Casey III, Esq. · Published October 20, 2026

Do plenary guardianship laws vary by state or jurisdiction? Yes. Each state writes its own guardianship statutes, so the definitions, court findings, and procedures for a plenary guardianship can differ from one place to another. This guide explains what varies, how Florida’s Chapter 744 is built, and why an order from another state may need extra steps before it works in Florida.

The short answer: yes, plenary guardianship laws vary by state

Plenary guardianship laws vary by state or jurisdiction because each state sets its own rules. Two states can use the same word and still apply different standards. A family that assumes one state’s rules will carry over may be caught off guard.

Some states use the word conservator for authority over property. Some split the person and property roles in a different way. Courts also differ on the evidence they require and on whether they must consider less restrictive options first. Those details shape how a case moves, so the rules that apply depend on where the case is filed.

A Florida order does not answer how a court in another state will treat the same family. The first question is always where the case belongs.

Robinson Casey focuses on guardianship and Marchman Act matters for families in Miami-Dade, South Florida, and across Florida. Richard J. Florida defines the term in Chapter 744 definitions. The court appoints this guardian after finding the person lacks the capacity to perform all the tasks needed to care for his or her person or property.

Put simply, this is the broadest form of guardianship. The court has found that the person cannot handle the full range of personal care or money decisions, not just a few of them.

A guardian may act for the person, the property, or both, according to the court’s order. Limited guardianship sits at the other end. A limited guardian gets only the powers the court names in its order, which is entered after the court finds the person lacks capacity for some tasks but not all, or after the person voluntarily petitions for appointment of a limited guardian.

Under a plenary order, the guardian exercises all delegable legal rights and powers of the ward, so rights that cannot be delegated stay with the person. Fla. Stat. § 744.3215 lists these rights. The difference between the two types shapes what a family asks a court to grant. For a deeper look at Florida’s options, read our Florida plenary guardianship guide.

Most differences show up in terms, findings, notice, reporting, and restoration

Jurisdictions differ most in how they name roles, what the court must find, and how guardians report back.

Terms: some states use conservator or other titles for property authority.

Findings and evidence: the incapacity standard, medical or professional evaluations, and whether less restrictive options come first.

Notice and participation: who must be told about the case, and whether the person may attend or object.

Reporting: plans, accountings, and review schedules vary in timing and detail.

Pay and bond: rules on guardian compensation and bond differ by state.

Restoration: how and when rights come back, or the order changes, is set by each state.

Data is also uneven. When you read another state’s rules, check each of these areas, not just the word “plenary.”

Florida builds plenary guardianship on Chapter 744 of the Florida Statutes

Florida keeps its adult guardianship rules in Chapter 744. The court’s order sets how far a guardian’s power reaches.

A case usually starts with a verified petition to determine incapacity. The petition must name the person, the petitioner, and the next of kin. It must also say which rights the person cannot exercise. See Fla. Stat. § 744.3201.

A petition to determine incapacity may be executed by an adult person and must be verified, but the 5-day deadline and three-member examining committee are not set out in this section. One member must be a psychiatrist or other physician, under Fla. Stat. § 744.331.

A guardian also acts as a fiduciary and may use only the rights the court removed from the ward and delegated, as stated in Fla. Stat. § 744.361.

Emergencies follow a faster path. That authority expires 90 days after appointment or when a guardian is appointed, whichever comes first. It may be extended for another 90 days if the emergency still exists, under Fla. Stat. § 744.3031.

Reporting continues after the order.

An out-of-state order does not carry over automatically into Florida

An order from another state does not simply take effect in Florida. Florida’s own process decides how it is recognized. Under Fla. Stat. § 744.306, a foreign guardian must file the authenticated order with the clerk in the county where the ward lives. That filing is due within 60 days after the ward’s residence moves to Florida.

Once filed, the order is recognized and given full faith and credit in Florida courts. The guardian and the ward then become subject to Chapter 744. A guardian appointed in another state may also maintain or defend an action in Florida as the ward’s representative.

This matters in a few common situations. A family member may move. A ward may own property in more than one state. A Florida family may need authority for matters outside Florida. Each one raises a question about which court acts, and when.

Transfers are court procedures tied to the states involved.

Ask these questions before you assume which state’s rules apply

Start with where the person lives now and where the first order was entered. Those two places often decide which court hears the case and which statute applies. Then work through these questions:

Did the need for a guardian arise in a different state from where the person lives today?

Does the person hold accounts or property in more than one state?

Is there an existing order, and was it entered in Florida or somewhere else?

What health evaluations or documents will the court expect for the person’s condition?

Are less restrictive options, such as limited guardianship, being considered?

Each answer helps show whether Florida’s rules, another state’s rules, or both apply. The answers also show which records to gather first.

Frequently asked questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Do plenary guardianship laws vary by state?

Yes.
