If you’re looking into a Marchman Act for your brother or sister in Florida, you may have already tried everything you can think of. There may have been emergency visits, refused help, or dangerous choices.

The law runs through the court and focuses on substance use impairment. It is not a general mental health process. A sibling is a relative, and the statute lets “any relative” petition for an adult respondent. The law also lists a spouse or legal guardian, a service provider, and an adult with direct personal knowledge of the person’s impairment and treatment history (§ 397.68112).

It must also state the facts behind it (§ 397.68141). Those facts should explain why you believe the person is impaired. They should show how the impairment has cost them self-control over substance use. At the hearing, the petitioner must prove by clear and convincing evidence that the person is substance abuse impaired and has a history of not complying with treatment. The petitioner must also prove that, because of the impairment, the person is unlikely to voluntarily participate in recommended services or cannot determine whether services are necessary. Finally, the petitioner must prove either that without services the person is likely to suffer neglect or refuse self-care, posing a real and present threat of substantial harm, with a substantial likelihood of serious bodily harm to self or others in the near future as shown by recent behavior; or that the person’s refusal of care rests on judgment so impaired by substance abuse that the person cannot appreciate the need for care or make a rational decision about it.

General worry is not enough. Dates, incidents, prior treatment attempts, and refusals give the court something concrete. A petition may include an assessment by a qualified professional done within 30 days before filing. If there was no assessment, or the person refused one, the petition must say so.

Filing location matters. The clerk may not charge a filing fee (§ 397.681). In J.P. v. J.N., a Fifth District court held that filing in the wrong county was a venue defect, not a loss of jurisdiction. However, the filing of the petition in the wrong county did not divest the circuit court in Putnam County of jurisdiction. Confirm where your brother or sister is physically located before you file.

Families asking who else can start a petition for a partner can read our guide on spouses and partners. Whether your facts support a petition turns on the details, and a consultation is where those details get reviewed.

Marchman Act, Baker Act, and Guardianship: How They Differ

The Marchman Act addresses substance use impairment. The Baker Act is a separate Florida law for involuntary examination related to mental illness, with its own rules. Guardianship addresses who has legal authority to make decisions.

A guardianship is a court appointment. It gives a guardian authority over decisions about medical care, money, housing, or daily life when a person cannot make safe decisions. Robinson Casey handles plenary, limited, emergency temporary, and mental health guardianship matters.

A family may need more than one tool. A Marchman petition asks for assessment and treatment. A guardianship asks for authority over specific decisions. Which path fits depends on your loved one’s condition and on which decisions need legal authority.

What the Court Must Find Under the Marchman Act

The court may order treatment only when the conditions are proved by clear and convincing evidence (§ 397.697). That is a high bar, and the petitioner has to meet it.

The person must then also meet one of several further tests. Fla. Stat. § 397.675 reads: “(b) Without care or treatment, is likely to suffer from neglect or refuse to care for himself or herself; that such neglect or refusal poses a real and present threat of substantial harm to his or her well-being; and that it is not apparent that such harm may be avoided through the help of willing, able, and responsible family members or friends or the provision of other services, or there is substantial likelihood that the person has inflicted, or threatened to or attempted to inflict, or, unless admitted, is likely to inflict, physical harm on himself, herself, or another.” The statute also says a mere refusal of services is not, by itself, evidence of lack of judgment. Fla. The court hears family members who know the person’s history. Testimony is under oath.

In J.C. v. State, the Fifth District reversed an order where the trial court questioned the only witness while the petitioner was absent. The appellate court said the judge was functioning as the absent petitioner. The judge decides the case, but the petitioner must present it.

How the Marchman Act Process Works, Step by Step

The process moves from petition to court review, to possible emergency assessment, to a hearing, and then to a treatment order if the court finds the criteria met.

Fact review. Gather dates, incidents, medical history, prior treatment, and refusals of care.

Filing. The petition goes to the clerk in the county where the person is located.

Emergency review. When emergency circumstances exist, the court may rely on the petition alone and enter an ex parte order for assessment and stabilization (§ 397.6818).
