Often, yes, but the treating facility sets the details. The Marchman Act is Florida’s civil process for involuntary assessment and treatment of people impaired by substance use. Its admission criteria appear in Fla. Stat. § 397.675. The statute text cited here is the current version, amended in 2024.

Think of visits as a facility decision made inside the court’s order and the statute’s limits. Visit schedules, approved visitors, and check-in steps differ from one provider to another. This guide explains the general framework and the steps families can take. It doesn’t replace a conversation about your loved one’s specific case.

If your family member is in a Marchman Act process and you're unsure what comes next, you don't have to sort it out alone. A petition must be filed with the clerk in the county where the person is located. The court, not the facility, makes the final call on involuntary treatment. Each step has its own clock, so timing matters.

A hospital, detox facility, or addictions receiving facility can handle that stage, as Fla. Stat. § 397.679 explains. Early care centers on medical and clinical stabilization. That focus can shape when visitors are allowed.

For an adult, a petition may be filed by a spouse, legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the person’s impairment. That is the formal role many families have. Under Fla. Stat. § 397.68112, this list is set by the statute, and a non-relative adult must have direct personal knowledge of both the person’s impairment and his or her prior course of assessment and treatment.

The person also has a right to a lawyer. The respondent has the right to counsel at every stage, and a person who cannot afford private counsel may receive court-appointed counsel. The Second District addressed questions about counsel in Marchman Act proceedings in Hillsborough County v. Albrechta.

What Can Family Members Do to Stay Involved?

Start by asking the facility for its rules on visits, phone calls, and mail. Ask the facility for its rules. Ask the facility what its rules are, and whether it will explain them to the person and to any family involved at admission. Ask for them in writing if you can.

Expect close supervision of communications early in treatment.

Information is the next hurdle. Treatment records are confidential and generally need the person’s written consent before anyone shares them, under Fla. Stat. § 397.501. Federal rules for substance use records say a valid written consent must name the recipient, state the purpose, and carry the patient’s signature, as 42 C.F.R. § 2.31 sets out. So ask your loved one to sign a consent that names you, if they are able.

Plan for narrow updates, because sharing information about a person in treatment is limited. Keep a written log of every call and visit request, with dates and the name of the staff member.

How Long Can Someone Be Held Under a Marchman Act in Florida?

A court-ordered involuntary treatment period can last up to 90 days at first. The court may order treatment for a period not to exceed 90 days. It must find the conditions proved by clear and convincing evidence, Fla. Stat. § 397.697 provides. Release follows when the conditions that justify treatment no longer exist.

Renewal is a separate step. A renewal petition must be filed before the court-ordered period ends, by the service provider, or by the original petitioner with supporting documentation from the service provider, under Fla. Stat. § 397.6975. The court must set a hearing within 10 court working days, and the hearing must be held not more than 15 days after filing. Fla. Stat. § 397.6975 reads: “The hearing is conducted pursuant to ss. 397.6957 and 397.697 and must be held before the circuit court unless referred to a magistrate.” The court sends the renewal petition and hearing notice to all parties and counsel. Fla. Stat. § 397.6975 reads: “The hearing is conducted pursuant to ss. 397.6957 and 397.697 and must be held before the circuit court unless referred to a magistrate.” If renewal is granted, the court may order up to an additional 90 days.

Early release is also possible. Before the period ends, a person may be eligible for discharge in listed situations. One example is when the person no longer meets the criteria for involuntary admission and gives informed consent to move to voluntary treatment, as Fla. Stat. § 397.6971 describes. Keep copies of every order and note each date. Those dates control the timeline.

Can a Marchman Act Be Dropped or Dismissed in Florida?

Release decisions rest with a qualified professional, not with family members. The statute says a person admitted involuntarily may be released without a further court order only by a qualified professional in a hospital, a detoxification facility, an addictions receiving facility, or any less restrictive treatment component, under Fla. Stat. § 397.6758. When a court ordered the treatment, notice of release goes to the petitioner and the court.

The statute ties release to a professional’s decision, not to a family’s wish. Early release has its own list of grounds. Examples include a likelihood of physical harm that no longer exists, or a person who no longer needs treatment. The statute says release without further court order may be made only by a qualified professional, not by a facility’s preference.

Release also follows when the conditions justifying treatment no longer exist. Check that your contact details are on file with the court and the facility. Don’t assume a phone call ends the case. Read the order and follow the dates it sets.

Who Pays for a Marchman Act Case in Florida?

Cost depends on how the court orders treatment. The court may order treatment from a publicly funded provider. It may also order private treatment if the person can pay. It can do so if someone acting for the person shows willingness and ability to pay, under Fla. Stat. § 397.697.

Filing the petition carries no clerk fee. The clerk may not charge a fee for filing it, under Fla. Stat. § 397.681. Service of process fees can be prohibited or waived for a petitioner found indigent, as Fla. Stat. § 397.68112 provides.

Provider charges vary, so ask each provider for an itemized explanation of what it bills. Ask whether insurance or public funding applies before treatment starts. Keep every bill and estimate in writing. Lawyer fees are separate. A respondent who desires counsel and cannot afford private counsel has the right to court-appointed counsel.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk Through Your Family’s Situation With Robinson Casey

If you are trying to understand where your loved one is, you don’t have to work through it alone.
