A court petition is a separate decision, and it can wait.

If you’re searching for how to talk to an addicted adult before filing a court petition in Florida, you may be in a hard spot. You might be watching someone you love drink or use drugs. You might feel guilty, scared, or angry. You might also wonder whether Florida’s Marchman Act is the next step. This page covers the conversation that comes first, and how to tell when a talk alone may not be enough. It is part of our involuntary commitment for addiction guide.

Where You Are Right Now: Worried, Unsure, and Looking for a Way to Start

Start with a private, honest talk about one concern. Keep the court question separate until you know more.

Many families reach this point feeling responsible for a situation they didn’t choose. You may have tried to talk before and watched it end in an argument. You may not know whether a court petition is even an option. Those feelings are common. They don’t mean you’re doing it wrong.

The Marchman Act is Florida’s law for court-ordered assessment and treatment of substance use. Miami-Dade families can read the Miami-Dade Clerk’s mental health court page. It directs people seeking involuntary alcohol or drug treatment to the Clerk’s Office Probate Court for adults.

If you're weighing a court petition for an adult you love, our team at Robinson Casey can talk through what that path involves with you. A family talk and a court petition are different steps.

Most talks try to do too much at once. Pick one clear aim. Good options include:

Opening a dialogue and being heard.

Sharing one specific concern about recent behavior.

Asking the adult to agree to one evaluation or one next step.

A small, clear goal keeps the talk focused. Write it down on a sticky note if that helps you stay on it.

A family conversation does not replace a legal decision. Whether a petition fits your situation depends on the facts. That question deserves a review with an attorney. The difference between a planned intervention and a court petition is covered in intervention or court petition in Florida.

Prepare Before You Start the Conversation

Prepare by choosing a calm time, a private place, and a few specific examples.

Timing matters. Pick a moment when the adult is sober, or as sober as possible. Avoid talking during use or right after it. Talks held while someone is intoxicated often go nowhere.

Choose a private setting with no audience. Keep the time limited so both of you can leave calmly.

Write down two or three recent examples. Describe what you saw or heard, such as “You didn’t come home Tuesday night.” Avoid labels like “addict” or “alcoholic.”

Keep the group small. Agree in advance on what each person will say.

Plan for safety. If the adult has threatened you, or if overdose is a real concern, decide ahead of time how you’ll leave the room and how you’ll get emergency help.

How to Open the Conversation With an Adult Who Refuses Help

Open with care, name one specific behavior, then ask a question and listen.

Begin with short statements. Try “I’ve noticed you seem unwell, and I’m worried about you.” Avoid accusations like “You always ruin everything.”

Name the behavior and how it affects the family. Stick to one or two examples. A long list of past problems usually makes the adult defensive.

Then ask an open question, such as “What do you think is going on?” Listen to the reasons the adult gives for not wanting help. You don’t have to agree with them. Hearing them out keeps the door open.

If someone says they don’t want help, don’t argue about whether they have a problem. Acknowledge the feeling. Then offer one small next step, such as a medical checkup. If your adult child has refused detox, guidance at the refusal stage covers that point in more depth.

If you’re a parent asking how to talk to an adult son about his drinking, keep the focus on his health and your concern. Skip comparisons to others.

Florida’s courts publish recovery engagement guidance. It covers motivational interviewing, a way of talking with people who feel mixed about change. It also covers how to respond to resistance and keep the talk going.

Common Approaches That Tend to Shut the Conversation Down

Lectures, threats, bargaining, ambushes, and debates over facts often end a talk before it starts.

Lecturing. Listing every consequence often makes the adult defensive.

Threats or ultimatums. A threat in the first talk can end the discussion.

Bargaining over amounts or schedules. Negotiating how much or how often someone uses can make the problem seem accepted as normal.

Ambushes. Surprising the adult with a group, a document, or a deadline can make them shut down.

Debating facts in the moment. Arguing about what happened rarely settles anything. Return to your concern later.

If the talk goes badly, pause. You can come back to it another day. A calm return is usually easier than a second argument.

Recognizing When a Conversation Alone May Not Be Enough

A conversation alone may not be enough when someone’s safety is at risk or when they refuse any evaluation.

Florida law sets specific criteria. Among other requirements, a person must have lost the power of self-control with respect to substance abuse. Under Fla. Stat. § 397.675, there must be good faith reason to believe the person is substance abuse impaired or has a substance use disorder and a co-occurring mental health disorder. The same section says mere refusal to get services is not, by itself, evidence of lack of judgment about the need for them. Fla. Stat. § 397.68112, for an adult, a petition may be filed by a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the respondent’s substance abuse impairment and his or her prior course of assessment and treatment. Under Fla. Stat. § 397.68141, it may include a report from a qualified professional who examined the person within 30 days before filing.

The family does not make the final decision.
