A judge decides only after a petition is filed and the statute’s requirements are met.

If you’re searching “can u force someone into rehab,” you may be worried about someone you love. You may also be unsure what the law allows. This page explains the process in plain terms.

What Does Forcing Someone Into Rehab Mean Under Florida Law?

Forced treatment in Florida is a court process. It is not a decision a family makes at home.

The Marchman Act covers court-ordered treatment for substance abuse impairment. The criteria for involuntary admission appear in Fla. Stat. § 397.675. In general, the person must be substance abuse impaired and must have lost the power of self-control with respect to substance use. The statute sets further requirements, and the court decides whether they are met.

Voluntary treatment is a separate path. Under Fla. Stat. § 397.601, a person who wants treatment may apply to a service provider for voluntary admission.

Where you file matters, too. Under Fla. Stat. § 397.681, a petition goes to the clerk of the court in the county where the person is located. Under Fla. For a minor, a parent, legal guardian, or service provider may file, subject to the same qualifications.

The petition’s contents matter, too. Under Fla. Stat. § 397.68141, it must name the person and the petitioner. It must state their relationship and give the facts behind the belief about impairment and lost self-control. It must also give a reason tied to likely harm, or to impaired judgment that keeps the person from understanding the need for care.

A petition may include a report from a qualified professional who examined the person within 30 days before filing. If the person was not assessed, the petition must say so.

Can You Force an Adult Son, Daughter, or Spouse Into Rehab?

The Marchman Act applies to adults as well as minors. A court, not the family, decides each case. If you’re asking whether an adult can be ordered into treatment, the answer depends on the statute and the evidence.

Refusal alone isn’t enough. The statute says mere refusal to receive services does not, by itself, show lack of judgment about the need for care. The court looks at the whole picture. J.C. v. It sets criteria for adults too, and it leaves the decision to the court after evidence is presented.

What to Expect: The Marchman Act Process Step by Step

Each stage depends on the court’s schedule and discretion.

The first consultation is free, confidential, and carries no obligation to continue.

Petition filed. The petition goes to the clerk of the court where the person is located.

Counsel and scheduling. Under Fla.
