The guardian may make personal decisions (where the person lives, what medical care they receive) and sometimes financial decisions, depending on the scope of the guardianship.

Mental health guardianship differs from other tools. A healthcare power of attorney lets someone you trust make medical decisions if you become unable to do so—but it requires that you have the capacity to sign it while you’re still well. A living will documents your wishes about end-of-life care in advance. A voluntary treatment arrangement means the person agrees to mental health care and follows through. Mental health guardianship, by contrast, is imposed by court order when the person cannot or will not consent, and when the court finds they lack the legal capacity to make their own decisions.

Under Florida Statutes Chapter 744, guardianship is available only when the court determines that a person is incapacitated—a specific legal finding, not a medical diagnosis.

The Legal Standard: Incapacity in Florida

Florida law defines incapacity narrowly. Under Fla. Stat. § 744.331, a person is incapacitated if they lack the capacity to manage property, make healthcare decisions, or meet essential requirements for physical health, safety, or self-care.

This is not the same as having a mental illness. Many people with serious mental illness—schizophrenia, bipolar disorder, severe depression—retain the ability to understand their situation and make decisions about their care. The legal question is functional: Can this person understand the nature and consequences of their decisions? Not: Does this person have a mental illness?

The court requires clear and convincing evidence of incapacity. This is a high burden. A physician’s evaluation is critical. The doctor must assess whether the person can understand information about their condition, appreciate how it applies to them, reason about options, and communicate a choice. Disagreement between family members and the person about whether treatment is needed does not alone establish incapacity. The person must actually be unable to understand or decide, not merely unwilling.

Common Situations Where Mental Health Guardianship Becomes Necessary

Several patterns often signal that mental health guardianship may be needed:

Serious mental illness with functional impairment. A person with schizophrenia, bipolar disorder, or severe depression may lose the ability to understand their own condition or the need for treatment. They may not recognize that their thoughts or perceptions are symptoms of illness.

Refusal of necessary treatment despite clear danger. When a person with serious mental illness refuses medication or hospitalization, and that refusal creates a substantial risk of harm to themselves or others, guardianship may be the only way to ensure they receive care.

Inability to meet basic needs. The person cannot obtain food, shelter, hygiene, or medical care without intervention. They may not understand why these things matter or how to secure them.

Lack of insight into illness (anosognosia). Anosognosia is a recognized clinical phenomenon in which a person with mental illness does not recognize that they are ill. They may sincerely believe they are fine, even as their condition deteriorates. This lack of insight can make voluntary treatment impossible and may trigger the need for guardianship.

Repeated psychiatric crises. A pattern of hospitalizations, emergency room visits, or dangerous behavior—despite family support and available treatment—suggests that voluntary arrangements are not working and that the person cannot manage their own care.

No alternative arrangement in place. If the person lacks capacity to execute a healthcare power of attorney or living will, and they refuse voluntary treatment, guardianship may be the only legal tool available.

Have questions about what happened?

Ask our team directly. Consider whether a less restrictive option might work:

The person is willing to engage in treatment. If they cooperate with mental health care, take medication as prescribed, and maintain contact with providers, guardianship may not be needed.

The person retains capacity to execute advance directives. If they can still understand and sign a healthcare power of attorney or living will, those documents may give you the authority you need without court involvement.

A temporary crisis has resolved. Short-term hospitalization or crisis intervention may stabilize the person. Once they regain capacity, guardianship may not be necessary.

Family coordination is sufficient. If the person consents to family involvement in their care and follows through, a court order may be unnecessary.

A more limited tool fits better. Limited guardianship restricts only certain rights while the person retains others. The Marchman Act addresses substance use disorders under a separate legal process. Emergency temporary guardianship provides short-term authority when immediate danger requires urgent intervention.

The Role of Incapacity Evaluations

A physician, psychiatrist, or psychologist typically performs an incapacity evaluation. The evaluator assesses the person’s ability to understand their condition, recognize the consequences of their decisions, reason about options, and communicate choices. They also document any functional deficits—inability to manage money, obtain food or shelter, or follow medical advice.

The court uses this evaluation as evidence in the guardianship proceeding. It is not dispositive; the judge may weigh it alongside other testimony and records. But a thorough, credible evaluation is often the foundation of a guardianship case.

Timing matters. An evaluation should be recent enough to reflect the person’s current condition. If months pass between the evaluation and the court hearing, the person’s circumstances may have changed.

Mental Health Guardianship vs. Other Legal Options

Limited guardianship restricts only specific rights. The person might retain the right to make healthcare decisions but lose the right to manage property, or vice versa. Limited guardianship is appropriate when incapacity is partial—the person can decide some things but not others.

Plenary guardianship grants the guardian broad authority over personal, medical, and financial decisions. It is used when incapacity is comprehensive.

The Marchman Act (Florida’s involuntary commitment statute for substance use disorders) operates under a different legal standard and procedure. It addresses addiction specifically, not mental illness, and does not require a finding of incapacity in the same way guardianship does.

Emergency temporary guardianship is a short-term tool available when immediate danger requires urgent court intervention before a full guardianship hearing can occur. It typically lasts 60 days and can be renewed.

The Court Process and What to Expect

A guardianship petition is filed with the court. The petition must describe why the person is incapacitated and what evidence supports that claim. The person has a right to be present at the hearing and to contest the guardianship. They may have an attorney represent them.

The petitioner (often a family member) and their witnesses present evidence—typically the incapacity evaluation, testimony from family or caregivers, medical records, and documentation of the person’s inability to manage their affairs or make decisions. The person or their attorney may present contrary evidence.

The judge considers all evidence and decides whether clear and convincing evidence of incapacity exists. If so, the court appoints a guardian and defines the scope of their authority. The guardian then has ongoing duties: acting in the person’s best interest, filing annual reports with the court, and submitting to court oversight.

Want to know where you stand?

Tell us what happened and our team will walk you through the options available to you, at no cost.

Get a free review

Get a free review

Recognizing the Signs That Guardianship May Be Needed

Watch for these red flags:

The person cannot understand the nature or consequences of their own decisions.

Repeated hospitalizations or psychiatric crises occur despite family support and available treatment.

Dangerous behavior or self-harm cannot be managed through voluntary means.

The person cannot communicate their wishes or participate in treatment planning.

They are vulnerable to exploitation due to mental illness and lack of judgment.

No one else has legal authority to act on their behalf in emergencies.

Frequently Asked Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is mental illness the same as incapacity?

No. Many people with serious mental illness retain the legal capacity to make decisions. They may also be represented by an attorney and have the right to a jury trial in certain circumstances.

What is the difference between plenary and limited guardianship?

Plenary guardianship grants the guardian authority over all decisions regarding the person's person and property. Limited guardianship restricts the guardian's authority to specific areas (such as healthcare or finances), allowing the person to retain decision-making power in other matters.

What happens after a guardianship is established?

The guardian has ongoing legal responsibilities, including making decisions in the ward's best interest, managing their finances if appointed as property guardian, and filing annual reports with the court. The guardianship can be modified or terminated if circumstances change.

Is guardianship the only option?

No. Depending on the situation, alternatives such as power of attorney, healthcare surrogate designation, or mental health treatment orders may be appropriate.
