Florida’s Marchman Act lets a relative ask a court to order an adult into involuntary assessment and treatment for substance abuse impairment. Whether a particular grandparent can file depends on the facts of that family’s situation.

If you’re asking whether a grandparent can file for addiction treatment Florida courts will hear, you’re probably in a hard moment. Many families ask this question after a crisis. A grandchild may have overdosed more than once. Money or medication may keep going missing. Or the grandchild may refuse every offer of help.

This page explains how the process works and what the court looks at. No one can promise how a judge will rule, so the goal here is to make each step clear.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How the Marchman Act Works in Florida

The Marchman Act is Florida’s civil law for involuntary assessment, stabilization, and treatment of people with substance use problems. It is a court process, not a criminal case.

The basic sequence is simple. Someone files a petition with the court. The court reviews it and decides whether to set a hearing.

The procedures sit in Chapter 397 of the Florida Statutes. That chapter also defines key terms. A qualified professional can be a physician, a licensed mental health professional, an advanced practice nurse, or a certified substance abuse professional with at least a bachelor’s degree.

Think of the petition as the family’s first written account of the problem. The court reads it early. Accuracy matters from the start.

Who Can File a Marchman Act Petition in Florida?

For a minor, a copy of the petition and notice of hearing must be provided to the respondent’s parent, guardian, or legal custodian.

Still, the petition must give the facts behind your belief. Those facts usually come from what you saw yourself or wrote down at the time.

If a document must be verified, the verification may be accomplished under oath or affirmation before an authorized officer, under oath before an officer authorized under s. 117.10, or by the written declaration described below. Under Fla. Stat. § 92.525, a person who knowingly makes a false declaration commits a third-degree felony.

When a Grandparent Has Guardianship or Custody Responsibilities

A grandparent who already holds legal guardianship of a minor grandchild stands in a different position than one filing for an adult. Section 397.68151(3) of the Marchman Act addresses who receives notice of a petition, not who may file one. The facts still have to support the petition.

Guardianship under Chapter 744 is a separate question. It applies when a person’s ability to make decisions is in doubt, and substance use can be part of that picture.

Emergency temporary guardianship is the fastest of these options. The court must make that finding. The alleged incapacitated person and their attorney must get notice at least 24 hours before the hearing, unless substantial harm would result from that delay.

A grandparent raising a grandchild whose parent has an addiction may face a different set of questions. The details matter.

Marchman Act Criteria Florida Courts Require

A petition must show why the court should act. The petition must name the respondent and the petitioner, state their relationship, and name the respondent’s attorney if known, as Fla. Stat. § 397.68141 requires.

The factual allegations must give the reason the petitioner believes the respondent is impaired. They must also explain why the petitioner believes the person has lost the power of self-control with respect to substance use.

The substantive test appears in Fla. Stat. § 397.675.

Specific, dated observations carry more weight than general statements. Useful details include incidents, injuries, missed responsibilities, and statements the person made. A petition may include a professional’s report from an exam within 30 days before filing. If the person was never assessed or refused an evaluation, the petition must say so.

Have questions about what happened?

Ask our team directly. The Baker Act is a separate Florida law that addresses mental health crises. The two can overlap when a person has both problems.

The Marchman criteria already reach that overlap. Under Fla. Stat. § 397.675, the test covers a person with a substance use disorder and a co-occurring mental health disorder.

Which law fits a given situation turns on the facts. The choice affects the process, so the facts should be reviewed early. Keep the question simple: is the core problem substance use, mental health, or both?

What Happens After a Petition Is Filed

After filing, the court must schedule a hearing within 10 court working days, unless a continuance is granted, under Fla. Stat. § 397.68151.

A petition filed in the wrong county is a venue problem, not a loss of jurisdiction. In J.P. v. J.N., the Fifth District held that the circuit court kept jurisdiction, so the remedy was transfer. For a Miami-Dade case, the person’s location on the filing date matters.

The court may appoint a lawyer. A respondent has the right to counsel at every stage of a judicial proceeding relating to a petition for involuntary treatment for substance abuse impairment, and may waive that right only if the respondent is present and the court finds the waiver is made knowingly, intelligently, and voluntarily.

In an emergency, the court may enter an ex parte order without appointing counsel, under Fla. Stat. § 397.6818. A service provider generally may not hold the respondent for more than 72 hours of observation, unless a listed exception applies. In D.H. v. K.J.R., the Second District held that the petition must give a good faith reason to believe the statutory criteria are met.

The court must find the conditions proved by clear and convincing evidence before ordering treatment. Under Fla. Stat. § 397.697, that order may last up to 90 days.

In J.C. v. State, the opinion states: “In doing so, the court failed to follow the applicable statute by essentially functioning as the absent petitioner.” In C.W.R.K. v. Stewart Marchman Act Behavioral Healthcare, the trial court failed to follow the governing statute when, in the absence of the petitioner, it called and questioned the health care professional who executed the involuntary services certificate. The Fourth District reached a different result in J.J.J. v. D.G. and certified conflict. The 2024 amendments may affect later cases.

What to Do When a Family Member Has a Drug Addiction

Start by writing down specific, dated events. Record the date, what happened, who saw it, and what was said. Keep copies of texts, messages, or records that show the problem.

If someone is in immediate danger, call 911 first. Timing matters, because the court process takes time to begin. Waiting for a single crisis to become a pattern can delay the steps that protect the person.

Families often make the same mistakes. They rely on general phrases like “he’s out of control.” They describe what they heard instead of what they saw. They file in the wrong county. They forget that a petition must say if the person refused an assessment.

Organizing facts early helps. A clear timeline makes it easier to discuss the case with a lawyer. It also helps the family answer the court’s questions accurately.

Key Takeaways for Grandparents Facing This Decision

A grandparent may be able to file under the Marchman Act, depending on the facts and Florida law.

The petition must give specific, accurate facts about impairment and loss of self-control.

Guardianship is a separate track when decision-making ability is in question.

The court reviews the evidence, and the hearing decides whether treatment is ordered.

Frequently asked questions

Whether a particular grandparent qualifies depends on the facts.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is there a filing fee for a Marchman Act petition?

The clerk may not charge a fee for filing a petition under Fla.
