Once someone starts a court case to decide incapacity, the agent’s authority can be paused. A court order finding incapacity can end it, unless the court keeps some of that authority in place. Fla. The person who signs it is the principal. The person named to act for them is the agent.

An agent may act only within the authority the document grants. Under Fla. Stat. § 709.2201, an agent may use only the specific authority given, plus what is reasonably needed to carry it out. Broad phrases like “all acts the principal can do” grant nothing on their own.

A durable power of attorney is different. Under Fla. Stat. § 709.2104, a power of attorney is durable if it contains specific words, or similar words, showing the principal wants it to work after incapacity. Fla. Stat. § 709.2104 reads: “Except as otherwise provided under this part, a power of attorney is durable if it contains the words: “This durable power of attorney is not terminated by subsequent incapacity of the principal except as provided in chapter 709, Florida Statutes,” or similar words that show the principal’s intent that the authority conferred is exercisable notwithstanding the principal’s subsequent incapacity.”

An agent is a fiduciary. An agent must act in good faith and keep a record of all receipts, disbursements, and transactions made on behalf of the principal. Those duties run to the principal, not to the agent.

What a Guardianship Is and Who Asks the Court for One

A guardianship is a court case under Florida’s guardianship law, chapter 744. A judge appoints a guardian for an adult found to be incapacitated. The guardian is a fiduciary. Under Fla. Stat. § 744.361, a guardian may exercise only the rights removed from the ward and delegated to the guardian.

A guardian may handle the person, the property, or both. The court decides the scope in each case.

The court does not always remove every right. A person who has been determined incapacitated retains rights such as access to the courts and to counsel. Some rights may be removed and given to a guardian, such as the right to contract or to manage property.

When delay could cause serious harm, a court may appoint an emergency temporary guardian. Fla. Stat. § 744.3031 applies after a petition to determine incapacity has been filed. It requires the court to specifically find an apparent imminent danger that the person’s physical or mental health or safety will be seriously impaired, or that the person’s property is in danger of being wasted, misappropriated, or lost, unless immediate action is taken. The emergency authority expires 90 days after appointment or when a guardian is appointed, whichever comes first, but may be extended for an additional 90 days upon a showing that the emergency conditions still exist.

How a Court-Appointed Guardian and an Agent Interact

A guardian is not the same as an agent. But the court can reach the agent’s conduct. Under Fla. Stat. § 709.2116, a court may review the agent’s conduct, terminate the agent’s authority, remove the agent, and grant other appropriate relief.

A guardian acting for the principal may ask the court for this relief. Any other interested person may also petition, if that person shows a good-faith belief that court action is needed.

Records matter.

A simple disagreement is not always enough. Under Fla. Stat. § 744.3203, when the agent is the person’s parent, spouse, child, or grandchild, a dispute between the agent and the petitioner that is better handled in another forum is not a ground to suspend the power of attorney in a guardianship case.

Documents and Dates That Shape the Answer

Gather the papers first. Collect the original power of attorney and any amendments. Add the guardianship petition, any letters of guardianship, and every court order in the case.

Dates matter. A non-durable power of attorney ends when the principal becomes incapacitated. Compare the signing date with the date of incapacity. Then check whether the document says it is durable.

Read the scope line by line. A broad grant does not cover real estate, banking, or health care by default. An agent may exercise only the authority specifically granted in the power of attorney and any authority reasonably necessary to give effect to that grant, and general provisions do not count as such a grant.

Copies often matter too. Under Fla. Stat. § 709.2106, a photocopy generally has the same effect as the original, unless the power of attorney says otherwise, but an original may be required for recording when it is relied upon to affect title to real property.

Health Care Surrogates, Guardians of the Person, and Medical Decisions

A health care surrogate is a separate document from a financial power of attorney.

A pending incapacity case does not automatically remove health care authority. Under Fla. Stat. § 709.2109, the proceeding does not affect the agent’s health care decisions unless the court orders otherwise.

A guardian of the person may receive health care authority from the court. Fla. Stat. § 709.2109 reads: “unless otherwise ordered by the court, a proceeding to determine incapacity does not affect the authority of the agent to make health care decisions for the principal.”

Consider a parent with dementia or after a stroke. The family may have a health care surrogate named years earlier. A later guardianship petition can raise hard questions about who decides what. The documents and the court orders control the answer.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

When Addiction or a Mental Health Crisis Raises the Question

Families often face this question during a crisis. Under s. 709.2109, starting a proceeding to determine incapacity suspends the authority of an agent who is not the principal’s parent, spouse, child, or grandchild, but unless the court orders otherwise, the proceeding does not affect the agent’s authority to make health care decisions for the principal.
