Under Fla. Stat. § 397.6957, a respondent may not be involuntarily ordered into treatment without a clinical assessment, unless he or she is present in court and expressly waives the assessment. The court may excuse the person’s presence at the hearing only if he or she knowingly, intelligently, and voluntarily waives the right to be present or, upon receiving proof of service and evaluating the circumstances of the case, finds that presence is inconsistent with his or her best interests or is likely to be injurious to self or others.

That makes the assessment a central step, not an optional one. A family member’s observations at home can’t replace it. Those observations still matter, because they start the process and give the court context.

The admission standard also looks at judgment. Under Fla. Stat. § 397.675, the person must have lost the power of self-control with respect to substance abuse. The person must also meet one of several further conditions, such as being unable to see the need for services or posing a real threat of substantial harm. The 2024 amendment says that mere refusal of services does not, by itself, show a lack of judgment. Fla. Stat. § 397.675 reads: “(b) Without care or treatment, is likely to suffer from neglect or refuse to care for himself or herself; that such neglect or refusal poses a real and present threat of substantial harm to his or her well-being; and that it is not apparent that such harm may be avoided through the help of willing, able, and responsible family members or friends or the provision of other services, or there is substantial likelihood that the person has inflicted, or threatened to or attempted to inflict, or, unless admitted, is likely to inflict, physical harm on himself, herself, or another.”

The hearing is a separate step. The judge decides the petition after reviewing all relevant evidence, including the assessment results and testimony from family members who know the person’s history.

Quick Answers

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can a family member file?

Yes. For an adult, a spouse or legal guardian, any relative, a service provider, or an adult who has direct personal knowledge of the person’s substance abuse impairment and prior course of assessment and treatment may file, under Fla. The petition must name the respondent and the petitioner and state their relationship.

A certificate or report of a qualified professional who examined the respondent within 30 days before the petition was filed can go with the petition. If no assessment happened, or the person refused one, the petition must say so.

A recent assessment is one way to file, not the only way. Under Fla. Stat. § 397.68111, a person can be the subject of a petition if they reasonably appear to meet the admission criteria. The same is true if they were under protective custody or had an emergency admission within the previous 10 days, or were assessed within 30 days.

In an emergency, the court can act quickly. The court may rely only on the petition and, without appointing an attorney, enter an ex parte order (an order issued without the other side present) for assessment and stabilization. Under Fla. Stat. § 397.6818, a service provider may hold the person for no more than 72 hours of observation, unless an exception in the statute applies.

Under Fla. Stat. § 397.6957(1)(b), an order for assessment issued in a nonemergency situation remains valid for 90 days, so that time period does not depend on a court finding that a substance abuse emergency exists. If the person remains unassessed after 90 days, the court must dismiss the case.

Who Performs the Evaluation and What Happens Once It Is Done

A qualified professional performs the clinical assessment. The written report then goes to the court before the hearing. For emergency admissions, the statute lists who may sign a professional’s certificate. That list includes physicians, clinical psychologists, psychiatric nurses, and clinical social workers, according to Fla. Stat. § 397.6793. The certificate must be signed and is valid for 7 days after it is issued.

The assessing professional must send the clinical assessment to the clerk no later than the close of business the day before the hearing. It must also note any co-occurring mental health needs. A report without a treatment recommendation leads to dismissal. So does a recommendation of no treatment.

The respondent may ask for an independent assessment by a qualified professional. The court must hear and review all relevant evidence, under Fla. Stat. § 397.6957.

Who presents the evidence matters too. The petitioner carries the burden of proof.

The hearing must be held within 10 court working days unless a continuance is granted, under Fla. Stat. § 397.68151. The respondent has a right to counsel at every stage, which the respondent may waive if present and the court finds the waiver is made knowingly, intelligently, and voluntarily, under Fla. Stat. § 397.681.

Capacity Evaluations in Related Guardianship Matters

Guardianship is a separate process from a Marchman Act petition. This page provides general information about Florida guardianship law. The Marchman Act is in Chapter 397.

A Marchman petition focuses on substance abuse impairment and whether involuntary treatment is needed. Guardianship asks a broader question. Can your loved one make safe decisions about medical care, money, housing and daily life?

Families often ask about several guardianship types. These include emergency temporary guardianship, limited guardianship, plenary guardianship, and mental health guardianship. Each has its own scope. The right fit depends on the facts of your family’s situation.

The two processes can overlap. When substance use and an inability to manage daily life both exist, the facts decide which process fits. For more on treatment options under the Marchman Act, read our guide on medication and psychiatric treatment.

Documents and Details to Gather Before Speaking With a Lawyer

Start with a dated timeline. Write down specific behaviors, dates, hospital stays, refused care, and money problems. A general description like “he’s not himself” helps less than a specific entry. For example: “On March 3, she refused her medication and left the apartment at night.”

Gather records you already hold. These include discharge papers, prescription lists, notes from prior treatment, and unpaid bills. Note any unusual bank activity or transactions you can document.

Note who was present for each incident. Also note who else saw the same behavior. Witnesses who can describe what they saw are often as useful as your own notes.

Your relationship to the person matters. If the respondent is an adult, a petition for involuntary treatment services may be filed by the respondent’s spouse or legal guardian, any relative, a service provider, or an adult who has direct personal knowledge of the respondent’s substance abuse impairment and prior course of assessment and treatment. Write down how you know what you know.

Keep your records focused on the person’s condition and safety. Share personal details with care, and limit them to what matters to the case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talking Through Your Family’s Situation With Robinson Casey

Your next step is a conversation about your family’s facts.
