A filed petition alone is not the same thing. The short answer to marchman act gun ownership Florida questions starts with that difference. Florida law says a person who has been adjudicated mentally defective or committed to a mental institution may not own or possess a firearm until relief is obtained (Fla. A judge can order assessment and treatment when the legal criteria are met. Under § 397.675, the court looks for a good faith reason to believe the person is substance abuse impaired, or has a substance use disorder and a co-occurring mental health disorder. The person must also have lost the power of self-control about substance use, plus meet one further listed condition.

For an adult, a petition can come from a spouse or legal guardian, any relative, a service provider, or an adult who has direct personal knowledge of the impairment and of the person’s prior course of assessment and treatment (§ 397.68112). The clerk may not charge a filing fee (§ 397.681). The respondent has a right to counsel at every stage, which the respondent may waive if present and the court finds the waiver knowing, intelligent, and voluntary; a respondent who desires counsel and cannot afford private counsel has the right to court-appointed counsel (§ 397.681).

A petition can rest on a respondent who reasonably appears to meet the criteria for involuntary admission, on protective custody or an emergency admission within the past 10 days, or on an assessment within the past 30 days (§ 397.68111). For the full process, read our Marchman Act process overview.

Marchman Act vs. Baker Act: Why the Difference Matters for Firearms

The Marchman Act and Florida’s Baker Act are separate laws. Many people ask about guns because they heard about a Baker Act hold. The Marchman Act deals with substance use impairment. Each has its own records, so a firearm answer for one may not fit the other.

The Marchman Act side has its own firearm link. For purposes of Fla. Stat. § 790.065, the phrase “committed to a mental institution” includes involuntary substance abuse treatment under § 397.6957. It does not include a person in a mental institution for observation, a person discharged based on the physician’s initial review, or a voluntary admission. One exception applies: a voluntary admission for outpatient or inpatient treatment does count if the person had an involuntary examination under s. 394.463 and each of the section’s listed conditions were met. The definition does not include a person held only for observation, a person discharged based on the physician’s initial review, or a voluntary admission, and those exclusions matter when you read the paperwork.

Federal and Florida Firearm Rules That Can Apply

Florida’s main rule bars a person who has been adjudicated mentally defective or committed to a mental institution from owning or possessing a firearm until relief is obtained (§ 790.064). Relief may be sought from the court that made the adjudication or commitment, or from the court that ordered the record be submitted to the Department of Law Enforcement (§ 790.064). A copy of the petition goes to the state attorney, who may object.

The court grants relief only if the evidence shows the person will not likely act in a manner dangerous to public safety, and relief is not contrary to the public interest. If relief is denied, the person must wait one year before filing again. Relief from firearm disabilities is granted under sub-subparagraph d. of § 790.065, and the department then deletes the person’s mental health record from the automated database.

Federal law has its own path. A person prohibited from having firearms can apply to the U.S. Attorney General for relief. The Attorney General may grant relief if the person is not likely to act dangerously and relief is not contrary to the public interest. A denial can be reviewed in the federal district court where the person lives (18 U.S.C. § 925).

Age and License Questions Are Separate From the Order

Age and license eligibility are separate questions from a court order. Keep them apart when you read the rules. A licensed dealer must get a completed form and check photo identification before selling a firearm from inventory (§ 790.065). The form asks for identifying details, including date of birth. If the buyer is prohibited, the dealer receives a nonapproval.

The firearm possession disability runs at the same time as the purchase disability (§ 790.064). So one commitment can affect both. Florida’s firearm laws have changed in recent years. Check the current statute text before you rely on any rule.

Questions to Ask About the Order and Its Paperwork

Start with the order itself. Its type, wording, and dates shape the firearm question. Ask these questions:

What kind of order is it? At the end of the hearing, the court either dismisses the petition or orders the respondent to receive involuntary treatment services (§ 397.6957). A treatment order can run up to 90 days (§ 397.697).

Does it say the person was committed for substance abuse? Or was the person only assessed or held in protective custody? The firearm definition turns on commitment language.

What is the end date? Treatment ends automatically at 90 days unless a renewal motion is filed (§ 397.6977).

Which county was the petition filed in? A petition belongs in the county where the person is physically located. A wrong-county filing is a venue problem, and the objection can be lost if it is not raised (J.P. v. J.N.).

Was there a hearing? Testimony must be taken under oath, and the proceeding must be recorded (§ 397.6957).
