Here’s the short answer: the judge checks where the case stands, confirms who is involved, and sets the deadlines and next steps. It’s usually a brief court date, and it isn’t where the final decision gets made. This page explains that hearing for families dealing with a guardianship or Marchman Act matter in South Florida and across the state. If the notice came for someone you love, you’re in the right place.

What is a case management hearing in Florida?

A case management hearing is a status-style court date where the judge manages the timing of a case. The judge reviews what has been filed, checks that people received notice, and sets what comes next. It isn’t the main hearing on the petition. At that later hearing, testimony must be taken under oath and recorded.

Timing matters in these cases. The court can excuse that only with a knowing waiver, or if it finds presence is inconsistent with the respondent’s best interests or likely to be injurious to self or others. Check your notice for courtroom and remote instructions, arrive early, and bring every court paper you received.

What does the judge usually cover?

The judge usually confirms who is in the case and whether everyone has been properly served. Then the judge reviews filings, reports, and any evaluations the court has ordered. Under Fla. Stat. § 397.68151, the clerk must send the summons electronically to a law enforcement agency within 6 hours after it is issued, unless a chief judge authorizes private process servers. The judge also sets or adjusts deadlines for document exchange and identifies issues that need a motion first.

What is a case management order?

A case management order is the written record of what the judge decided and directed at the hearing. It usually lists deadlines, required filings, and the next court date. Read it as soon as it arrives, and keep a copy with your other papers.

It’s a scheduling document, not the final ruling. A scheduling order sets dates and steps. A ruling on the merits decides the issues. People sometimes confuse the two, so check which one you received.

Put every date on a calendar, and count from the date written in the order. If a date or direction is unclear, speak with a lawyer quickly. Guessing at a deadline is risky.

How do guardianship and Marchman Act cases differ?

Guardianship falls under Chapter 744 of the Florida Statutes. Marchman Act treatment falls under Chapter 397. Each chapter sets its own steps, so the same kind of hearing can look different in each.

In guardianship, the notice must state the time and place of the hearing. It must also say that an attorney has been appointed for the alleged incapacitated person (Fla. Stat. § 744.331, and each member of the examining committee must file his or her report with the clerk of the court within 15 days after appointment.

An emergency temporary guardianship is different. The imminent-danger standard for an emergency temporary guardian is in a different statute, Fla. Hearings are open unless the alleged incapacitated person or adjudicated ward elects a closed hearing by written notice before the hearing, or, subject to the court’s approval, by oral or written motion during the hearing (Fla. Keep the notice or summons, any petition or response papers, and a calendar of known dates in one folder. Add the names of the people involved and any records you already have.

Bring written questions. Ask which deadlines apply, who must attend, what documents the court requested, and whether remote participation is allowed.

Don’t guess in court. Testimony at the hearing is taken under oath, and the proceedings are recorded.
