In a guardianship, a judge decides that an adult lacks capacity to manage some or all of their affairs. The judge then appoints a guardian to act for that person.

The law also limits who can serve. § 744.309 bars anyone convicted of a felony, anyone unable to do the job because of incapacity or illness, anyone otherwise unsuitable, and anyone judicially determined to have committed abuse, abandonment, or neglect against a child or found guilty of (or pleading nolo contendere to) a listed s. 435.04 offense; it also bars certain professional, business, creditor, and employment conflicts of interest, subject to exceptions. A petitioner should check a proposed guardian against these limits before filing.

The petition has to carry the facts. The petitioner must say they believe the person is incapacitated and list the facts behind that belief. They must also name people who know those facts from personal observation. § 744.3201 requires all of this, and the petition must be verified by the petitioner.

The Guardianship Process in Florida, Step by Step

A case starts with a verified petition to determine incapacity. The petition lists the petitioner’s name, age, address, and relationship to the person. It also lists the person’s age, county of residence, address, and next of kin. Minors’ birthdates must be included.

Within 5 days after filing, the court must appoint an examining committee of three. One member must be a psychiatrist or other physician, under § 744.331. A petitioner cannot serve on the committee. Committee members also cannot be related to or associated with the petitioner.

Committee reports go to the petitioner and the person’s attorney. They must be served at least 10 days before the hearing, unless the parties waive that rule for incomplete reports. The Flagler County Clerk of Court describes the process this way: an incapacity evaluation, an examining committee, and a hearing to decide total or partial incapacity.

If the court finds incapacity, letters of guardianship follow. Under § 744.345, the letters say whether the guardianship covers the person, the property, or both. They also say whether it is plenary or limited. The guardian’s authority comes from those letters.

Notice, Rights, and Counsel for the Person Named

Notice comes first. Under § 744.331, the notice must be read to the alleged incapacitated person and given to that person’s attorney. Next of kin named in the petition must be served too. The notice must say that an attorney has been appointed to represent the person.

The person keeps important rights even after a finding. Under § 744.3215, a person determined incapacitated keeps the right to counsel and to access the courts. They also keep the rights to receive visitors, to communicate with others, and to an annual review of the guardianship report and plan.

Some rights can be removed by the order but not given to a guardian. These include the right to vote, marry, travel, hold a driver license, and seek or keep a job.

In emergency cases, the court must appoint counsel for the person during the proceeding, under § 744.3031.

For a self-filer, notice and evidence are where petitions often go wrong. A petition that leaves out a next of kin, a witness, or the factual basis may not meet the statute.

Limited, Plenary, and Emergency Temporary Guardianship: Choosing the Petition

The petition must say which type of guardianship is wanted. Under § 744.334, it states whether the extent of guardianship desired is plenary or limited. The Florida Probate Rules also require the nature of the incapacity and the nature and value of the property to be stated.

A limited guardianship gives the guardian only the powers the letters spell out. A plenary guardianship follows the full process described above, ending in a hearing on total or partial incapacity. For a deeper comparison, read our plenary vs. limited guardianship guide.

Emergency temporary guardianship works differently. A court may appoint an emergency temporary guardian only after an incapacity petition is filed. The court must find imminent danger to the person’s health or safety, or danger that property will be wasted or lost, unless immediate action is taken. Notice must reach the person and their attorney at least 24 hours before the hearing, unless the petitioner demonstrates that substantial harm to the person would occur if the 24-hour notice is given (§ 744.3031).

That emergency authority lasts 90 days or until a guardian is appointed, whichever comes first. It can be extended once for another 90 days if the emergency still exists. Our emergency temporary guardianship guide covers that process in more detail.

Alternatives to Guardianship: Power of Attorney, Health Care Surrogate, and Advance Directives

Alternatives come up early. The petition must state the reasons a guardian advocate or other alternatives are insufficient, under § 744.334. That statute names advance directives, durable powers of attorney, representative payee arrangements, and trust instruments.

A durable power of attorney lets a person name an agent for financial matters. An advance directive can record health care wishes and name a decision-maker. If a valid document exists, the petition must explain why it falls short. Our alternatives to guardianship guide explains these tools in plain terms.

Timing matters a great deal. When no valid document exists and the person cannot decide, guardianship is the court-supervised route.

Even after appointment, the court keeps looking at alternatives. Under § 744.462, if the instrument has been judicially determined to be valid, or if, after the appointment of a guardian, a petition is filed alleging that an alternative to guardianship will sufficiently address the problems of the ward, the court must review the continued need for a guardian.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Ongoing Duties and Trade-offs of Serving as a Guardian

Being a guardian is a continuing job, not a single filing.
