You may have seen missed work, drained savings, a car crash, or threats in the home. Many families feel stuck between doing nothing and taking control of someone else’s life.

The law has a clear answer, but the details matter. The answer depends on the facts, and the biggest fact is whether your adult child agrees to treatment or refuses it. For an overview of involuntary commitment for addiction, see our involuntary commitment guide.

Can You Send an Adult Child to Rehab Without Their Consent?

Not by family decision alone. For an adult, the usual path to treatment without consent runs through a court. A judge needs proof, not just worry.

Florida law allows involuntary admission only when there is good faith reason to believe a person is substance abuse impaired, or has a substance use disorder and a co-occurring mental health disorder, and, because of that impairment or disorder, has lost the power of self-control with respect to substance abuse and meets at least one additional statutory condition, such as impaired judgment about the need for services or a likelihood of serious harm to self or others. The person must also have lost the power of self-control with respect to substance use.

The statute gives two paths after that. The first is impaired judgment. The person cannot understand their need for help or make a rational choice about it. The statute also says that mere refusal to get services is not, by itself, evidence of impaired judgment.

The second path involves danger. Without care or treatment, the person is likely to suffer from neglect or refuse to care for himself or herself, and that neglect or refusal poses a real and present threat of substantial harm to his or her well-being, and it is not apparent that such harm may be avoided through the help of willing, able, and responsible family members or friends or the provision of other services. Or there is a substantial likelihood they will hurt themselves or someone else.

How the Marchman Act Court Process Works

The Marchman Act is Florida’s law on substance abuse impairment.

For an adult, a petition may be filed by a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the substance use and prior treatment, under Fla. Stat. § 397.68112.

It must also state the facts behind the belief that the adult needs help, as Fla. Stat. § 397.68141 requires. A professional’s report from within 30 days can be attached. If the adult was never assessed, the petition must say so.

The petition goes to the clerk of the court in the county where the person is located, and the clerk may not charge a filing fee, per Fla. Stat. § 397.681. Under Fla. Stat. § 397.681(1), a petition for involuntary treatment must be filed with the clerk of the court in the county where the person is located. Under Fla. Stat. § 397.681(1), a petition for involuntary treatment for substance abuse impairment must be filed with the clerk of the court in the county where the person is located.

In an emergency, the court may act on the petition alone and issue an ex parte assessment and stabilization order, under Fla. Stat. § 397.6818. A provider generally cannot hold the person for more than 72 hours of observation without a court-approved extension or another statutory exception.

The court must schedule a hearing within 10 court working days, unless a continuance is granted, under Fla. Stat. § 397.68151. Section 397.68151 allows the court to appoint a magistrate to preside at the hearing; it does not address drug tests. Testimony must be under oath.

In J.C. v. State, the Fifth District reversed where the trial court questioned the only witness while the petitioner was absent. The Fifth District reaffirmed that rule in C.W.R.K. v. Stewart Marchman Act Behavioral Healthcare. The Fourth District has reached a different view in J.J.J. v. D.G., so treat this as Fifth District law, not a statewide rule.

If the court finds the conditions proven by clear and convincing evidence, it may order treatment for up to 90 days, under Fla. Stat. § 397.697. No one can promise how a particular judge will rule.

Marchman Act, Guardianship, or the Baker Act: Which Applies?

The Marchman Act covers substance use. The Baker Act covers mental illness. Guardianship covers an adult who cannot manage their own affairs. The facts decide which law fits.

The Baker Act’s involuntary examination rules apply when there is reason to believe a person has a mental illness and is at risk without care. See Fla. Stat. § 394.463. Many families face both issues, so the facts need careful review.

Guardianship is a separate process. If you also hold or need a power of attorney, read about how guardianship interacts with a power of attorney. For timing, see how long a guardianship takes in Florida.

Steps Families Can Take Before Filing

Start a dated record now. Note missed work, medical emergencies, driving while impaired, money taken, and any threats or violence. Specific dates and facts carry more weight than general worry.

Stop covering for the substance use. Paying the adult’s debts or making excuses to an employer can keep the problem going. Setting clear limits is a common step families take.

Pick a calm moment when your adult child is sober. The Partnership to End Addiction advises parents to listen rather than lecture and to focus on health and safety. Do not put yourself at risk during a confrontation.

In an emergency, call 911 right away. That covers an overdose or threatened violence. The Florida Department of Health notes that 988 offers immediate crisis support for Florida residents.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What to Bring to a Consultation

Bring the adult’s age and the county where they are living now.
