Casey III, Esq. · Published October 25, 2026

Florida courts can appoint an emergency temporary guardian, before a guardian is appointed but after a petition for determination of incapacity has been filed, when an adult faces imminent danger and waiting would be too risky. This page explains each step in plain language.

Families in Miami-Dade and across South Florida often reach this question suddenly. A parent may be hospitalized. A sibling may stop paying bills and make unsafe choices. The law still follows the same steps.

What Emergency Temporary Guardianship Is in Florida

An emergency temporary guardianship is a short-term court order. It lets a court-appointed person act for an adult while the full case moves forward. Florida law allows this appointment under § 744.3031, but only in a narrow set of cases.

The key word is “temporary.” A full guardianship lasts longer and covers more. A plenary guardian may exercise all powers that can be handed to someone else. A limited guardian holds only the powers the court names, under § 744.102.

An emergency appointment can happen before the court decides whether the adult needs a full guardian. It’s a bridge, not the final answer. The judge decides whether the emergency standard is met, not the family.

Families often reach this point after a sudden change. A parent may wander out at night. A relative may be losing savings to someone with no right to them. Each situation raises the same question: can the adult be protected while the court works through a full case?

If someone you love may be at risk right now, you don't have to work through the court process alone. The judge must specifically find that there appears to be imminent danger that the person’s physical or mental health or safety will be seriously impaired. The judge may also act on a finding that property is in danger of being wasted, misappropriated, or lost. Under § 744.3031, either danger, to the person or to the property, can support emergency relief. Immediate action must be needed to prevent either harm, under § 744.3031.

In these cases, the precise wording of the legal standard matters, and a consultation can help you understand how it applies to your family’s situation. The danger must be imminent and must threaten serious impairment of the adult’s physical or mental health or safety, or serious waste, misappropriation, or loss of property, and immediate action must be needed, under § 744.3031.

Facts that bear on this question can include wandering into unsafe areas, an untreated medical condition with a clear risk, or someone draining an adult’s bank account. Each case turns on its own facts. The timeline matters as much as the event itself.

The emergency test is about timing. A full guardianship asks whether the adult lacks the capacity to manage property or meet essential health and safety needs, as defined in § 744.102. That process runs through an examining committee. Once the examining committee is appointed, the court sets the date for the hearing on the petition, under § 744.331. Fla. Under Fla. Prob. R. 5.648, the emergency petition must state that imminent danger appears. It must also name the extent of guardianship requested, limited or plenary.

The petition must list the next of kin known to the petitioner. It must name the proposed emergency guardian. It must say that person is qualified, or that a willing and qualified guardian has not been located.

A petition to determine incapacity must come first or be filed alongside it. Under § 744.3201, that petition must be verified. It must include the facts behind the petitioner’s belief and the rights the adult cannot exercise. A copy of the emergency petition must be filed with it.

Any Florida resident who is 18 or older and legally competent may qualify to serve, subject to the statute’s disqualifications, under § 744.309. The court also may not favor a person just because that person already served as emergency guardian, under § 744.312.

Specific facts help. Dates, incidents, and medical notes make the danger easier to see on paper. Vague claims give a judge less to work with.

Notice, Hearing, and How Fast the Court Can Act

Notice is the first rule to know. Under § 744.3031, the adult and the adult’s attorney must receive notice of the petition and hearing at least 24 hours before the hearing starts. The exception applies only if the petitioner shows that substantial harm would occur with 24-hour notice.

The court must also appoint counsel to represent the adult during these summary proceedings. That lawyer may ask that the proceeding be recorded and transcribed.

How fast can I get guardianship in Florida? Emergency appointments are built to move faster than a full guardianship. The actual timing depends on the court’s calendar, the notice rules, and the facts in the petition.

At the hearing, the judge reviews the evidence. If the imminent danger finding is met, the court enters an order that spells out the guardian’s powers. The court may also issue an injunction or restraining order to protect the adult’s health or safety.

How Long Emergency Temporary Guardianship Lasts

An emergency temporary guardianship lasts 90 days after appointment, or until a guardian is appointed, whichever comes first. This limit comes from § 744.3031.

The authority can be extended for another 90 days, but only if the emergency conditions still exist. It must show that the conditions behind the first order still exist.

The emergency guardian also has end-of-term duties. A final report is due no later than 30 days after the emergency period expires. For a guardian of property, the report includes a verified inventory and a full accounting. For a guardian of the person, it summarizes residential placement, medical condition, and mental health services.

The emergency order does not settle who makes long-term decisions. A plenary or limited guardianship is a separate question. Track the dates on the order from day one.

Can Temporary Guardianship Be Done Without Going to Court?

No. An emergency temporary guardian is appointed by a Florida court, so a judge’s order is required. Under § 744.102, a guardian is a person the court has appointed to act for a ward. A family arrangement made outside court is not an appointment.

Other planning tools can matter when the adult still has capacity to sign. A durable power of attorney stays in effect after incapacity only if it contains the words listed in § 709.2104, or similar words. Fla.
