Casey III, Esq., responsible lawyer, Robinson Casey.

Your Child Is Being Discharged, and No Treatment Plan Is in Place

A hospital discharged without an addiction treatment plan is a real risk in Florida, and it can happen fast. If a discharge date is set and no treatment is lined up, a parent has options, and the timing matters.

The call probably came from a nurse or social worker. Your adult child is still using, still fragile, and nobody has clearly said where they will go next. You may have already paid for treatment, tried interventions, and set hard boundaries. Now the crisis is back in front of you.

You are likely afraid of the obvious things. You fear another overdose. You fear your child will be jailed or end up homeless. And you fear that nothing will work, and that you are the only one holding this together.

This page explains how hospital discharge works in Florida, what warning signs to watch for, and how a Marchman Act petition fits in. It does not promise any result. Every case turns on its own facts.

If your child's discharge date is close and no treatment is arranged, you don't have to face that call alone. It usually includes follow-up care and referrals to other services.

A useful plan names what was treated, which follow-up visits are booked, and who will be told about the discharge. Ask the team three direct questions: What is being treated? What follow-up is scheduled? Who will be notified?

Ask for the answers in writing. A verbal promise is hard to act on when the discharge date arrives.

Discharge planning is a process, not a bed. A plan can exist on paper while no detox or residential bed is open. Ask for a named program and a confirmed intake date, not just a referral sheet.

Florida law also sets duties for the provider. When a provider refuses an involuntary admission, it must try to reach the referral source, and that can include a parent. If it cannot reach that person, it must refuse admission and try to help the patient find other services (Florida provider duties statute).

Why a Patient Can Leave With No Addiction Treatment Plan

A patient can leave with no addiction plan when the immediate medical danger has passed but the addiction itself has not been treated. Hospitals stabilize the emergency. Addiction treatment is a separate step.

Once the medical emergency ends, a hospital may discharge a patient who no longer meets its medical criteria. That can happen even when no addiction program has been arranged.

Refusing treatment does not, by itself, prove a person lacks judgment. The statute says mere refusal is not evidence of lack of judgment about the need for services (Florida involuntary admission criteria). Under Fla. Stat. § 397.675, the person must have lost the power of self-control with respect to substance abuse. In addition, either they must need substance abuse services and their judgment must be so impaired that they cannot appreciate that need or make a rational decision about it, or, without care, they must be likely to suffer neglect posing a real and present threat of substantial harm that does not appear avoidable through the help of willing, able, and responsible family members or friends or other services, or there must be a substantial likelihood that they have inflicted, threatened or attempted to inflict, or, unless admitted, are likely to inflict physical harm on themselves or another. That is why a parent often hears “they said no” and feels stuck.

Privacy rules add another barrier. Federal law keeps substance use disorder records confidential and limits disclosure without written consent (federal substance use records law).

Red Flags That the Discharge Is Premature or Unplanned

The clearest warning signs are a missing written plan, no confirmed program intake, and no explanation of what happens if your child leaves. Watch for these signs:

No written discharge plan or follow-up appointment before the discharge date.

No referral to a detox, residential, or outpatient program with a confirmed intake date.

No overdose plan explained to you, including whether overdose-reversal medication was discussed.

No explanation of what the hospital will do if your child refuses treatment or tries to leave.

You learned the discharge date only after it was already set.

If you see any of these, ask for a conversation now. Waiting until the discharge day leaves you fewer options.

How the Marchman Act Can Apply When a Discharge Leaves Your Child Unprotected

The Marchman Act lets a qualifying family member ask a Florida court to order involuntary assessment, stabilization, or treatment for a person with a substance use problem. A court, not the family or the lawyer, decides whether the legal criteria are met.

A parent can file. For an adult, the statute allows a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the impairment and prior treatment to file (Florida persons who may petition statute).

The petition goes to the clerk of the court in the county where the person is located. The clerk may not charge a filing fee for it (Florida jurisdiction and counsel statute). Location matters.

The criteria focus on impairment and loss of self-control. They also cover whether the person can appreciate the need for care, or faces a real and present threat of harm (Florida involuntary admission criteria).

When an emergency exists, the court can enter an ex parte order for assessment and stabilization without appointing an attorney first. A provider generally cannot hold the person for more than 72 hours of observation, with limited exceptions (Florida court determination statute).

For the full overview, see our Marchman Act guide.

What a Court Order Can Cover and What Follows

A court can order involuntary treatment for a period not to exceed 90 days. The court must find the conditions proved by clear and convincing evidence (Florida involuntary treatment order statute).

The court keeps jurisdiction after the order. It can monitor compliance, change the treatment setting, or start contempt proceedings for violating an order (Florida involuntary treatment order statute).

The court must schedule a hearing within 10 court working days unless a continuance is granted (Florida petition hearing statute). Under the petition hearing statute, the court must immediately determine whether your child is represented by an attorney or whether appointing counsel is appropriate. Our Marchman Act guide covers the broader process.

Appellate courts in Florida have addressed these questions in different ways, and the 2024 amendments may affect them.

A provider can release a person without a new court order only through a qualified professional. When a court ordered the treatment, the petitioner and the court must receive notice of the release (Florida release statute).
