Casey III, Esq. · Published October 26, 2026

A Marchman Act case and a job are separate questions, but a court case often reaches work quickly. This page explains Marchman Act job impact in Florida. It separates what the court process does from what happens through schedules, employer policies, and privacy. A petition alone does not settle whether someone keeps a job. The employer’s rules, the type of work, and how absences are handled matter just as much. This is general information for families and for adults named in a petition.

What a Marchman Act Case Is and Why Work Comes Up

The Marchman Act is Florida’s civil court process for getting an adult with a substance use problem into assessment and treatment. The statute asks whether there is good faith reason to believe the person is substance abuse impaired, or has a substance use disorder and a co-occurring mental health disorder, and whether that has caused the person to lose the power of self-control over substance use. The person must also meet one of the statute’s second tests, such as being unable to appreciate the need for services or being likely to neglect themselves without care or treatment. Fla. Stat. § 397.675 sets out the full criteria.

A case starts with a petition. This section sets out which courts have jurisdiction over involuntary treatment petitions: the courts have jurisdiction, and the petition must be filed with the clerk of the court in the county where the person is located under Fla. Stat. § 397.681. The admission criteria are in a different section. The respondent is named in the petition and has the right to counsel at every stage of the case, although the respondent may waive that right if present and the court finds the waiver is knowing, intelligent, and voluntary. Fla. Stat. § 397.681

Work comes up because the process takes time. Hearings, assessments, and treatment all pull people away from their schedules. Employers notice absences, even when a court ordered them. The statute governs the court process and treatment. It does not set workplace rules. Whether a job is affected turns on the employer’s written policies, any employment contract, and the type of work.

Families often ask whether an employer must hold a position open. Federal leave law may help some workers. The Family and Medical Leave Act allows an eligible employee to take leave when a serious health condition makes them unable to do their job. That leave may be unpaid. 29 U.S.C. § 2612

Eligibility depends on the employer and the worker’s history. Check it early, before a missed shift turns into a firing decision. Read the employee handbook for leave requests, attendance points, and testing rules.

How a Case Can Affect Work Indirectly

Most job problems come from the schedule, not from the court order itself. Three patterns cause the most trouble.

Missed shifts. Court dates, evaluations, intake visits, and treatment sessions can all land during work hours.

Attendance rules. Repeated absences or late arrivals can trigger points or write-ups under an attendance policy.

Performance dips. Physical withdrawal can make daily work harder for a time. Read about alcohol withdrawal during involuntary treatment to understand what that can look like.

A documented absence is different from an unexcused one. A scheduled appointment with a letter or record is easier to explain than a no-call, no-show. Ask the employer how leave gets recorded. Keep copies of appointment letters and court notices in one folder. That paper trail helps in later talks with a manager.

Safety-Sensitive Jobs, Licenses, and Employer Policies

Jobs that involve driving, heavy equipment, healthcare, childcare, or security often have stricter rules. Employers in these roles may look more closely at substance use and fitness for duty.

Federal disability law sets some limits. The Americans with Disabilities Act does not treat a person who is currently using illegal drugs as a qualified individual, when the employer acts on that use. It also protects a person who has finished a supervised rehabilitation program and is no longer using.

Many employers have a drug-free workplace policy. Under such a policy, an employer may require testing and may discipline workers for violations, including by firing them. Some licensed professions also have their own reporting rules. Those rules depend on the license.

If a mental health condition is part of the picture, federal guidance explains workplace protections and possible accommodations. The EEOC guidance on mental health conditions at work is a good starting point for that question.

Disclosure, Privacy, and What an Employer Can Learn

Court petitions and related records are confidential under Florida law. Petitions, court orders, and related records are exempt from public records disclosure. The clerk may not publish personal identifying information on a court docket or in a public file. Fla. Stat. § 397.6760

Confidential court records do not mean an employer learns nothing. An employer may hear about a case from a coworker, a family member, a drug test required by policy, or the employee’s own words. These are separate paths, and each one carries different facts.

Whether someone must tell an employer about a petition turns on the job, the policy, and any legal duties that apply. Many people share only what they need to request leave, such as a scheduled appointment. Asking for leave in writing creates a clear record. Planning that message before the situation escalates usually works better than a rushed conversation.

Can a Marchman Act Case Be Dropped, and What Does That Mean for Work?

A case can end early or finish on its own timeline. What happens depends on how far the case has gone and what the court has ordered. After a hearing, the court may dismiss the petition, order involuntary treatment services, or, if the person has not been assessed, issue an involuntary assessment and stabilization order and continue the hearing. Fla. Stat. § 397.6977 At the conclusion of the 90-day period of court-ordered involuntary services, the respondent is automatically discharged unless a motion for renewal of the involuntary services order has been filed with the court.

Ending the court case does not automatically restore a job. It also does not erase an employer’s earlier actions. Keep records of the court outcome and of any treatment completed. Those papers can matter in later conversations with an employer.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk With a Florida Marchman Act Attorney About Your Situation

A court date and a paycheck can land in the same week.
