Casey III, Esq. · Published October 27, 2026

Does guardianship override parental rights in Florida? Not automatically. A guardianship is created by a court order, and that order decides how much authority changes hands. Whether a particular family member loses any decision-making power depends on the facts of the case. This page explains how Florida courts approach that question, in plain language.

Short Answer: Guardianship Does Not Automatically Override Parental Rights

In Florida, a guardianship is not an automatic transfer of a family member’s authority. A guardian is a person the court appoints to act for a ward’s person, property, or both, under Fla. Stat. § 744.102. The title “guardian” does not tell you how much power changes. The court’s written order does.

Many families assume a guardian takes over everything. Each situation depends on its own facts. A person who has been determined to be incapacitated retains certain rights, including the right to be treated humanely, with dignity and respect, to have access to the courts, to have counsel, to receive visitors and communicate with others, and to privacy. That person also keeps the right to an annual review of the guardianship report and plan.

If a relative's health, safety, or drug use has you weighing a court filing, you don't have to figure it out alone, and our team is here to talk. The key idea is the “incapacitated person.” Under Fla. Stat. § 744.102, a court must first find that a person lacks the capacity to manage at least some property or to meet at least some essential health and safety needs.

“Manage property” means taking the steps needed to obtain, administer, and dispose of property, benefits, and income. “Essential health and safety needs” means the care without which serious and imminent physical injury or illness is more likely than not to occur. That includes food, shelter, clothing, and personal hygiene.

Incapacity is decided task by task. A court can find that a person lacks capacity for some tasks but not others. That is why a court can narrow a guardianship to certain areas. A finding in one area is not a finding in every area.

How Parents and Other Family Members Fit Into the Process

The court chooses who serves as guardian. Under Fla. Stat. § 744.312, the court gives preference to certain people. That list includes a person related by blood or marriage, a person with relevant experience, and a person who can manage the financial resources involved. A parent or adult sibling can fall into the blood-relative category. Being family does not settle the question alone.

The court must also consider the wishes the incapacitated person has expressed about who should serve. If that person cannot state a preference, the court considers the wishes of the next of kin. The court also checks for disqualifications and conflicts of interest.

Family members also receive notice. Under Fla. Stat. § 744.331, notice of an incapacity petition must be served on the person, their attorney, and all next of kin named in the petition. The court appoints an examining committee. Under Fla. Stat. § 744.331, each member of the examining committee must file a report with the clerk of the court within 15 days after appointment. Within 3 days after receiving each report, the clerk must serve it on the petitioner and on the attorney for the alleged incapacitated person. All reports must be served at least 10 days before the hearing on the petition, unless the reports are not complete and those parties waive the 10-day requirement. One of those members must be a psychiatrist or other physician.

How the Court Sets the Scope: Limited vs. Plenary Guardianship

A limited guardian holds only the powers the court names in its order. A plenary guardian holds all delegable legal rights and powers. That happens after the court finds the ward cannot do all the tasks needed to care for their person or property, under Fla. Stat. § 744.102. Plenary is the broader label. Limited is the narrower one.

The statute sorts rights into three groups. Some can be removed by the order but cannot be handed to a guardian. These include the right to vote, to travel, to hold a driver license, and to seek or keep a job. Under Fla. Stat. § 744.3215, the right to marry is subject to court approval when the right to contract has been removed.

A third group can be removed and given to the guardian. These include the right to contract, to sue and defend lawsuits, to manage property, to decide where they live, and to make health care decisions.

The Florida guardianship manual from Florida State Courts covers limited guardianship and restoration of rights. A National Guardianship Association report notes that Florida lacks uniform statewide data on restoration outcomes.

Emergency Temporary Guardianship and Urgent Situations

An emergency temporary guardian can be appointed quickly when waiting would cause serious harm. The court can make that appointment after a petition to determine incapacity is filed. It must find imminent danger to the person’s physical or mental health or safety, or danger that property will be wasted or lost. Any adult interested in that person’s welfare may apply.

The process still has safeguards. The court must appoint counsel for the alleged incapacitated person. Notice of the emergency petition and hearing must be served at least 24 hours before the hearing. The only exception is when the petitioner shows substantial harm would occur if that notice is given.

Time limits matter. Emergency authority ends 90 days after appointment or when a guardian is appointed, whichever comes first. It may be extended for another 90 days if the emergency conditions still exist. The longer-term question of scope is handled in the later guardianship proceeding.

Guardianship vs. Marchman Act Involuntary Commitment for Addiction

Guardianship deals with incapacity to manage property or meet essential needs. A Marchman Act petition deals with substance use. Under Fla. Stat. § 397.675, involuntary admission requires a good-faith reason to believe the person is substance abuse impaired or has a substance use disorder and a co-occurring mental health disorder. The person must also have lost the power of self-control with respect to substance use. A judgment or risk-of-harm standard must also be met.

For an adult, Fla. Stat. § 397.68112 lets a petition come from the respondent’s spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the respondent’s substance abuse impairment and prior course of assessment and treatment. A parent or sibling may therefore be a petitioner. The Second District has also held that a Marchman respondent has a constitutional right to counsel, in Hillsborough County v. Albrechta.

The two routes can overlap. A family may face both an addiction problem and a question about whether the person can manage money or basic needs. The right path depends on the facts. If your relative lives outside Florida, our out-of-state adult child guide covers that situation. That talk can be hard. Pick a calm time. Focus on specific, recent events rather than labels. Say what you have noticed and what worries you.

Court filings also depend on facts. Under Fla. Stat. § 744.3201, a verified petition must state whether the person uses assistance to exercise their rights, such as supported decisionmaking. If they do, it must explain why that help is inappropriate or insufficient. Keeping clear notes on dates and events makes those facts easier to describe.

No one can predict how the other person will respond. Our talk-before-filing guide walks through that step in more detail.

Next Steps and Who to Contact

A guardianship does not automatically override parental rights in Florida. The court order sets the scope, and the court chooses the guardian. Key points to remember:

A guardianship is created by a court order, not by the title alone.

The order can be limited to certain areas or cover all delegable powers.

The court weighs the person’s own wishes and the next of kin’s wishes.

Emergency temporary guardianship is short, lasting up to 90 days, with a possible 90-day extension.

The Marchman Act addresses substance use through a separate process.

This page was prepared under the responsibility of Richard J.
