A Marchman Act petition is a court filing under Chapter 397 of the Florida Statutes. It can lead a judge to order an adult into assessment or treatment when the legal criteria are met.

The two tools are different. So the real question is which one fits the facts in front of your family. Many families plan it with a counselor or interventionist before anyone sits down.

The strength of an intervention is preparation. Family members agree on what they will say, which limits they will set, and which treatment options are ready if the person says yes. Clear boundaries, such as no longer paying for a loved one’s bills, can also be part of the plan.

The limit is plain. An intervention has no court power. It cannot require the adult to attend, and it cannot keep the adult in treatment. If the person refuses or leaves, the family has no legal tool inside the intervention to compel care.

Families often ask how to help someone who does not want help. An intervention can open a door. It cannot make anyone walk through it, and no plan can promise that the person will say yes. When talks stall, many families turn to the court process next.

What a Marchman Act Petition Is and What It Can Do

A Marchman Act petition is a request filed with the court. It asks a judge to order an adult into involuntary assessment or treatment for substance use. The petition goes to the circuit court under Chapter 397 of the Florida Statutes.

Not everyone can file one. For an adult, a petition may come from the person’s spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the person’s substance use and prior care. Fla. Stat. § 397.68112 sets out that list.

A judge does not act on a petition automatically. The statute requires a good faith reason to believe the person meets the criteria in Fla. Stat. § 397.675. Those criteria include a loss of self-control over substance use.

If the court finds the conditions proved by clear and convincing evidence, it may order treatment for up to 90 days, under Fla. Stat. § 397.697. The Marchman Act addresses substance use, so the petition should stay focused on that issue.

When Families Usually Move From Talks to a Petition

Families usually consider a petition after talks have not worked and the risk is real. Whether a petition fits depends on the facts, and a lawyer can help you sort them out.

Common points include repeated refusals of treatment after talks. Another is a substantial likelihood that the person will cause physical harm to themselves or others in the near future, as shown by recent behavior. A third is past voluntary treatment that did not hold. Each point matters most when you can describe it with specifics.

The petition must explain why you believe the person is impaired and why the person has lost self-control. It must also state either the harm the person has inflicted or is likely to inflict, or why the refusal reflects impaired judgment. Fla. Stat. § 397.68141 lists these contents. It also requires the petitioner’s name, the relationship to the respondent, and the respondent’s attorney if known.

Keep a dated record. Write down what happened, when it happened, and what the person said or did. Note whether the person has been assessed. A petition may include a professional’s report from an exam within 30 days before filing. If there was no assessment or the person refused one, the petition must say so. Gather these details before you file.

Moving to a petition does not end family efforts. You can keep talking with your loved one while the court process runs.

What to Bring to a Marchman Act Consultation

Bring a dated timeline of substance use and incidents. Add any prior treatment history, existing court orders, and the names and relationships of family members involved. These items help a lawyer see whether the Marchman Act fits your facts.

The lawyer will review whether the facts line up with the statutory criteria and what the petition must include. The lawyer will also explain what the family needs to prepare and how the court process moves. Timing matters. The court must schedule a hearing within 10 court working days unless a continuance is granted, under Fla. Stat. § 397.68151.

The respondent also has rights. When a petition is filed, the court must immediately determine whether the respondent has a lawyer or whether appointing a lawyer for the respondent is appropriate, under Fla. Stat. § 397.68151. The respondent generally must attend the hearing, unless the court waives presence on the grounds the statute allows, under Fla. Stat. § 397.6957.

A lawyer can explain the court’s process and your family’s options. No lawyer can predict how a judge will rule.

Serving Families in Miami-Dade and South Florida

Marchman Act petitions are filed with the clerk of the court in the county where the person is located. This location rule matters for where your family starts.

Location errors can happen. In J.P. v. J.N., a Fifth District court held that filing in the wrong county did not take away the circuit court’s jurisdiction. However, the filing of the petition in the wrong county did not divest the circuit court in Putnam County of jurisdiction. J.P. v.
