The statute lets a person be taken to a receiving facility for that exam if there is reason to believe that the person has a mental illness and because of his or her mental illness meets the listed criteria.

A receiving facility is a public or private facility or hospital designated by the department to receive and hold or refer, as appropriate, involuntary patients under emergency conditions for mental health or substance abuse evaluation (§ 394.455). The facility then decides whether the person needs further care or should be released.

The goal of a hold is evaluation, not automatic treatment. Staff must find out whether the person meets the law’s criteria for further involuntary services. A hold and a later court-ordered service plan are two different steps.

How Does an Involuntary Examination Hold Begin?

Under Florida Statute § 394.463, an involuntary examination may be initiated by any one of the following means: A court order, a law enforcement officer, or a professional’s certificate can each start the examination.

Court order. A circuit or county court may issue an ex parte order (an order signed without the other side present). It must rest on sworn testimony with specific facts. If no time limit is written, the order is valid for 7 days after the date it was signed, but only until the person is delivered to the facility.

Law enforcement officer. An officer may take a person into custody when the person appears to meet the criteria. The officer must restrain the person in the least restrictive way available. The officer must also write a report.

A physician, a physician assistant, a clinical psychologist, a psychiatric nurse, an advanced practice registered nurse registered under s. 464.0123, a mental health counselor, a marriage and family therapist, or a clinical social worker who examined the person within the preceding 48 hours can execute a certificate. If less restrictive options are not available, an officer takes the person into custody.

Under a court’s ex parte order, if other less restrictive means are not available, such as voluntary appearance for outpatient evaluation, a law enforcement officer or other designated agent of the court must take the person into custody, and the order must be made part of the patient’s clinical record. That is why a hold can begin on a street or at home.

When Does an Involuntary Examination Hold Apply?

A hold applies when a person appears to have a mental illness. The word “appears” matters here.

It does not depend on a later finding about what was true.

Under Florida Statute § 394.463, a person may be taken to a receiving facility for involuntary examination if there is reason to believe that the person has a mental illness and because of his or her mental illness meets the listed criteria. The definition leaves out intoxication and conditions shown only by substance abuse, as well as developmental disabilities and conditions shown only by dementia, traumatic brain injury or antisocial behavior.

What Happens During the 72-Hour Hold?

A person held for examination must be examined by a physician or clinical psychologist without unnecessary delay.
