For a homeless adult child, it is one of the main legal routes to explore.

If you are searching for homeless adult addiction involuntary treatment Florida options, you have probably been here before. Maybe it was the overdose call, the hospital discharge, or the shelter that would not take your child back.

Now you don’t know where your child is sleeping tonight. Your fears are specific. You fear an overdose that ends in death. You fear jail. You fear your child will live on the street with no way out. That reaction is common, and it does not by itself decide the case.

When Guardianship Comes Into the Picture

Guardianship is a separate court tool for an adult who cannot make safe decisions about personal care, housing or treatment. The court must specifically find that there appears to be imminent danger that your child’s physical or mental health or safety will be seriously impaired, or that property is in danger of being wasted, misappropriated, or lost, unless immediate action is taken. Notice must reach your child and their attorney at least 24 hours before the hearing, unless the petitioner demonstrates that substantial harm would occur if the 24-hour notice is given. It can be extended 90 days if emergency conditions still exist.

Under § 744.331, once the court appoints the examining committee, it sets the date on which the petition will be heard. Fla. A limited guardian holds only the powers the court grants. That difference matters when your child can make some decisions but not others.

Mental health guardianship fits when a co-occurring mental health condition is part of the facts. Your attorney reviews which route fits your facts.

How Homelessness Changes the Legal Picture

An adult with no fixed address changes how the court handles notice and location.
