Your brother drinks until he can’t hold a job. Your sister refuses treatment and keeps ending up in emergency rooms. Money disappears, bills pile up, and each crisis seems to bring you back to the same place.

The Marchman Act is Florida’s court process for substance abuse impairment. Its rules sit in Chapter 397 of the Florida Statutes.

For an adult, § 397.68112 lets several people file. That includes a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the impairment and the prior course of assessment and treatment. A sibling is a relative, so a sibling can be the petitioner.

The petition asks the court to order involuntary treatment services. For an adult, it may be filed by the person’s spouse or legal guardian, any relative, a service provider, or an adult who has direct personal knowledge of the person’s substance abuse impairment and prior course of assessment and treatment. If the legal criteria are met, it can also ask for involuntary treatment services.

What Florida Courts Look For Under the Marchman Act

The court needs a good faith reason to believe your loved one meets the criteria for involuntary admission. Those criteria are in § 397.675.

The person must have a substance abuse impairment, or a substance use disorder with a co-occurring mental health disorder. Because of that condition, the person has lost the power of self-control with respect to substance use.

The person must also meet one of two further tests:

They need substance abuse services and, because of the impairment, can’t appreciate that need or make a rational decision about it. A simple refusal of services is not, by itself, proof of lost judgment.

Without care, they are likely to neglect themselves or refuse care in a way that poses a real and present threat of substantial harm, and it is not apparent that the harm can be avoided through willing, able, and responsible family members or friends or other services. Or there is a substantial likelihood that they have inflicted, or threatened or attempted to inflict, or, unless admitted, are likely to inflict, physical harm on themselves or others.

Your petition must name both of you, state your relationship, and set out specific facts. A recent, concrete incident carries more weight than a general worry. Whether your facts meet these tests depends on the facts.

Marchman Act or Baker Act: Which Law Applies

The Marchman Act applies when substance use is the core problem. Crises driven by mental illness alone follow different rules, so the facts decide which route fits.

Many families face both at once. Florida’s criteria in § 397.675 cover a substance use disorder paired with a co-occurring mental health disorder, so that overlap matters.

Ask yourself what drives the danger most. Is it alcohol or drugs, or psychiatric symptoms? Families often describe a cycle: a hospital stay, a release, missed medication, then use again. Keep dates and records of each episode. A pattern like that gives the court concrete facts to weigh.

How the Marchman Act Process Works, Step by Step

The petition goes to the clerk, a hearing is set within 10 court working days unless a continuance is granted, and the court may appoint a magistrate to preside at the hearing.

Consultation and timeline. Your attorney reviews the facts, records, and past treatment, then builds a dated timeline.

Filing. Under Fla.
