Casey III, Esq. · Published October 14, 2026

Learning how to start an intervention for drug addiction Florida families can use starts with one clear idea. An intervention is a planned family conversation. It is not a court case. If the person still refuses, a Marchman Act petition may be an option. Under Fla. Stat. § 397.68111, a person may be the subject of a petition for court-ordered involuntary treatment pursuant to this part if that person meets one of the conditions listed in the statute, and other requirements may also apply. The court decides whether any order is entered.

Where You Are Right Now: Intervention and the Marchman Act Are Different Steps

An intervention and a Marchman Act petition are different steps. The first is a family conversation. The second is a request filed with a court.

You may be the only person in your household who is worried. You may also be carrying this with a spouse, parent, or sibling. Either way, you’re trying to work out what comes first.

An intervention is supportive and planned. The family speaks together to encourage treatment.

The statute text linked here lists the conditions under which a person may be the subject of a petition for court-ordered involuntary treatment pursuant to this part, and other requirements may also apply. Fla. Stat. § 397.68111 The court decides whether any order is entered. Other requirements may apply.

A family may choose to try a conversation first. That choice is personal, and it has legal and medical sides worth talking through. Don’t wait for a crisis, and don’t try to solve everything in one talk.

Refusal is part of addiction for many people. A “no” in one moment does not answer whether help is needed. Treat the first refusal as information, not the final word.

Pick a time when everyone is sober and not rushed. Avoid holidays, active arguments, and the hours right after a bad night.

Write down one goal for the first conversation. A useful goal might be agreeing to a medical or treatment assessment. A narrow goal gives everyone a clear finish line.

Emotions run high in these talks. Don’t make threats you can’t follow through on. A threat that never happens teaches the person that your words don’t count.

Assess Safety First: When an Intervention Is Not the Right Next Step

If someone is in immediate danger, emergency help comes first. Call 911 or go to the nearest emergency room for signs of overdose, suicidal statements, or threats of violence. The planned talk can wait.

Emergency help handles the moment. It does not replace ongoing medical care or a treatment plan. Plan for follow-up care after the crisis passes.

Don’t confront a person who is impaired. If it’s safe, talk when they are sober. Protect your own safety too. If you feel threatened, leave the room and keep a safe place to go.

Florida law also covers emergencies in court. Under § 397.6818, when a petitioner says emergency circumstances exist, the court may rely on the petition alone. It may then enter an ex parte order for assessment and stabilization without appointing a lawyer. The court decides whether to do so, based on the petition and its discretion.

Gather Facts and Document the Pattern Before You Talk

Write down dated, specific facts you saw or heard yourself. Specific facts are more useful than labels like “out of control.”

Useful notes often include:

Specific incidents, with dates and what happened

Missed work, school, or appointments

Money or property that went missing

Driving incidents

Statements the person made about using

For example, “On March 3, he missed his shift and said he had used that morning” is clearer than “He’s always high.” Keep notes private and accurate. Don’t exaggerate. If you’re unsure of a date, write that you’re unsure.

Your notes may matter later. Under § 397.6957, the court shall hear and review all relevant evidence. That can include testimony from family members familiar with the person’s prior history.

Before you record any conversation, ask about the rules. Bring that question to your consultation.

Who Should Take Part, and Who Should Not

Choose a small group of close family members who can stay calm and speak consistently. A small group who agree on the plan is easier to manage than a crowd.

Leave out people who are using with the person or who are in open conflict with them. Their presence can turn the talk into an argument.

Agree on roles before the talk. One person leads. Others speak when it’s their turn. Agree on what each person will say, and what they won’t say.

If a treatment professional already works with your family, ask that person to help with planning.

Who may file a petition is set out in the statute. For an adult, § 397.68112 lists the respondent’s spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the person’s impairment and prior treatment. Other requirements may apply, and the court decides.

Plan the Conversation and the Treatment Offer

Open with care, describe specific facts, state your concern, and name one next step. Then let the person respond.

A sample opening might sound like this: “We love you, and we’re worried. Last Saturday you didn’t come home and didn’t answer our calls. We’d like you to see a doctor about your use this week. Can we talk about that?”

Prepare a clear treatment proposal. Say what it would involve and what the family will do to help. Don’t promise that treatment will fix the problem. Don’t use the offer as a bargaining chip.

Expect a no. The person may refuse, agree to one step but not others, or get angry. Decide in advance how your family will respond to each answer.

Refusal of an evaluation matters in a petition. Under § 397.68141, if the person was not assessed before filing, or refused to submit to an evaluation, that must be noted in the petition. The clerk also may not charge a filing fee for a petition under that section.

How long does the process take?

The statute sets scheduling rules, but the court’s calendar and discretion control timing. Understand Possible Legal Options

If the person refuses treatment, a petition may be an option under Florida law. Whether a court grants relief depends on the statute and the court's discretion.

4.
