Florida law does give families a court route. The main one is a petition under the Marchman Act. In some situations, a guardianship case under Chapter 744 may also apply.

Robinson Casey is a Florida law firm that focuses on Marchman Act petitions and guardianship matters for families across South Florida and statewide. A court does. Florida’s statute on who may file lists the adult’s spouse or legal guardian, any relative, a service provider, or an adult who has direct personal knowledge of the impairment and of the person’s prior course of assessment and treatment (Fla. Stat. § 397.68112). A parent can file as a relative. A parent still cannot simply order treatment.

Refusal also carries a specific legal meaning. Under Fla. Stat. § 397.675, a refusal to receive services is not, by itself, evidence that the person lacks judgment about needing them. A “no” alone is not enough. A petition needs facts that show more.

The legal question and the emotional question are different. The law asks what a court can do. Your heart asks how to keep your child safe and close to you. Both need attention, and this page covers both.

Can You Force an Adult Child Into Detox in Florida?

Yes, a Florida court can order involuntary assessment and treatment for an adult, but only when the statutory conditions are met. For involuntary outpatient treatment, the individual must be supported by a social worker or case manager of a licensed service provider, or by a willing, able, and responsible individual appointed by the court, and must meet the other statutory requirements.

The court applies set criteria. The court needs a good faith reason to believe the person is substance abuse impaired, or has a substance use disorder and a co-occurring mental health disorder. Because of that impairment, the person must have lost the power of self-control over substance use. The statute then requires either a need for services with impaired judgment about that need, or neglect that poses a real and present threat of substantial harm to the person’s well-being, where it is not apparent that such harm may be avoided through the help of willing, able, and responsible family members or friends or the provision of other services; or a substantial likelihood that the person has inflicted, threatened, or attempted physical harm on himself, herself, or another, or, unless admitted, is likely to inflict physical harm on himself, herself, or another.

For a treatment order, the court must find the conditions proved by clear and convincing evidence. Readers who want more background can review our involuntary commitment for addiction guide.

How a Marchman Act Petition Works, Step by Step

Under Florida Probate Rule 5.648, which governs petitions to appoint an emergency temporary guardian, the petitioner verifies the petition, and its contents include the alleged incapacitated person’s name, age, and residence and post office address; that there appears to be imminent danger that the person’s physical or mental health or safety will be seriously impaired, or that the person’s property is in danger of being wasted, misappropriated, or lost, unless immediate action is taken; the nature of the emergency and the reason immediate action must be taken; and the proposed guardian’s relationship to or any previous association with that person. A Marchman Act petition for involuntary services must state the name of the respondent, the name of the petitioner, the relationship between them, and the factual allegations showing the need for involuntary services for substance abuse impairment (Fla. Stat. § 397.68141); guardianship petitions are governed by separate requirements. The petition may include a professional’s report from within 30 days before filing. If the adult was not assessed or refused, the petition must say so.

Location matters. The petition goes to the clerk in the county where the person is located, and the clerk may not charge a filing fee (Fla. Stat. § 397.681). The Fifth District has treated a wrong-county filing as a venue problem, not a loss of jurisdiction (J.P. v. J.N.).

The court must set a hearing within 10 court working days unless it grants a continuance (Fla. Stat. § 397.68151). The adult has the right to counsel at every stage (Fla. Stat. § 397.681). The court must hear relevant evidence, including family members’ testimony about past history (Fla. Stat. § 397.6957). The full opinion in J.C. v. State is available on the Florida courts website.

In an emergency, the court may enter an ex parte order based on the petition alone. It may do so without appointing an attorney (Fla. Stat. § 397.6818). A provider generally may not hold the person for more than 72 hours of observation, though the statute lists exceptions. Timelines vary with the facts, so no general guide can predict how a case will move.

When Guardianship May Be the Better Question

Guardianship asks whether a person can make decisions for their own care or property. That is a different question from substance use treatment alone. A plenary guardian holds all delegable powers after the court finds the ward cannot perform all necessary tasks. A limited guardian holds only the powers the court designates (Fla. Stat. § 744.102).

A mental health guardianship request raises a similar question about a different kind of condition. Which route fits depends on the adult’s circumstances.

An emergency temporary guardian is for urgent situations. Notice of the hearing must reach the adult and their attorney at least 24 hours before it begins, unless the petitioner demonstrates that substantial harm would occur if the 24-hour notice is given. Before that emergency authority expires, any interested person may file a verified petition to extend it, showing that the conditions that warranted the appointment still exist.

It must state the nature of the emergency and whether a limited or plenary guardianship is requested (Fla. Prob. R. 5.648). Some families need both a Marchman Act route and a guardianship route.

Common Questions Parents Ask About an Adult Child Who Refuses Help

A treatment petition deals with care and stabilization. It does not answer every family question.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What if my adult son refuses to leave home?

A treatment petition does not decide where your son lives. Living arrangements raise separate property and housing questions. Those should be reviewed on their own facts.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How do I deal with an alcoholic adult daughter who denies a problem?

Denial is common. A petition must rest on factual allegations, so specific, dated events matter more than debates about her views. For conversations, the Partnership to End Addiction suggests staying calm, listening rather than lecturing, focusing on health and safety, and picking a good time to talk.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can I stop giving my adult child money without legal consequences?

Financial limits are a personal decision. Petitions must allege facts, so your notes do the heavy lifting.

Write down incidents involving alcohol or drugs. Include safety concerns, missed work or school, medical or emergency visits, and anything your child said about treatment. Note any refusal and when it happened.

Keep copies of texts and messages, police or emergency records, and any hospital or discharge papers you already have. Bring them to the first conversation.

Talk with a lawyer before you threaten legal action. Then decide with that advice what to say to your child about legal steps.

What to Expect Emotionally, and How Parents Can Care for Themselves

Most parents feel guilt, fear, and anger when a child refuses help. An adult child may respond with anger or blame once a family considers legal action. Plan for that reaction instead of being caught off guard by it.

Treatment plans can change. People sometimes leave early or change their minds. Expect that possibility and decide your next steps with it in mind.

Take care of your own basics. Protect your sleep, build a support plan within your household, and write two lists: what you can control, such as your words and your boundaries, and what you cannot, such as your child’s choices.

If someone is in immediate crisis, Florida residents can contact 988 for immediate crisis support (Florida Department of Health).

Talk With Robinson Casey About Your Family’s Situation

You may be handling a crisis on your child’s behalf, watching them refuse help, and trying to decide what to do before things get worse.
