Under Florida’s Marchman Act, a court may order involuntary treatment for substance use, but only through a court process, and the court decides whether any order is entered.

If you are worried about someone you love, this page explains the law in plain terms. It is general information, not advice about your specific situation.

The Short Answer: It Depends on Florida Law and the Court’s Decision

In Florida, involuntary substance use treatment is generally handled through a court process, not a family’s decision alone.

The statute’s criteria include a good faith reason to believe the person is substance abuse impaired. They also include a finding that, because of that impairment, the person has lost the power of self-control with respect to substance use (Fla. Stat. § 397.675). The statute pairs loss of self-control with one of its listed alternatives, and other requirements may also apply.

The court decides whether those requirements are met, based on the evidence and its discretion. No outcome is automatic. Robinson & Casey focuses on Marchman Act petitions and guardianship matters.

If someone you love is struggling and you're unsure whether a court can step in, you don't have to sort it out alone. For the broader framework, read our Marchman Act attorney guide.

Who Can File a Petition and What the Court Considers

For an adult, the statute names who may file. These include a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the person’s impairment and prior treatment (Fla. Stat. § 397.68112). Other requirements may apply, and the court decides whether the petition goes forward.

The petition must name the respondent and the petitioner. Among the contents Fla. Stat. § 397.68141 requires are the petitioner’s relationship to the respondent, the respondent’s attorney if known, and the factual allegations the statute describes, and the section lists other required contents as well. It may include a report from a qualified professional who examined the person within 30 days before filing.

The petition is filed with the clerk of the court in the county where the person is located. The clerk may not charge a filing fee (Fla. Stat. § 397.681).

Filing a petition does not decide the case. The court still must decide whether the statutory criteria are met.

What Happens After a Petition Is Filed

After filing, the court must decide whether the person has a lawyer or whether appointing one is appropriate (Fla. Stat. § 397.68151). The statute says the court shall schedule a hearing within 10 court working days unless a continuance is granted. Timing beyond that depends on the court’s schedule and discretion.

The statute says the respondent must be present at the hearing unless the court makes certain findings (Fla. Stat. § 397.6957). Testimony is taken under oath and the proceedings are recorded.

If the court finds the conditions proved by clear and convincing evidence, it may order involuntary treatment services for a period not to exceed 90 days (Fla. Stat. § 397.697). A renewal may be requested before that period ends, as provided in Fla. Stat. § 397.6975. Whether an order is entered, and for how long, is for the court to decide.

Refusal of Treatment and the Admission Criteria

The statute says that mere refusal to receive services is not, by itself, evidence of lack of judgment about the need for services (Fla. Stat. § 397.675). Refusal does not end the court process on its own. The court still decides.

The respondent has rights. A respondent has the right to counsel at every stage of the proceeding, and may waive it only if present and the court finds the waiver knowing, intelligent, and voluntary (Fla. Stat. § 397.681).

A person may also be found eligible for discharge before the 90-day period ends in listed circumstances. One example is when the person no longer meets the criteria and gives informed consent to voluntary status (Fla. The Marchman Act route runs through a petition and a court decision.

The statute lists circumstances in which a person may be the subject of a petition. One such circumstance, as described in Fla. Stat. § 397.68111, is that the person reasonably appears to meet the statute’s criteria for involuntary admission; other requirements may apply, and the court decides whether they are met. Other requirements may apply, and the court decides whether a petition proceeds.

Family knowledge can matter in the process. The court may hear testimony from family members familiar with the person’s prior history (Fla.
