It means the evidence must leave the judge with a firm belief that the conditions are met.

Whether a specific case qualifies depends on the facts. Those facts include the person’s substance use history, recent conduct and what qualified professionals have documented. No outcome can be predicted here. Each petition goes before a judge on its own record.

What the Marchman Act Is and Who Can File a Petition

The Marchman Act is the Florida law, in Chapter 397 of the Florida Statutes, that allows court-ordered assessment and treatment for substance use. It is separate from the Baker Act, which covers mental-health involuntary examinations. Florida’s Baker Act bench guide describes those separate court procedures.

A spouse can file. For an adult, the petition may be filed by the respondent’s spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the substance use and prior treatment.

A qualified professional’s report from an exam within 30 days before filing may be attached.

Location matters. The petition is filed with the clerk in the county where the person is located, and the clerk may not charge a filing fee. As J.P. v. J.N. states: “However, the filing of the petition in the wrong county did not divest the circuit court in Putnam County of jurisdiction.”

How the Court Process Works, Step by Step

A Marchman case moves from petition to hearing, and an order follows only if the court finds the criteria proved. The court must schedule a hearing within 10 court working days unless a continuance is granted.

A respondent who wants a lawyer and cannot afford private counsel has the right to court-appointed counsel, as § 397.681 explains.

Courts have jurisdiction of involuntary treatment petitions for substance abuse impaired persons, and the clerk may not charge a fee for filing. Testimony from family members and drug tests are covered by § 397.6957, not this section. The person must be present unless the court finds that they knowingly, intelligently, and voluntarily waive the right to be present, or, after receiving proof of service and evaluating the circumstances, that presence is inconsistent with their best interests or is likely to be injurious to self or others.

If the court finds the conditions proved, it can order up to 90 days of involuntary treatment. If the conditions are expected to exist after 90 days, a renewal of the involuntary services order may be requested under s. 397.6975 before the 90-day period ends.

A provider may not hold the person longer than 72 hours for observation unless a listed exception applies.

Florida’s appeals courts disagree on one point. The Fifth District held that a trial court may not call and question the professional when the petitioner is absent. The Fourth District reached a different result in J.J.J. v. D.G. and certified conflict. According to C.W.R.K. v. Stewart Marchman Act Behavioral Healthcare, the trial court failed to follow the governing statute when, in the absence of the petitioner, it called and questioned the health care professional who executed the involuntary services certificate.

Why Pregnancy Changes the Conversation

Pregnancy does not add a separate test under the Marchman Act, but it can become part of the evidence. The court hears all relevant evidence, so medical information about the pregnancy may be considered.

Keep the paperwork organized from the start. Gather prenatal appointment dates, written reports from treating providers and any assessment that names a treatment recommendation. A clinical assessment must note whether the person has any co-occurring mental health or other treatment needs and must contain a recommendation on the level of substance abuse treatment the person requires, if any.

Keep records of who was present, what was said and what happened afterward. Those details help the court understand the household’s real situation. Your own account matters, and so does what others saw.

The respondent must be present at the hearing on a petition for involuntary treatment services unless the court finds he or she knowingly, intelligently, and voluntarily waives the right to be present or, upon receiving proof of service, finds that presence is inconsistent with best interests or likely injurious; the respondent may refuse to testify. The court’s decision depends on evidence presented in the courtroom, not on how worried the family feels.

What Families Often Do While the Question Is Open

Start a dated, factual log. Write down the date, what happened, who saw it and what was said. Specific events are easier for a court to weigh than general statements like “he is always drunk.”

Track the money, too. Note unpaid bills, unexplained withdrawals and any spending that affects the children’s needs. Keep copies of statements and receipts.

If someone is in immediate danger, call 911 first. The Marchman process is a court process that takes time. It involves filings, notice and hearings, and each step has its own timing rules.

Do not wait for the court to fix the household alone.
