Casey III, Esq. · Published October 17, 2026

If you were served with a Marchman Act petition in Florida, start by reading the papers. Note the court, the case number, and any hearing date. The Marchman Act is Florida’s law for court-ordered assessment and treatment of substance abuse impairment. This guide explains how the process generally works and what to ask a lawyer. Robinson Casey limits its practice to Marchman Act petitions and guardianship matters.

What a Marchman Act Petition Asks the Court to Do

A Marchman Act petition asks a judge to order an involuntary assessment and, if the statute’s criteria are met, involuntary treatment. The criteria appear in Fla. Stat. § 397.675. Under § 397.675, the criteria include a good-faith reason to believe the person is substance abuse impaired and that the impairment has caused a loss of self-control with respect to substance use. Other requirements also apply, and the court decides based on the evidence and its discretion.

Petitions must be filed with the clerk of the court “in the county where the person is located.” The clerk may not charge a filing fee, according to Fla. Stat. § 397.681. The person named in the petition is called the respondent.

The Marchman Act is not the Baker Act. The Baker Act is the short name for the Florida Mental Health Act, as set out in Fla. Stat. § 397.681 provides that the courts have jurisdiction of involuntary treatment petitions for substance abuse impaired persons.

If a Marchman Act petition has reached your family, you don't have to work through the papers alone, and our team is glad to talk through your options with you. Write down the key facts while you still remember them clearly.

Fla. Stat. § 397.68141 says a petition must name the respondent and the petitioner. It must also describe their relationship and list the factual reasons for the request. Check those facts against what you know.

Read every page, including attachments and notices.

Note the court, the case number, and any hearing date.

Keep copies of everything you receive, and keep the envelopes.

Write a dated timeline of events while the details are fresh.

List your questions so you can bring them to a lawyer.

Don’t set court papers aside. They can list dates that matter, and missing one can cause problems. Talk with a lawyer about your options as soon as you can.

How the Court Process Generally Works

The process generally moves from the petition to an assessment, then to a hearing and a court order. The court controls its own schedule, so the timing of each step can change.

Counsel. After a petition is filed, the court must immediately decide whether the respondent has a lawyer or needs one appointed, under Fla. Stat. § 397.68151.

Emergency orders. When emergency circumstances are asserted or found, the court may enter an ex parte assessment and stabilization order without appointing an attorney. Fla. Stat. § 397.6818 addresses carrying out the emergency order while the treatment hearing is pending, and the court decides how that provision applies in each case, based on its discretion and the circumstances.

Hearing.

Order. If the court finds the conditions proven by clear and convincing evidence, it may order treatment for a period not to exceed 90 days, per Fla. Stat. § 397.697.

Renewal. A renewal petition must be filed before the current period expires. The court may then order up to an additional 90 days, per Fla. Stat. § 397.6975.

Each of these steps is subject to the court’s discretion and the facts of the case.

Your Rights and How You Can Respond

A respondent has the right to counsel at every stage of the case. Fla. Stat. § 397.681 says a respondent may waive counsel only if present and the court finds the waiver knowing, intelligent, and voluntary. A respondent who cannot afford private counsel may ask for court-appointed counsel under the same statute.

At the hearing, the respondent generally must be present. Fla. Stat. § 397.6957 lists exceptions, including a knowing waiver. The respondent may refuse to testify. The respondent may also request an independent assessment, and the court must inform the respondent of that right.

A lawyer can review which documents and arguments may matter in your case.

Assessments, Evidence, and Court Records

Involuntary treatment generally requires a clinical assessment. Under Fla. Stat. § 397.6957, a respondent may not be ordered into treatment without one, unless the respondent is present and expressly waives it.

The court hears “all relevant evidence.” That can include testimony from family members familiar with the respondent’s prior history, along with the assessment results. Testimony is taken under oath, and the proceedings are recorded. The court decides what evidence to weigh.

A petition may include a report from a qualified professional who examined the respondent within 30 days before filing, per Fla. Stat. § 397.68141. If the respondent was not assessed or refused, the petition must say so.

Under Fla. Stat. § 397.6760, petitions, court orders, and related records are confidential. The clerk may release them on request to listed people, including the respondent and the respondent’s attorney.

Fla.
