Casey III, Esq. · Published October 14, 2026

If you’re trying to figure out how to admit someone to rehab, Florida offers two main paths. The first is voluntary admission, where the person agrees to enter treatment. The second is a court process under the Marchman Act, which applies when a loved one refuses help. This page explains both paths in plain English. It is general information, not legal advice. Richard J. Casey III, Esq. is the responsible lawyer for this page. Robinson & Casey focuses on Marchman Act petitions and guardianship matters.

What Admitting Someone to Rehab Actually Means

Admitting someone to rehab means a licensed treatment provider accepts that person for substance use treatment. This can happen because the person agreed, or because a court orders it under state law.

Under Fla. Stat. § 397.601, a person who wishes to enter treatment for substance abuse may apply to a service provider for voluntary admission. The voluntary path starts when the person applies to a service provider. The court path appears in the Marchman Act, which lets certain people ask a court for involuntary treatment.

Two practical points matter from the start. Admission rules and intake steps differ from one provider to another. A court decides any contested matter, based on the evidence and its discretion. Nothing on this page predicts how a court will rule in a particular case. Every family’s situation is different, so the details matter.

If you're watching a loved one's health slip, you don't have to sort out the legal options alone. Pick a moment that isn’t rushed. Avoid arguments, holidays, and times when they are angry or intoxicated. Timing shapes the talk more than any single phrase.

Speak about specific things you have seen. Name the missed shifts, the unpaid bills, or the night you found them unable to drive. Specific facts are harder to argue with than labels like “addict” or “drunk.” Use “I” statements, such as “I’m scared when you drive after drinking.” Keep the focus on the problem, not on past mistakes.

Before you talk, prepare a short, realistic plan. Know what treatment options you could ask about. Know what insurance or payment details might be needed. Decide who could drive them to an intake appointment. A plan shows you have thought it through. It also gives your loved one something concrete to consider.

Expect resistance. Your loved one may say no the first time, or agree and then change their mind. A first conversation may not end in agreement, and that doesn’t mean it failed. You can end it calmly, leave the door open, and try again later. If anyone is in immediate danger, contact emergency services right away.

Setting Healthy Boundaries Without Losing the Relationship

Healthy boundaries are limits you set on your own actions, and you can keep them. A boundary describes what you will do, not what you want the other person to do.

“I won’t lend money for bills” is a boundary you control. “Get treatment or you’re out” is an ultimatum, and families often struggle to enforce those. Pick limits you can truly maintain. A limit you drop teaches the opposite lesson.

Families often consider boundaries like these. You might stop paying for the results of substance use, such as fines or towing. You might decline to lend cash. You might not allow use in the home, or keep children out of unsafe situations. Each family decides its own limits.

Watch for enabling. Enabling means shielding a person from the results of their use, such as calling in sick for them or hiding the problem from relatives. Enabling usually comes from love and fear, so the goal is not blame. The goal is to step back where you can.

Boundaries are a family decision. They don’t, by themselves, lead to treatment admission. They can make room for a conversation about help, but no boundary can make another adult agree to treatment. Keep your own support in place too, through people you trust.

How Voluntary Admission Works

Voluntary admission is the path where the person chooses treatment and applies to a service provider. Florida law says a person who wishes to enter treatment for substance abuse may apply to a service provider for voluntary admission. Fla. Stat. § 397.601 also says a person must be admitted when there is sufficient evidence of substance abuse impairment. That duty applies within the provider’s financial and space capabilities. The statute also looks at whether the person’s medical and behavioral conditions are beyond the provider’s safe management capabilities.

The section adds that the provider must emphasize the least restrictive setting appropriate to the person’s treatment needs. Read these terms as written. The statute does not promise a particular program, bed, or start date.

Families can get ready for the steps that often come next. Gather identification, insurance or payment details, and a list of current medications. Ask each program directly what its admission requirements are, what documents it needs, and how intake works. Availability and timing depend on the provider, so ask before you assume.

When Your Loved One Refuses: Florida’s Marchman Act

When voluntary treatment is refused, the Marchman Act lets certain people file a court petition for involuntary treatment. A petition must be filed with the clerk of court in the county where the person is located. Fla. Stat. § 397.681 also says the clerk may not charge a fee for filing that petition. The same section gives a respondent the right to counsel at every stage. The respondent may waive that right only if present and the court finds the waiver knowing, intelligent, and voluntary.

Who may file depends on age. For an adult, Fla. Stat. § 397.68112 lists a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the impairment. For a minor, a parent, legal guardian, or service provider may file. Other requirements may apply, and the court decides.

The petition must state the names of both parties and their relationship. It must also state the factual reasons for the petitioner’s belief. Fla. Stat. § 397.68141 lists these requirements. Involuntary admission criteria appear in Fla. Stat. § 397.675. Those criteria include a good faith reason to believe the person is impaired, and other requirements also apply.

Venue, meaning the right county, matters.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Emergency Steps, Assessment, and Stabilization

In an emergency, the statute lets a court act on the petition alone. Under Fla. Stat. § 397.6818, when emergency circumstances exist, the court may rely solely on the petition’s contents. Without appointing an attorney, it may enter an ex parte order for involuntary assessment and stabilization. Ex parte means the court acts without both sides present. That order must be carried out while the hearing on the petition is pending.

The same section says a service provider may not hold the respondent for longer than 72 hours of observation, unless a listed exception applies. One exception is a court-approved extension after a hearing. The statute also says an ex parte order not executed by the initial hearing date is deemed void.

If the court finds the conditions proved by clear and convincing evidence, it may order involuntary treatment for a period not to exceed 90 days. Timing, placement, and length depend on the statute’s terms and the court’s schedule and discretion. Nothing here promises how quickly any step will happen.

Special Situations: Minors, Guardianship, and Other Matters

A minor’s admission follows different rules. A parent, legal guardian, or service provider may file a petition for a minor. For voluntary services, the statute removes the disability of minority for people under 18, solely for obtaining substance abuse services from a licensed provider.

For involuntary admission, the statute says the disability of minority is not removed. Parental participation may be required as the court finds appropriate. That is a court decision, not an automatic result.

Guardianship is a separate legal area. Families sometimes look into it when a loved one cannot manage personal or financial decisions. It involves different statutes and procedures than the Marchman Act. This page does not cover it in depth.

Other statutes and procedures can apply to your situation. If your matter falls outside this practice, you may need a referral to another lawyer or firm. For the full overview of the Marchman Act work, see our Marchman Act attorney page.

Frequently Asked Questions

Here are short answers to common questions about how to admit someone to rehab in Florida.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How do I admit someone in rehab?

Start with voluntary admission, where the person applies to a service provider.
