Each crisis ends in another hospital visit, and then the same unsafe days at home. You’re weighing a Marchman Act petition, and one question keeps coming back: how does the person find out? Marchman Act service of process in Florida follows set steps. The clerk issues a summons. Then the papers go to the person through official channels, not through you. This page walks through each step.

Why Notice Comes Before Any Marchman Act Hearing

Florida requires formal notice before a court can hear a Marchman Act petition. Notice tells the person what was filed and when the hearing is set, so they can respond.

The Marchman Act is Florida’s law on court-ordered treatment for substance abuse impairment. Section 397.68151 of the Florida Statutes addresses the filing of a petition for involuntary services for a substance abuse impaired person and the appointment of counsel. Under Fla. Stat. § 397.68151, a copy of the petition and the notice of hearing must go to the respondent. The respondent is the person named in the petition.

Notice protects the person’s right to know the case against them. It also protects the process itself. Courts look closely at whether each required step was followed, so doing it right from the start matters.

Under Fla. Stat. § 397.681, the respondent has a right to counsel at every stage, which the respondent may waive if present and the court finds the waiver knowing, intelligent, and voluntary. Each one has a job. The petition explains the case. The notice sets the date. The summons calls the person to court.

Under Fla. Stat. § 397.68141, the petition must name the respondent and the petitioner. It must state how they are related and name the respondent’s attorney, if known.

The petition must also give the facts. It must explain why the petitioner believes the person is impaired and has lost self-control. It must also explain either the risk of physical harm or why the person’s refusal of care rests on impaired judgment.

Be specific. Write down dates, events, and what you saw. Vague worry gives the court little to work with.

If the person had an evaluation within 30 days before filing, the petition may include it. If they refused an evaluation or were never assessed, the petition must say so.

Who Delivers the Papers: Sheriff, Process Server, or Court-Designated Person

The clerk issues the summons, and it usually goes to a law enforcement agency for service. The chief judge can instead allow private process servers.

Under Fla. Stat. § 397.68151, the clerk must send the summons, petition, and notice electronically to a law enforcement agency within 6 hours after the summons issues. Unless the chief judge authorizes disinterested private process servers, that transmission is required.

“Disinterested” means a server with no stake in the case.

Section 397.68151 does not address custody orders or the sheriff; it requires the clerk, within 6 hours after the summons is issued, to submit the summons and, if applicable, the petition and notice to a law enforcement agency to serve the person whose admission is sought, unless the chief judge authorizes disinterested private process servers to serve parties under this chapter.

Expect this moment to be tense.

Timing Between Filing and the Hearing

The court must schedule the hearing within 10 court working days, unless a continuance is granted. That deadline comes from the same statute that governs notice.

The petition belongs in the county where the person is physically located when it is filed.

The clerk cannot charge a fee for filing the petition. Florida law gives a respondent the right to counsel at every stage of a judicial proceeding relating to a petition for involuntary treatment for substance abuse impairment; however, the respondent may waive that right if the respondent is present and the court finds that such waiver is made knowingly, intelligently, and voluntarily.

In an emergency, the court may act faster. It can enter an ex parte order without appointing a lawyer. Under Fla. Stat. § 397.6818, a provider may hold the person for no more than 72 hours of observation unless a listed exception applies.

Court records are confidential. Under Fla. Stat. § 397.6760, the clerk may release them to the petitioner and others the statute names.

When the Person Cannot Be Found or Will Not Accept the Papers

If the person does not appear at the hearing, the court may act again. Under Fla. Stat. § 397.6818, this applies even when service failed. The court may reissue an emergency order only if it still reasonably believes the respondent meets the commitment criteria and that a substance abuse emergency exists.

That order lasts 90 days. If the person’s location is known, the court must continue the case for no more than 10 court working days.

Some deadlines are firm. An ex parte order not carried out by the initial hearing date is void. If the person has not been assessed within 90 days, the court must dismiss the case.

Keep a written log. Record each address you tried, each date, each call, and who you spoke with. These details help you answer the court’s questions clearly.

Searching for someone in crisis is exhausting. You may feel pulled between fear and guilt. A steady, written record keeps the facts clear when emotions run high.

What Happens at the Hearing After Notice Is Complete

Once notice is complete, the court holds the hearing. The respondent must attend unless the court finds that they knowingly, intelligently, and voluntarily waive that right or, after evaluating the circumstances, that their presence is inconsistent with their best interests or is likely to be injurious to self or others. Under Fla. Stat. § 397.6957, the court hears all relevant evidence, including testimony from family members who know the person’s history.

Testimony is given under oath, and the proceeding is recorded. The respondent may refuse to testify.

The petitioner carries the burden of proof.

If the court finds the conditions proved by clear and convincing evidence, it must either order the respondent to receive involuntary treatment services from his or her chosen licensed service provider if possible and appropriate, or dismiss the petition. Any treatment order must include findings regarding the respondent’s need for treatment and the appropriateness of other less restrictive alternatives. The court keeps authority to monitor compliance after that.

For what happens after an order, read our Marchman Act treatment placement guide.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk Through Your Family’s Situation With Robinson Casey

If a Marchman Act petition is being prepared for your loved one, a direct conversation can clarify the next steps.
