Casey III, Esq. · Published October 18, 2026

To get someone mental help when they refuse in Florida, a court usually has to step in. Florida has three main legal routes: the Baker Act for mental illness, the Marchman Act for substance abuse, and guardianship for a person who cannot make safe decisions or manage their affairs. The right route depends on the main problem and the facts. This guide walks through each route in plain language, starting with safety.

Start With Safety: When to Call 911 Right Away

If someone is in immediate danger, call 911 first. Legal steps can wait until the person is safe.

Warning signs that need an emergency response include threats of violence, talk of suicide with a plan, a medical emergency, or an inability to care for basic needs like eating, staying warm or taking required medicine.

A crisis response handles the danger of the moment. It is not a long-term legal plan. Once the danger passes, the legal options below become the main question.

Write down what you see and when, even during the emergency. Dates, exact words and names of witnesses become important later if a petition is filed. Florida law also has a separate emergency examination route, covered in the next sections.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Which Florida Law Applies to Your Situation

Three separate Florida laws cover most of these cases. Each one has its own petition, its own standard and its own court process.

The Baker Act is in Florida Statutes Chapter 394. It deals with mental illness and involuntary examination.

It covers substance abuse impairment. Its criteria can also apply when a substance use disorder occurs with a co-occurring mental health disorder, under § 397.675.

Guardianship is in Florida Statutes Chapter 744. It asks whether a person can make safe decisions and manage their own affairs.

Mental health and substance use problems often happen together. MedlinePlus notes that these co-occurring conditions are usually best treated at the same time. That overlap is why families often feel stuck choosing a route. Don’t assume one law covers everything. Start by naming the main concern, then check which petition fits it.

How the Baker Act Differs From the Marchman Act and Guardianship

The Baker Act, Florida Statutes Chapter 394, governs involuntary examination for mental illness. Its process is set out in § 394.463.

It is a separate process from the Marchman Act petitions and guardianship matters handled by Robinson Casey. The Marchman Act addresses substance abuse impairment, and guardianship addresses whether a person can make safe decisions and manage their affairs. Knowing which law fits the main concern helps you choose the right route.

How Do I Get Someone Involuntarily Committed for Addiction?

Under the Marchman Act, an eligible person can ask a court for involuntary treatment for substance abuse impairment. For an adult, § 397.68112 allows a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the person’s impairment to file.

The petition must name the person and the petitioner, state their relationship, and give the facts. Under § 397.68141, the petitioner must explain why they believe the person is impaired and has lost the power of self-control.

After filing, the court decides whether the person has a lawyer or should get one. It must schedule a hearing within 10 court working days unless a continuance is granted, under § 397.68151. Debating the person’s beliefs often makes the conversation harder. Focus on concrete concerns the person can see, such as sleep, safety or money.

Refusal alone is not automatic proof of a legal problem. Florida’s Marchman criteria state that mere refusal to receive services does not by itself show lack of judgment about needing them, under § 397.675. The law looks at the whole picture.

Keep a written record. Note dates, the exact words the person used, what you saw, who else was present, and any police or emergency room visits. In a Marchman hearing, the court may hear testimony from family members about the person’s history, under § 397.6957. Clear notes help you describe that history accurately.

When Guardianship May Be the Right Route

It is a separate proceeding from a treatment petition, although the two can overlap.

A petition to determine incapacity must be verified. Florida’s § 744.3201 provides that an adult person may execute a petition to determine incapacity. The petition must be verified, and among its required contents it must state the name, age, and present address of the petitioner and his or her relationship to the alleged incapacitated person; state the name, age, county of residence, and present address of the alleged incapacitated person; and allege that the petitioner believes that person to be incapacitated, specifying the factual information on which that belief is based.

When there is imminent danger, a court may appoint an emergency temporary guardian. The court must find that the person’s health or safety could be seriously impaired unless immediate action is taken, under § 744.3031.
