Casey III, Esq. · Published October 24, 2026

If your son refuses detox in Florida, start with safety. Get emergency medical help right away if he shows signs of a medical crisis. Then set clear limits, offer support, and learn how Florida’s Marchman Act works. That law can allow a court to order involuntary assessment and treatment in some cases, but only through a legal process.

Robinson & Casey focuses its practice on Marchman Act petitions and guardianship matters for families in Miami-Dade County and across South Florida. This guide explains the steps families often need to understand, in plain language.

Why a Loved One Refuses Detox, and Why It Matters Now

Most people who refuse detox are not simply being stubborn. Their reasons often come from denial, fear of withdrawal, fear of losing independence, or mixed feelings about quitting. Someone may say yes on Monday and no on Thursday.

That back-and-forth is common. It does not mean your family failed. It also does not mean your loved one is beyond help. Your worry makes sense, especially if you have watched his use get worse.

Time matters, though. Stopping heavy drinking or drug use all at once can be medically dangerous. A doctor can tell you which symptoms need immediate care. Waiting is not safe when a person drinks heavily or uses every day, even if the refusal feels like a standoff you can simply outlast.

If your son keeps refusing detox, you don't have to work through the court process alone. Do not wait for a better day.

Next, ask a physician or emergency department about medically supervised withdrawal options. Ask which level of care is safest, given his health history.

Keep a written record. Note dates, what happened, and who saw it. Include driving incidents, injuries, missed work, money problems, and threats. Clear facts help a doctor and, later, a court understand the pattern.

Keep talks short and calm. Avoid ultimatums made in anger. You might say, “I love you, and I’m worried. I’d like you to see a doctor this week.” Then stop talking and let it settle.

Can You Help Someone Who Does Not Want Help?

Adults generally cannot be made to accept treatment without a legal process. Families still have real influence, though.

Honest conversation, encouragement, and a clear plan can open a door even when refusal continues. Some people say yes after several calm talks, not after one big argument.

Florida law also draws a line on refusal. Under Fla. Stat. § 397.675, mere refusal to receive substance abuse services does not, by itself, show a lack of judgment about needing them. Under Fla. Stat. § 397.675, a court also looks for a good faith reason to believe the person is substance abuse impaired, or has a substance use disorder and a co-occurring mental health disorder, and, because of that, has lost the power of self-control with respect to substance abuse. The court also looks for one of the following: the person needs substance abuse services but, because of impaired judgment, cannot appreciate that need or make a rational decision about it; or, without care, the person is likely to suffer neglect posing a real and present threat of substantial harm, and it is not apparent that the harm can be avoided through the help of willing, able, and responsible family members or friends or other services; or there is a substantial likelihood that the person has inflicted, threatened or attempted to inflict, or, unless admitted, is likely to inflict physical harm on himself, herself, or another. A court looks at more than a “no.”

Supporting someone is different from covering for their use. Paying their bills, lending cash, or calling their employer with excuses keeps the pattern going. Support means helping with steps that build safety, such as arranging a doctor’s visit or driving them to an appointment.

Setting Boundaries and Stopping Enabling

Enabling means doing things that make it easier to keep using. Paying a phone bill, covering rent, or hiding missed shifts can all do this, even when love drives the choice.

Good boundaries are ones you can actually keep. For example: no money for substances, no use inside your home, and no covering for missed work or school. Write them down before you talk to him.

Guilt-based pressure often backfires. Lines like “After everything we’ve done for you” tend to start fights, not change. Try calm, specific statements instead. “I won’t lend you money. I will drive you to a doctor on Tuesday.”

You have permission to stop funding use while still expressing care. Stopping the money does not mean stopping the love.

Offering Support Without Forcing the Issue

You can offer support today, even if your loved one is not ready for detox. Support does not depend on a yes.

Some options include asking a doctor to talk with the family, attending family education sessions offered through a treatment program, or setting a regular time to talk when everyone is calm.

Present medical care as a step toward safety, not a punishment. You might say, “A medical team can help keep you safe while you stop.” Frame it as protection for him, not a penalty.

Your own stress and health matter too. Families who live with constant fear often lose sleep, money, and patience. Make time for your own rest.

Avoid promises you cannot keep, such as a threat you won’t follow through on. Follow-through builds trust over time.

Can You Force Someone Into Detox in Florida? How the Marchman Act Works

In some cases, yes.

For an adult, a petition may be filed by a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the impairment and prior treatment, under Fla. Stat. § 397.68112.

The petition goes to the clerk of court in the county where the person is located, and the clerk may not charge a filing fee, under Fla. J.N., the court stated: “However, the filing of the petition in the wrong county did not divest the circuit court in Putnam County of jurisdiction.”

Under Fla. Stat. § 397.68151, the court must schedule a hearing within 10 court working days unless a continuance is granted.

At the hearing, the petitioner must prove the case by clear and convincing evidence, under Fla. Stat. § 397.6957. If the court finds the conditions proven, it may order treatment for up to 90 days, under Fla. Stat. § 397.697.

In an emergency, Fla. Stat. § 397.6818 lets the court rely on the petition alone and enter an ex parte order for assessment and stabilization, without first appointing an attorney. Whether any order issues depends on the facts and what the court finds.

Frequently Asked Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can I force my son into detox in Florida?

Sometimes.
