Casey III, Esq. · Published October 15, 2026

Can I force my adult son into rehab? In Florida, involuntary substance use treatment runs through a court process under the Marchman Act. If you’re watching your son’s drinking or drug use get worse, you’re probably scared and short on answers. The material here is general in nature and is not legal advice about any particular family’s situation. It is general information, not advice about your case.

Why the question feels different when your son is an adult

For an adult son, Florida’s involuntary route runs through a court petition, and he keeps rights inside that process. Age matters here. For a minor, the statute names parents, legal guardians, and service providers as possible petitioners. For an adult, the list is wider and includes relatives. Your son would be the respondent, the person named in the petition.

The answer also depends on the facts. What he has done, what evidence exists, and whether he has been assessed all matter to a court. Florida law sets out criteria a judge reviews. No one can tell you ahead of time how a judge will rule. Other requirements may apply, and the court decides.

Waiting can feel like the only option. Some families first try a direct conversation, which is covered below. Knowing the legal steps early can help you decide what to do next.

If your son has not agreed to treatment and you are weighing a court petition, you don't have to sort through Florida law alone. Stat. § 397.68112 says a petition may be filed by the respondent’s spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the respondent’s substance abuse impairment and prior course of assessment and treatment. Other requirements may apply, and the court decides.

The petition also has content rules. Fla. Stat. § 397.68141 says it must name the respondent and the petitioner, state their relationship, and set out the facts supporting the need for services. Those facts must explain why the petitioner believes the person is substance abuse impaired. The statute sets out more required findings than this summary covers, and the court evaluates them.

Under Fla. Stat. § 397.681, the petition goes to the clerk of the court in the county where the person is located. The statute also says the clerk may not charge a fee for filing it.

How a Marchman Act case generally moves through court

A Marchman Act case generally moves from petition to court review, then to assessment, then to a hearing. The court controls the pace, so no step has a fixed date. Hearing dates, holds, and placements depend on the court’s schedule and its discretion.

In emergencies, the statute gives the court more options. Fla. Stat. § 397.6818 says that when emergency circumstances exist, the court may rely solely on the petition. Without appointing an attorney, it may enter an ex parte order (one-sided, entered before a full hearing) for assessment and stabilization. That order must be carried out while the hearing is pending.

At the hearing, Fla. Stat. § 397.6957 says the respondent must generally be present, unless the court makes a waiver or other finding. The court hears all relevant evidence, including testimony from family members familiar with the person’s history.

One common mistake is treating the petition as a formality. A court decides whether the petition sets out facts that support the statutory criteria, based on its own review and discretion.

When a Baker Act question applies instead

The Baker Act is a separate Florida process for mental-health cases, not substance use. Mental-health questions generally fall under the Baker Act. The Baker Act information from DCF explains that separate process.

Mixing up the two laws can cost time and lead to the wrong questions. Some people have a substance use problem and a mental health condition at the same time. In that situation, the facts and the professionals involved can shape which process fits. The court makes that call based on the record, not the family.

This firm limits its work to Marchman Act and guardianship matters. The Baker Act is covered here only as a distinction, not as a service.

Options families weigh before going to court

Voluntary treatment is a route your son can choose for himself. Fla. Stat. § 397.601 says a person who wishes to enter treatment for substance abuse may apply to a service provider for voluntary admission.

A direct conversation can cover specific events, your concern, and an offer to help him get an assessment. Ultimatums you can’t enforce can damage trust. They may not lead to treatment.

Some families cover bills or shield a loved one from the results of his drinking or drug use. Stepping back from that can feel wrong. It may matter to your decisions, but no single change ensures any result. Talking with people you trust can help you think through a hard choice.

What a court can and cannot promise

No court order is automatic, and filing a petition does not decide the outcome. Fla. Stat. § 397.697 says that when the conditions for involuntary treatment are proved by clear and convincing evidence, the court may order treatment for a period not to exceed 90 days. The word “may” matters. The court decides whether to order it.

The same statute says a court may order treatment from a publicly funded or privately funded provider, depending on the respondent’s ability to pay. The court may also decline to enter an order. It may order something different from what a family hoped for.

No lawyer can promise a result.
