Casey III, Esq. · Published October 30, 2026

To talk to an adult child before a Marchman Act petition, decide what the talk is for, pick a calm and private moment, and describe specific things you have seen. The talk may not fix the problem, but it shows you what your family can try before anyone goes to court. This page gives general information about Florida law. It is not advice on your own facts.

Where You Are Right Now: Carrying Your Family’s Strain Alone

If your spouse’s substance use or mental illness has made the home feel unsafe, you are not overreacting. This is a hard place to be, and you don’t have to pretend otherwise. Maybe there was a frightening night, a hospital stay, or a car you found wrecked. Maybe the bills are late again and no one will explain why.

Your worries are probably the same ones many spouses carry. You worry about the children seeing it and absorbing it. You worry about money running out. You worry about what happens if nothing changes, and whether the marriage and the family can survive it. And you feel like you are holding all of it by yourself.

Families facing this situation often have questions about how the court process works, and a consultation can help clarify them. Knowing that route exists can help you think clearly about the next step.

If your spouse's drinking or drug use has made every day feel unsafe, you don't have to work out the Marchman Act alone; our team can talk it through with you. Each goal needs a different kind of conversation. Trying to do all three at once usually turns into an argument.

A single talk rarely covers everything. Sharing concern is the gentlest goal. Asking for an assessment or treatment is a bigger request. Setting limits is about what you will do, not what your spouse must agree to. When you name one goal, the talk stays focused and easier to finish.

Write down specific behaviors and dates before you talk. “You’re always drunk” is a label. “On March 3 you didn’t come home, and the car was missing until morning” is a fact. Facts are harder to dismiss and easier to discuss.

Also decide in advance what you will ask for and what you will not negotiate. For example, you might decide you will not pay the rent that was missed, and you will ask for one doctor’s appointment this week. Having these answers ready keeps you steady if the talk goes sideways.

Choose the Moment, the Setting, and the People in the Room

Pick a time when your adult child is sober or calm and not in the middle of a crisis. A conversation during a fight, a binge, or a bad withdrawal is unlikely to go well. Waiting for a quieter day is a real choice, even when it feels slow.

Choose a private, low-pressure place with no children nearby. The kitchen table with the television off works better than a car ride or a crowded restaurant. Keep the talk short enough that you can finish it without rushing.

Think about whether one trusted family member should be present. That person can help you stay on track and remember what was said. If your family already works with a clinician or counselor, ask whether that person can join or advise you on how to start. Do not bring money disputes into the talk. Those fights tend to take over every other point.

How to Open the Conversation With an Adult Child Who Refuses Help

Open with one specific thing you saw, how it affected you, and one clear request. This approach keeps the talk about facts and feelings instead of character.

Try something like this: “Last Tuesday you didn’t come home, and I didn’t know where you were. I’m scared, and I need us to find help together.” The statement uses “I,” names a real event, and asks for one step. It avoids words like “lazy” or “selfish,” which put the other person on the defensive.

Expect denial, minimizing, or anger. Many adults who use substances or live with a mental illness do not see the problem the way their family does. Plan a calm reply, such as “I hear that you don’t think it’s that bad. I still need us to talk about it.” Then stop pushing.

If the talk turns hostile, end it early and say when you can return to it. A short, calm exit often works better than pushing for agreement on the spot. The second talk may go better than the first, because both of you have had time to think.

Common Approaches That Tend to Shut the Conversation Down

Ultimatums delivered in anger, lectures, and public confrontations usually end the talk before it starts. So do threats you do not plan to carry out. Your child learns that the threat is empty, and the next conversation feels pointless.

Comparisons to other people also shut doors. Phrases like “Your brother never acted like this” make the adult child feel judged, not helped. Lectures about the addiction or the illness rarely change behavior in the moment.

Be careful about covering every consequence. Paying every bill, making every excuse, or cleaning up every mess can hide the real effects from your child. Families sometimes call this enabling, which means making it easier for the problem to continue.

Keep “tough love” separate from the Marchman Act. Tough love is an everyday approach: firm limits and honest talk. The Marchman Act is a formal court process with its own rules, petitions, and hearings. Using one term for the other can confuse your family and your child about what is actually happening.

Helping Without Enabling: Setting Limits That Protect Both of You

A limit is a rule you can keep. Examples include no more loans, no covering missed bills, and no driving the car after drinking. A limit you cannot keep teaches your child that the rule does not count.

Protect the children’s routines and safety first. Decide ahead of time what you will do if a limit is crossed. For example, you may decide that if your spouse drives the children after drinking, you will take the keys and call a trusted adult to pick the children up. Write this plan down so you do not have to invent it in a crisis.

Separate household money from shared debts where you can. Open a separate account for the bills that must be paid, and keep emergency cash somewhere your spouse cannot easily reach. Talk with a financial professional about your own situation if the debts are large.

Remember that limits protect your household. They do not replace getting your loved one assessed or treated. A limit keeps the home steadier while the bigger question is still open.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Can You Force an Adult Child Into Treatment in Florida?

Florida law allows a court to order involuntary treatment for an adult who meets the statutory criteria, but only when the conditions for involuntary treatment services have been proved by clear and convincing evidence. The court makes that decision after a process, not because a family member asks.

The statute says a person may meet the criteria if there is a good faith reason to believe they are substance abuse impaired and have lost the power of self-control. The person must also need services and be unable to make a rational decision about them, or be at risk of serious harm to self or others.
