand knowledge, such as a coworker, roommate, or neighbor

Professional observations also matter. A petition may include a report from a qualified professional who examined the person within 30 days before filing. If the person was never assessed, or refused an evaluation, the petition must say so.

How strong the evidence is depends on the facts, and the court weighs it. Testimony must be given under oath, and the court hears testimony from family members who know the person’s history.

Who Provides the Proof in a Marchman Act Petition

For an adult, Fla. Stat. § 397.68112 allows a petition from a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the impairment and prior treatment. That list is broader than many families expect.

Florida law also allows a written declaration to verify a document. The declaration reads: “Under penalties of perjury, I declare that I have read the foregoing document and that the facts stated in it are true.” Knowingly making a false declaration is a third-degree felony.

The petitioner carries the burden of proof. In J.C. v. State, the Fifth District Court of Appeal reversed an order where the trial court called and examined the only witness while the petitioner was absent.

The Fourth District reached a different result in J.J.J. v. D.G. and flagged a conflict with the Fifth District.

What Happens After the Petition Is Filed

The court reviews the petition and, when an emergency exists, may order an ex parte assessment and stabilization, then holds a hearing on the evidence.

The petition goes to the clerk of court in the county where the person is located, under Fla. Stat. § 397.681. The clerk may not charge a fee for filing it. The court schedules a hearing within 10 court working days unless a continuance is granted, under Fla. Stat. § 397.68151.

The person has rights in this process. The court must immediately determine whether the respondent has an attorney or whether appointing counsel is appropriate, and an appointed office represents the person until the petition is dismissed, the court order expires, the person is discharged from involuntary treatment services, or the office is otherwise discharged by the court. A person who cannot afford a private lawyer may receive court-appointed counsel.

If the court finds the conditions proved by clear and convincing evidence, it may order up to 90 days of involuntary treatment services, under Fla. Stat. § 397.697.

When danger is immediate, the petition can request an emergency order. When emergency circumstances exist, or the court determines that an emergency exists, the court may rely solely on the contents of the petition and, without the appointment of an attorney, enter an ex parte order for the respondent’s involuntary assessment and stabilization. The emergency order still needs facts behind it. In D.H. v. K.J.R., the Second District held that a petition without a good faith basis could not support an ex parte order.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

When Waiting Can Be Dangerous

Waiting can be risky when a person may hurt themselves or others, or when withdrawal signs appear.

Under Fla.
