Casey III, Esq. · Published October 20, 2026

Families looking into involuntary addiction treatment and gun ownership in Florida often ask one question first: does the order take away a firearm? The answer turns on the exact order, its wording, and how federal and Florida law classify it. This guide explains those rules for families in Miami-Dade and across South Florida.

Short Answer: Gun Ownership Turns on the Specific Order

Involuntary addiction treatment can carry firearm consequences, but only when the order and the law line up. Two layers need checking. The first is federal law. The second is Florida law, which adds its own firearm rules on top.

A court may order involuntary treatment services only after the conditions are proved by clear and convincing evidence. Such an order can run for up to 90 days, Fla. Stat. § 397.697.

Many gun owners assume a treatment order automatically ends their rights. That is a mistake. Before you ask a firearm question, pin down the type of order, its exact wording, and the date it was entered.

This guide maps the rules and the facts that move them. It is not a forecast for any one family.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How Federal Law Treats Adjudicated or Committed Persons

Federal law treats a past adjudication as mentally defective, or a commitment to a mental institution, as a barrier to receiving firearms. The federal text lists “has not been adjudicated as a mental defective or been committed to a mental institution” as a condition for a firearm transfer.

“Adjudicated” and “committed” are two different labels. Both appear in federal and Florida texts, so the exact label on your paperwork matters. Read the order itself, not a summary of it.

Federal law also has a relief path. A person barred from possessing firearms may apply to the Attorney General for relief. The Attorney General may grant it only if the applicant is unlikely to act dangerously and relief is not contrary to the public interest. A denial can be reviewed in federal district court, and any relief granted must be published in the Federal Register.

A Florida order can raise federal questions even when the case stayed local.

How Florida Firearm Rules Layer on Top of Federal Law

Under s. 790.065, a person adjudicated mentally defective or committed to a mental institution is prohibited by state or federal law from purchasing a firearm.

Under s. 790.065, the Department of Law Enforcement keeps an automated database of persons who are prohibited from purchasing a firearm based on court records of adjudications of mental defectiveness or commitments to mental institutions.

The state’s purchase guidance says background checks apply federal prohibitions. Those include prohibitions for unlawful drug users or addicts and for people involuntarily committed to treatment, FDLE firearm purchase FAQ. That is why a substance-use order can matter at a purchase check, even though the Marchman Act is a substance-use law.

Compare each rule against the actual order. Summaries cannot show how a specific order was categorized.

Mental Illness, Substance Use, and How Florida Orders Are Categorized

The Marchman Act sets its own criteria for substance use. The firearm statutes use different terms, such as mental defective and mental institution, so the category on the order affects how the rules are read.

Under Fla. Stat. § 397.675, a person meets involuntary admission criteria if there is good faith reason to believe the person is substance abuse impaired or has a substance use disorder and a co-occurring mental health disorder. The person must also have lost the power of self-control with respect to substance abuse. Further tests apply.

A petition can be filed when a person reasonably appears to meet those criteria. It can also be filed after protective custody or an emergency admission within the previous 10 days, or after an assessment within 30 days, § 397.68111.

Emergency orders work differently. A service provider may hold a person for no more than 72 hours of observation, unless a listed exception applies, § 397.6818. Note the dates on any emergency paperwork.

Different proceedings can describe the same facts in different words. A treatment record, a court order, and a clinician’s report may each use other labels. Compare them side by side.

Have questions about what happened?

Ask our team directly. The court must grant relief if it finds, from the petitioner’s reputation, mental health record, criminal history, and the circumstances, that the petitioner is unlikely to act dangerously. Under Florida law, the court must also find that granting the petition would not be contrary to the public interest.

If the Attorney General denies relief, the petitioner may file a petition with the United States district court for the district in which he resides for judicial review of the denial, 18 U.S.C. § 925.

Four questions shape the answer: the type of order, when it was entered, whether it was later set aside or ended, and what records exist. Each request turns on the order and current law.

Documents and Facts to Gather Before Asking Questions

Gather the petition, any order, and any notice you received before asking firearm questions.
