Casey III, Esq. · Published October 21, 2026

Knowing how to talk to addicted parent about court ordered treatment starts with calm, specific facts and a small, clear request. Florida’s Marchman Act gives families a court route when an adult’s substance use puts them or others at risk. This guide walks through that route in plain language, so you can plan the conversation and understand what could come next. It explains options, not how any case will end.

Where You Are Right Now

You didn’t choose this, and feeling worried, tired, or unsure is normal. You may not know whether a hard talk will help or make things worse. Many families reach this point when a parent’s drinking or drug use starts to affect safety, health, money, or the people who rely on them.

Crisis calls, missed bills, and sleepless nights wear people down. That strain is real, and it’s okay to say so.

Maybe you’re thinking about a court process. Maybe one is already in front of you. You might also be reading this for someone else, and that’s common.

This page explains the options and the steps for the conversation. It doesn’t predict how a case will turn out. For the bigger picture, start with our guide to involuntary commitment for addiction, then come back here for the conversation steps.

If your parent's drug or alcohol use has you weighing a court process, you don't have to sort it out alone. A judge decides whether the legal standards are met.

The core test is in Fla. Stat. § 397.675. The court looks for a good-faith reason to believe the person is substance abuse impaired, or has a substance use disorder and a co-occurring mental health disorder. The person must also have lost the power of self-control about substance use.

A petition can be filed by a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the impairment. The court must schedule a hearing within 10 court working days unless it grants a continuance, under Fla. Stat. § 397.68151.

The person named in the petition may have an attorney, and under Fla. Stat. § 397.68151 the court first decides whether the person has an attorney or whether appointing counsel is appropriate. Someone who can’t afford one can ask for a court-appointed lawyer, under Fla. Stat. § 397.681. Florida’s Second District has said this right is constitutional, in Hillsborough County v. Albrechta.

Voluntary treatment starts with the person’s own choice. A court order is different.

Preparing Before You Talk to Your Parent

Preparation is the part of how to talk to addicted parent about court ordered treatment that you control. Start with specific facts, not labels.

Write down dates, incidents, and changes you saw. A missed job, a car crash, a fall, an unpaid bill, or a call from a neighbor all count. “Always drunk” is hard to act on. A described event is easier to use.

The facts matter in court too. A petition can also include a report from a qualified professional who examined the person within 30 days before filing. Your notes are the start of that record.

Next, decide what you’re asking for. It might be an evaluation, a meeting with a clinician, or a talk with a lawyer. Know what you can’t do, such as paying debts or housing your parent, so you don’t promise something you can’t deliver.

Pick a calm, private time when your parent is sober. Skip holidays, family fights, and moments of intoxication. If there’s any risk of violence, make a safety plan before you talk.

How to Talk to a Parent Who Does Not Want Help

Expect pushback, and keep your next step small and specific. Denial, anger, minimizing, and bargaining are common when someone hears about their substance use. These reactions don’t mean the conversation has failed.

Speak in “I” statements about specific behavior and its effect on you. Say “I’m scared when you drive after drinking,” not “You’re an alcoholic.” Long debates about whether there’s a problem rarely help. Stick to what you saw and what you need.

Avoid threats you can’t carry out, insults, and promises you can’t keep. A threat you don’t follow through on tells your parent your words don’t carry weight.

Florida law also draws a line here. Under Fla. Stat. § 397.675, a mere refusal to receive services does not, by itself, constitute evidence of lack of judgment about the need for those services. Fla. Stat. § 397.675 reads: “(b) Without care or treatment, is likely to suffer from neglect or refuse to care for himself or herself; that such neglect or refusal poses a real and present threat of substantial harm to his or her well-being; and that it is not apparent that such harm may be avoided through the help of willing, able, and responsible family members or friends or the provision of other services, or there is substantial likelihood that the person has inflicted, or threatened to or attempted to inflict, or, unless admitted, is likely to inflict, physical harm on himself, herself, or another.” The court looks at the whole picture, not only the refusal.

End with one concrete next step, such as an evaluation appointment. Then give your parent time to answer. Some people need more than one conversation before they respond.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What Happens at a Court-Ordered Substance Abuse Evaluation

A court-ordered evaluation is a clinical assessment by a qualified professional. Florida law generally requires one before a judge can order involuntary treatment, unless the person is in court and expressly waives it, under Fla. Stat. § 397.6957.

The professional’s report goes to the clerk no later than the close of business the day before the hearing. It must note any co-occurring mental health needs and include a treatment recommendation. A report with no treatment recommendation, or a recommendation of no treatment, leads to dismissal of the petition.

If an assessment was attached to the petition, the person may ask for an independent assessment by a court-appointed or agreed-upon qualified professional, and the judge must tell them about that right.

Emergencies move faster. The court may rely only on the petition to issue an ex parte assessment and stabilization order, without appointing a lawyer first, under Fla. Stat. § 397.6818. The provider may generally hold the person for no more than 72 hours of observation, unless a listed exception applies.

Keep copies of the order, notices, and deadlines together in one folder. Testimony at the hearing is under oath, the proceedings are recorded, and the court may order drug tests.

How Addiction Can Come Up in a Custody or Guardianship Matter

Substance use can come up in custody or guardianship matters when someone’s safety or ability to manage their own affairs is at issue.

In an involuntary treatment hearing, the court can hear from family members familiar with the person’s history and how it relates to their current condition, as Fla. Stat. § 397.6957 provides. Your firsthand observations can matter.

Build a dated, factual log. Record what happened, when, who saw it, and any records that back it up. Stick to observations, not guesses about motives.

Be careful with social media and messages. A post or text written in anger can be read out of context later, so pause before you send.

Location matters too. A petition is filed in the county where the person is physically located. Under Fla. Stat. § 397.681(1), a Marchman Act petition must be filed with the clerk of the court in the county where the person is located.

If the concern is urgent safety for someone who can’t manage their own affairs, our guardianship attorney and emergency temporary guardianship pages describe those matters.

Protecting Your Own Well-Being Through This Process

You can protect your own health while you help a parent through this process. Living with a parent’s addiction is hard, and a court case adds more weight. Feeling drained, angry, or guilty is common, and those feelings don’t mean you’re doing this wrong.

Set practical limits. Decide which crisis calls you’ll answer, and at what hours, unless someone is in immediate danger. Agree with siblings or other relatives on who handles court dates, rides, and calls to the clinic.

Use the court’s timeline to plan. If an assessment order is issued and the respondent is present, has been served, or their location is known, the hearing is continued for no more than 10 court working days; otherwise, the petitioner must tell the court once the respondent has been assessed so a hearing can be scheduled as soon as practicable. Knowing these steps makes the process easier to follow.

Talk Through Your Situation With Robinson Casey

Talking through your facts with a lawyer can show which Florida options may fit your situation.
