Whether it can reach kratom or gabapentin use depends on the facts and on how the statute’s test applies to the person. The person who files, called the petitioner, must show the statutory elements.

Families often ask this question after watching use turn dangerous. A parent may see a child who can’t stop. A spouse may fear for a partner’s safety. Both need to know what the law requires before making a hard decision. Under Fla. Stat. § 397.675, a court needs a good faith reason to believe the person meets those criteria.

The person must also meet one more test. The person must need services and be unable to appreciate that need, or be likely to neglect self-care in a way that poses a real and present threat of substantial harm. Or the person must have inflicted, threatened, or attempted physical harm, or be likely to do so.

The statute also says a refusal of services alone does not prove poor judgment. That point matters to many families.

Under Fla. Stat. § 397.68112, an adult’s petition may come from a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the impairment and past treatment.

Fla. Stat. § 397.68141 requires the petition to name the respondent and petitioner and their relationship. It must also explain the facts behind the request, including why the petitioner believes the person is impaired and has lost self-control.

Fla. Stat. § 397.681 says the petition goes to the clerk in the county where the person is located. The clerk may not charge a filing fee. In Miami-Dade, the Miami-Dade Clerk, Mental Health Court page directs adult cases to the Probate Court.

Kratom Under Florida Law: What to Verify Before Relying on It

The Marchman test is written around impairment and loss of self-control, not a list of named products.

Kratom comes in several forms, including leaf powders and concentrated extracts. Families should write down the exact product name, the form, and where it came from. Those details help frame the facts.

A petition with thin facts can fail. In D.H. v. K.J.R., the petition did not establish a good faith reason to believe D.H. met the statutory criteria for involuntary assessment and stabilization, and the trial court erred in entering the ex parte order. The petition did not establish a good faith reason to believe the person met the statutory criteria. The facts in the petition carry real weight.

Gabapentin: When Prescribed Use Becomes a Court Question

The same test applies: substance abuse impairment and loss of self-control, measured against the statutory criteria.

Gabapentin is a medication a doctor may prescribe. Use that follows a prescription can still raise questions if it changes how a person functions.

The court also looks at the harm that follows. These facts connect to the statute’s questions about self-control and risk of harm.

Mixing substances can raise the harm questions the statute asks about. A petition should describe those facts in specific terms: what was taken, when, and what happened afterward. The facts drive the analysis.

Evidence, Hearings, and What Happens After a Petition Is Filed

After filing, the court must schedule a hearing within 10 court working days unless a continuance is granted. The respondent receives a copy of the petition and notice.

The respondent has the right to a lawyer at every stage. The respondent may waive that right only if present and the waiver is knowing, intelligent, and voluntary. The Second District has said this right rests on due process.

The court may consider testimony from family members, the professional’s assessment, and drug tests. Testimony must be under oath. A respondent may refuse to testify. Under Fla. Stat. § 397.6957, a respondent may not be ordered into treatment without a clinical assessment, unless the respondent is present and expressly waives it.

Who carries the proof matters. In J.C. v. State, the court failed to follow the applicable statute by essentially functioning as the absent petitioner. In J.C. v. State, the court reversed where the trial court functioned as the absent petitioner. The Fourth District disagreed in J.J.J. v. D.G., and it certified conflict.

When conditions are proved by clear and convincing evidence, the court may order treatment for up to 90 days. No particular result can be predicted from general facts.

Where the Marchman Act Fits Among Guardianship and Involuntary Commitment

The Marchman Act covers substance abuse impairment.
