This page explains those statutes in plain language. It is general information, not legal advice, and other requirements may apply.

Why Families Ask Whether a Marchman Act Affects Firearms

Families ask this question because a loved one’s substance use has reached a dangerous point, and guns may be in the home. That worry is fair. It also makes the situation feel heavier, because the answer depends on details that are easy to misread.

If you’re reading this for a parent, spouse, sibling, or adult child, you probably didn’t choose this situation. You may be trying to keep that person safe and protect everyone else in the house while you figure out what the law says.

The short answer is that the court decides. The court looks at the petition, the evidence, and the findings it makes. The statutes set the limits on firearms, not a general rule. This page covers the main Florida and federal statutes, the questions to ask before you act, and where to get help. It does not predict how your case will turn out.

If a Marchman Act concern has you weighing the firearms in your home, you don't have to sort out the law alone. Stat. § 397.675. That statute says a person may meet the criteria if there is a good faith reason to believe the person is substance abuse impaired. It also requires a finding that, because of that impairment, the person has lost the power of self-control with respect to substance abuse. The statute lists more findings the court considers. A label or diagnosis alone does not settle the question.

Petitions go to the clerk of the court in the county where the person is located. The clerk may not charge a filing fee, under Fla. Stat. § 397.681. That same statute gives the respondent a right to counsel at every stage. Our Marchman Act attorney page covers the petition process in more detail.

Federal Firearm Prohibitions That May Apply to Involuntary Commitment

Whether it applies is a legal question tied to the exact order and findings.

Subsection (a) of section 922 of the federal firearms law begins, “It shall be unlawful—” and then lists the specific acts it covers. These include transfers and possession limits tied to certain categories of people. Whether a particular state commitment falls into one of those categories depends on the statute’s exact terms and the findings made. A general summary cannot answer that for you.

Federal relief may also be possible. Section 925 of the federal firearms law provides that a person who is prohibited from possessing, shipping, transporting, or receiving firearms or ammunition may make application to the Attorney General for relief from the disabilities imposed by Federal laws. The Attorney General may grant relief if satisfied the applicant is not likely to act in a manner dangerous to public safety, and relief is not contrary to the public interest. If relief is denied, the person may ask a federal district court to review that denial.

Read the exact order and its findings before drawing a conclusion. Don’t assume a Marchman Act order triggers federal rules, and don’t assume it never does.

Florida Firearm Laws and Background Check Consequences

Florida law bars a person who has been adjudicated mentally defective or committed to a mental institution from owning or possessing a firearm. That bar lasts until relief is obtained, under Fla. Stat. § 790.064.

Records can also reach state systems. Fla. Stat. § 397.6760 makes these court records confidential. It also says confidentiality does not stop the clerk from submitting information required by § 790.065 to the Department of Law Enforcement. How a record is reported depends on the statute and the agency involved.

None of these consequences is automatic. Confirm what your specific order says before you assume anything.

Temporary Firearm Removal and Court Orders During a Petition

Emergencies follow a separate path. Fla. Stat. § 397.6818 says that when emergency circumstances exist, the court may rely on the petition alone and, without appointing an attorney, enter an ex parte order for assessment and stabilization. The same statute says a service provider may not hold a person for more than 72 hours of observation, unless one of the statute’s listed exceptions applies.

Fla. Stat. § 790.401 defines a “petitioner” for a risk protection order as a law enforcement officer or a law enforcement agency that petitions a court for a risk protection order under that section. Fla. Stat. § 790.401 says a law enforcement officer or agency petitions for those orders. Its sample order language tells the respondent to surrender firearms and ammunition.

Whether any order issues, and how it is carried out, depends on the court and the facts. Don’t assume a fixed sequence of events.

Can Firearm Rights Be Restored After a Marchman Act Matter?

Florida’s statute describes a process for relief, but eligibility and outcome depend on the court’s decision. Under Fla. Stat. § 790.064, a person may petition the court that made the adjudication or commitment for relief.

The statute says the person must follow the procedures in § 790.065(2). Under § 790.065, the court shall grant relief if it finds, based on the evidence, that the person will not likely act dangerously to public safety and that relief is not contrary to the public interest. Other requirements also apply, and the court decides based on the evidence. If the court denies relief, the statute says the person may not petition again until one year after the final order.

This page does not say restoration is available or will be granted in any case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Questions to Ask Before Making Decisions About Firearms

Before any firearm decision, find out exactly what the court ordered or found.
