Casey III, Esq. · Published October 13, 2026

Florida law lets certain people ask a court to order involuntary treatment for substance use. A family member cannot simply decide that someone must enter rehab. The court makes that decision based on the evidence.

If you’re asking how to commit someone to rehab, this guide walks through the general route. It also covers the other options families weigh. This is general information, not advice about your situation.

What Involuntary Rehab Means Under Florida’s Marchman Act

Involuntary rehab is court-ordered assessment and treatment for a person with a substance use problem. In Florida, that route runs through the Marchman Act.

Voluntary treatment works differently. Under Fla. Stat. § 397.601, a person who wants treatment may apply to a service provider for voluntary admission.

The Marchman Act covers substance use. It does not cover every behavior problem a family faces. The criteria for involuntary admission appear in Fla. Stat. § 397.675. That section lists several requirements, so read the full text before relying on any summary. The court decides whether they are met. J.C. v. Timing depends on the court’s schedule.

Gather the facts. Write down specific behavior, dates, and any prior assessment or treatment. Stat. § 397.68151 says the court must determine right away whether the person has a lawyer or whether one should be appointed. It also says the court shall schedule a hearing within 10 court working days, unless a continuance is granted.

Emergency orders. When emergency circumstances exist, Fla. Stat. § 397.6818 lets the court rely on the petition. The court may then enter an ex parte order, meaning one entered without the other side present, for assessment and stabilization.

Notice and hearing. Under Chapter 397, Florida Statutes, copies of the petition and notice are provided to the respondent and others the statute names, and the court decides how notice is handled in each case.

What Can Happen at and After the Hearing

Under sections 397.6957 and 397.697, Florida Statutes, if the court finds the conditions proved by clear and convincing evidence, it may order treatment for a period not to exceed 90 days. Whether to enter an order, and its terms, depend on the evidence and the court’s discretion. The court still decides the case.

Possible order. Under Chapter 397, Florida Statutes, the court may order treatment from a publicly funded provider for a period not to exceed 90 days. Other requirements may apply, and the court decides based on its discretion and the circumstances. A privately funded provider may be ordered if the respondent can pay, or if someone acting for the respondent shows willingness and ability to pay.

Continued oversight. Under Chapter 397, Florida Statutes, the court may retain jurisdiction after an order and may enter further orders as the circumstances require, in its discretion.

Early release. Fla. Stat. § 397.681 says a respondent has the right to counsel at every stage.

Outcomes depend on the evidence, the court’s discretion, and the facts of each case. No lawyer can promise how a judge will rule.

Other Paths Families Consider, and How to Support a Loved One

Voluntary treatment is one option, and the court route is another. Neither fits every family, so the right choice depends on the person’s situation.

Under Fla. Stat. § 397.601, a person must be admitted when there is sufficient evidence of substance abuse impairment. That admission is subject to the provider’s financial and space capabilities. The person’s medical and behavioral conditions must also be within the provider’s safe management capabilities.

Some practical steps can help while you decide:

Write down dated, specific examples of behavior. Stick to what you saw or heard.

Keep conversations calm. Avoid confrontations when the person is intoxicated or threatening.

Plan for safety. If someone is in immediate danger, contact emergency services first.

Keep your own support network in place. Caring for someone with a substance use problem is hard on the whole family.

Those notes can also help anyone who later reviews the facts with a lawyer.

Frequently Asked Questions

Short answers to common questions follow.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can you put a family member in rehab?

A court may order involuntary treatment under the Marchman Act if the statute’s requirements are met.
