This is the broadest form of guardianship under state law, and it comes with substantial legal duties that the court enforces. If you’ve been appointed as a plenary guardian, or you’re considering whether one is necessary for a loved one, understanding these obligations is essential—they’re not optional, and they carry real legal consequences.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What Is a Plenary Guardian in Florida?

A plenary guardian holds authority over both the ward’s personal decisions and their financial affairs, unlike a limited guardian who retains certain rights for the ward. The court appoints a plenary guardian only after finding that an adult lacks the capacity to manage their person or property. This finding means the ward cannot make informed decisions about healthcare, living arrangements, or finances, and a responsible adult must act on their behalf.

Plenary guardianship is different from limited guardianship. In a limited guardianship, the court preserves specific rights for the ward—for example, the right to vote or to make certain medical decisions. A plenary guardian has no such restrictions. The ward loses the right to make decisions about where they live, what medical care they receive, and how their money is spent. This broader authority creates broader responsibilities.

Duties to the Ward as a Person

A plenary guardian must ensure the ward’s health, safety, and well-being. This goes beyond simply keeping them alive—it means actively managing their day-to-day care and quality of life.

Medical and healthcare decisions fall squarely on the guardian’s shoulders. You’ll consent to or refuse medical treatment, arrange for necessary surgeries or therapies, and make end-of-life decisions if the time comes. These choices must be guided by what’s best for the ward, not what’s convenient for the guardian.

Living arrangements are also your responsibility. You decide whether the ward lives at home, in assisted living, in a nursing facility, or elsewhere. This decision should reflect the ward’s needs, preferences (to the extent they can express them), and available resources.

Personal services—nutrition, hygiene, clothing, and daily support—must be arranged and monitored. If the ward can’t bathe or dress themselves, you ensure someone provides that care. If they can’t prepare meals, you arrange for food and feeding assistance.

Florida Statute 744.331 requires that you visit the ward regularly and maintain contact. The statute doesn’t specify an exact frequency, but the visits must be documented and must reflect a genuine relationship with the ward’s condition and needs. A guardian who never visits is not meeting this duty.

You should also foster the ward’s social and recreational needs. Isolation harms mental and physical health. Arranging for activities, social contact, or community involvement—within the ward’s abilities and interests—is part of your role.

Fiduciary Duties Over the Ward’s Property

When you manage a ward’s money and assets, you’re acting as a fiduciary. This is a legal status that carries specific, enforceable duties.

The duty of loyalty means you must act in the ward’s best interest, not your own. You cannot use the ward’s money to pay for your own expenses, even if you’re providing care. You cannot borrow from the ward’s estate. You cannot make investments that benefit you at the ward’s expense. This duty is absolute.

The duty of prudence requires you to manage the ward’s assets as a reasonably careful person would manage their own. You can’t take reckless risks with the ward’s money. You can’t leave large sums in a checking account earning no interest if safer investments are available. You must balance safety and reasonable return.

Within 60 days of your appointment (or as ordered by the court), you must file a detailed inventory of all the ward’s assets with the probate court. This inventory lists every bank account, investment, piece of real estate, vehicle, and item of value. It must be thorough and accurate. This protects both the ward and you—it creates a clear record of what you’re responsible for.

You’re required to file an annual accounting with the court. This document shows every dollar that came in, every dollar that went out, and the current balance. You’ll list medical expenses, living expenses, investments, distributions, and fees. The court reviews these accountings. If something looks wrong, the court will ask questions.

Court approval is required before you sell real property, make large expenditures, or engage in certain transactions. You can’t simply decide to sell the ward’s house without a court order. This oversight protects the ward from hasty or self-interested decisions.

You must post a bond in most cases. The bond is insurance that protects the ward’s estate if you mishandle funds. The cost is typically paid from the ward’s estate, but it’s a real expense and a real requirement.

Have questions about what happened?

Ask our team directly. This is not optional and not flexible. Missing this deadline can result in sanctions or removal.

Your annual accounting is due every year on or before the anniversary of your appointment. It must be complete, accurate, and itemized. The court may require you to provide receipts or documentation.

You may be required to file a guardianship plan that outlines your goals for the ward’s care and services. This plan documents how you’re addressing the ward’s medical, social, and personal needs.

Status reports on the ward’s condition, living situation, and any significant changes must be provided to the court as ordered. If the ward’s health declines or improves, if they move, or if there are disputes, you may need to report this to the court.

Failure to comply with these obligations can result in court sanctions, removal as guardian, or even personal liability for damages.

Personal Conduct Standards for Guardians

Beyond the specific financial and care duties, the law holds guardians to a high standard of personal conduct.

You must act in good faith and with honesty. This means being truthful with the court, the ward, and family members. It means disclosing conflicts of interest. It means not hiding transactions or misrepresenting the ward’s condition.

You cannot commingle the ward’s funds with your own money. Every dollar belonging to the ward must be in an account separate from your personal accounts. Mixing funds—even temporarily—violates this duty and can result in liability.

You must avoid conflicts of interest. If you’re also a beneficiary of the ward’s will, or if you have a financial interest in decisions you’re making for the ward, you must disclose this to the court. In some cases, you may be required to recuse yourself from certain decisions.

You must keep the ward informed to the extent they’re capable of understanding. Even if the ward has cognitive decline, you should explain decisions and respect their preferences where possible. This isn’t just ethical—it’s a legal requirement.

You’re prohibited from abuse, neglect, exploitation, or abandonment of the ward. This is both a legal duty and a criminal matter. Guardians who exploit or neglect wards face removal, civil liability, and criminal prosecution.

When Guardianship Ends or Changes

Guardianship is not permanent unless circumstances warrant it.

Restoration of capacity can occur if the ward’s condition improves. If the ward regains the ability to manage their person or property, they (or a family member) can petition the court to restore their rights. The burden is on whoever seeks restoration, but it’s always possible.

Death of the ward automatically terminates the guardianship. You’ll file a final accounting and your duties end.

Modification or termination can happen if the court finds the guardianship is no longer necessary or if a less restrictive alternative (like a limited guardianship) would be more appropriate. This can occur at any time.

Guardian resignation or removal ends your role. The court may remove you for cause—breach of duty, self-dealing, or neglect—or you may resign. A successor guardian is appointed.

When guardianship ends, you must file a final accounting showing all transactions up to the end date. This closes the court’s supervision of the estate.

Want to know where you stand?

Tell us what happened and our team will walk you through the options available to you, at no cost.

Get a free review

Get a free review

Common Questions About Plenary Guardianship Duties
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How do I know what decisions require court approval?

Generally, routine care and expenses don’t require court approval.
