Casey III, Esq. · Published October 15, 2026

Family intervention and a Marchman Act petition are two different ways to respond to a loved one’s substance use in Florida. An intervention is a private, voluntary process a family arranges. A Marchman Act petition is a court case, and a judge decides it. You’ll see who decides, what each path can do, and where each one stops. This is general information, not legal advice.

What Is a Family Intervention?

A family intervention is a private, voluntary meeting that relatives arrange to talk with someone about concerns and treatment options. The person can decline to take part. An intervention does not create a court order, and no judge is involved.

Some families bring in a professional facilitator to guide the conversation. That arrangement is private, and its terms vary from one provider to another. Some families choose this path because it doesn’t involve a courtroom. It keeps the decision with the family and the person, at least for now.

Florida law also has a voluntary and involuntary treatment route. Under Fla. Stat. § 397.601, a person who wants to enter treatment for substance abuse may apply to a service provider for voluntary admission. That step belongs to the person. A family can encourage it, but a family cannot make it happen.

Talking things through may open the door to treatment. It cannot force anyone to walk through it. A conversation is not a petition, so keep the two separate as you compare them.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What Is the Marchman Act Process?

The Marchman Act is Florida’s law for court-ordered services for substance abuse impairment.

For an adult, Fla. Stat. § 397.68112 describes who may file a petition, including a spouse or legal guardian, any relative, a service provider, and an adult with personal knowledge of the impairment, and the full terms of the statute govern. Other requirements may apply, and the court decides who may proceed.

The petition must name the respondent and the petitioner. The petition must state, among other things, their relationship and the facts that show the need for services, as Fla. Stat. § 397.68141 provides, and other requirements may also apply. As Fla. Stat. § 397.681 provides, the petition is directed to the clerk of the court in the county where the person is located, and other requirements may also apply. That section also gives a respondent the right to counsel at every stage.

The statute also sets criteria. Section 397.675 says a person may meet the criteria for involuntary admission if there is good faith reason to believe the person is substance abuse impaired and has lost the power of self-control with respect to substance abuse. Other criteria also apply, and the court decides whether they are met.

How Do the Two Paths Differ?

The biggest difference is who makes the decision. In an intervention, the person and family decide. In a Marchman Act case, a judge decides after reviewing the evidence.

Legal force is the second difference. An intervention has no court-ordered force. A court case can lead to an order, but only when the court finds the required conditions met. Under Fla. Stat. § 397.697, the court may order involuntary treatment services when it finds the conditions proved by clear and convincing evidence. That order may run for a period not to exceed 90 days. Extensions of court-ordered treatment are addressed separately in section 397.6975, Florida Statutes. Whether any extension is granted is for the court to decide, based on the evidence and the circumstances of the case.

Procedure is the third difference. Under Florida Statutes section 397.6957, testimony at a Marchman hearing must be taken under oath, and the proceedings must be recorded. An intervention follows no court procedure at all.

Neither path is better for every family. The right choice depends on the facts, the law, and what the person is willing to do.

What Are the Limits of Each Approach?

An intervention cannot compel treatment. A court process cannot promise a hearing date, an order, or a placement. Those depend on the court’s calendar and discretion.

The statute says the court “shall schedule a hearing to be held on the petition within 10 court working days unless a continuance is granted,” under Fla. Stat. § 397.68151. Timing still depends on the court’s schedule and any continuance.

Other requirements may also apply.

A lawyer does not decide the case. The judge does.

Is Court-Ordered Addiction Treatment Effective?

This page makes no claim that either path works better. Outcomes depend on many individual factors.

Those factors include the person’s own engagement with treatment and the kind of care provided. A treating provider can answer questions about specific treatment methods. A court order cannot make treatment succeed, and a voluntary choice cannot either.

A lawyer can explain those steps. A lawyer does not judge which medical treatment will work for a given person.

When you read claims that one path works better, look for the source. Check whether the research matches your situation. If you’re comparing options, write down the facts you know and the questions you still have.

What Happens After a Petition Is Filed?

After a petition is filed, the court decides what happens next. The timing depends on the court’s schedule.

The court may decide whether the respondent already has a lawyer or whether appointing one is appropriate.

In an emergency, the court may act on the petition alone. Under Fla. Stat. § 397.6818, in emergency situations and subject to the conditions the statute imposes, the court may enter an ex parte order for assessment and stabilization based on the petition, and the court decides whether to enter such an order without appointing an attorney.

As Fla. Stat. § 397.68141 provides, a petition sets out facts supporting the requested order, and the court decides whether those facts meet the statutory requirements, and other requirements may also apply.

How any case unfolds depends on the evidence, the circumstances, and the court’s discretion. Other requirements may apply.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Questions Families Ask When Comparing the Two Paths

Short answer: the person and family decide in an intervention. A judge decides in a court case.

Who decides?

In an intervention, the person and family decide. In a Marchman Act case, the court decides based on the evidence and its own findings.

Is a court filing needed for treatment?

A person can apply for voluntary admission under section 397.601 without a court case.

Can a family try intervention first?

A family can start with a private conversation. Whether a court petition makes sense later depends on the facts and the law. A lawyer can talk through that sequence.

Who may file a petition?

For an adult, section 397.68112 names a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge.
