Florida law says that person’s dignity must be respected at all times, including when they are taken into custody or transported (§ 394.459).

The law also keeps people with a mental illness out of jail when no crime is charged. Or the person cannot decide for themselves whether an examination is needed.

Neglect and risk: Without care, the person is likely to neglect or refuse to care for themselves. That poses a real and present threat of substantial harm. And the harm cannot be avoided through willing, able, and responsible family or friends, or other services.

The statute ties the risk to the illness. The words “because of his or her mental illness” link each criterion to the condition.

Repeated admittance counts as evidence. The statute defines it as three or more admissions into a facility within the preceding 12 months.
