Casey III, Esq. · Published October 18, 2026

Florida families often ask how long to wait for a treatment bed after court order, and the honest answer is that the wait turns on the facts of each case. A Marchman Act order gives the court its authority and sets firm time limits.

If your loved one was just ordered into treatment, you’re probably scared and worn out. You want the danger to end now, and waiting can feel like nothing is moving. That feeling is common. This page offers general information about the Marchman Act and guardianship matters in Florida.

Why Families Ask How Long the Wait Will Be

A court order and an open treatment bed are two different things. Many families assume that once a judge signs an order, the person goes straight into a program. That’s not how the process works.

The order gives the court’s authority. A licensed provider still makes the admission decision. Florida law says a petition may be filed for a person who reasonably appears to meet the criteria for involuntary admission. Those criteria center on a person who has lost the power of self-control with respect to substance use and who is in need of help they can’t see they need, or who is likely to harm themselves or someone else. The criteria for involuntary admission are the starting point for every case.

Knowing this helps you read the timeline. The court can move quickly on paper, while the bed still depends on the provider’s own steps.

If your family is waiting on a treatment bed after a Marchman Act order, Robinson Casey can talk through where your case stands, and you don't have to face it alone. It doesn’t control which provider has room that day.

Under Florida law, the court may order treatment from a publicly funded licensed provider for a period not to exceed 90 days. The court may also order treatment through a privately funded provider if the person can pay, or if someone on the person’s behalf shows willingness and ability to pay (Fla. Stat. § 397.697). If the court finds it necessary, it may direct the sheriff to take the person into custody and deliver them to the provider named in the order, or to the nearest appropriate licensed provider (Fla. Stat. § 397.697).

Before a full treatment order, a court may act faster. It can enter an ex parte order for involuntary assessment and stabilization based on the petition, and that order must be carried out while the hearing is pending (Fla. Stat. § 397.6818).

After an order, the court keeps jurisdiction over the case. It can monitor compliance and start contempt proceedings for violating a valid order (Fla. Stat. § 397.697).

What Affects How Long a Family Waits for a Bed

Provider capacity and the admission decision control most of the wait. Florida law puts these checks on the provider, not on the family.

Before admitting someone, a provider must confirm the person meets admission criteria. It must check that admission won’t push it over its licensed capacity. It must find the most appropriate and least restrictive setting that fits the person’s needs. It must also decide whether the cost is within the person’s or the responsible party’s financial means (Fla. Stat. § 397.6751). It must also decide whether the person’s medical or behavioral conditions are beyond its safe management capabilities.

If the provider can’t admit, it must try to contact the referral source. That source can include a court or the petitioner, and the goal is to talk through alternatives. If the provider can’t reach that source, it must refuse admission and help the person find other services. It then has one workday to report the basis for refusal in writing (Fla. Stat. § 397.6751).

Location matters too. A petition belongs in the county where the person is physically located when it’s filed. In J.P. v. J.N., the Fifth District treated filing in the wrong county as a venue question, not a loss of jurisdiction.

The Statutory Clocks That Set Timing

Florida law sets fixed clocks for assessments, hearings and treatment periods. Each one has its own limit.

After an emergency admission to a hospital or detox facility, the attending physician must assess the person within 72 hours. After a nonresidential admission, a qualified professional must assess within 5 days (Fla. Stat. § 397.6797).

A provider generally can’t hold a person for more than 72 hours of observation. Withdrawal, a medical need, or a court-granted extension after a hearing can change that (Fla. Stat. § 397.6818).

The court must schedule a hearing on an involuntary services petition within 10 court working days, unless a continuance is granted (Fla. Stat. § 397.68151).

A renewal petition must be filed before the treatment period ends. If granted, the court may order up to an additional 90 days (Fla. Stat. § 397.6975).

At the end of the 90-day period, the person is automatically discharged unless a renewal motion was filed (Fla. Stat. § 397.6977).

These clocks limit how long each step can take. They don’t tell you when a specific bed opens.

What Families Can Do While They Wait

Stay reachable, keep a written record, and act fast if there is immediate danger. Those three steps help most while the placement is pending.

Keep a log of dates, provider contacts, court notices, and the names of people you spoke with. Clear records help you answer questions quickly and accurately.

Answer calls from the provider and the court. When a provider can’t admit, the statute requires it to reach out to the referral source to talk through alternatives (Fla. Stat. § 397.6751).

Start planning for discharge early. Discharge planning must document follow-up behavioral health appointments, how to get prescribed medications, living arrangements and transportation, and referral to recovery support (Fla. Stat. § 397.6977).

Protect privacy. Federal rules limit who can receive addiction treatment records, and they set consent and court-order requirements for disclosure from federally assisted programs (HHS Office for Civil Rights).

If someone is in immediate danger, call 911 right away.

Common Questions About Treatment Timing After a Marchman Act Order

Families can’t control a provider’s census, but they can stay in contact with the court and the provider.
