Robinson Casey limits its practice to Marchman Act petitions and guardianship matters. The practice serves families in Miami-Dade County, across South Florida, and statewide. This guide explains who can file, how the court process moves, and what to expect. Richard J. Casey III, Esq. is the responsible lawyer.

What a Marchman Act Attorney Does in Addiction Cases

A Marchman Act attorney can help a family understand the petition and the court process.

The Marchman Act is Florida’s civil process for court-ordered assessment, stabilization, and treatment of a person with substance abuse impairment. It sits within Chapter 397 of the Florida Statutes. A family can’t simply ask a judge for help. The petition must contain specific facts, and the court must follow set steps before any order issues.

An attorney’s work usually includes:

Reviewing whether the family member is eligible to file

Gathering facts about the loved one’s use, behavior, and past refusals of care

Drafting and filing the petition with the required content

Preparing for the hearing, including witnesses and records

Protecting the rights of the person named in the petition

This page is written for families in Miami-Dade and South Florida whose loved one won’t accept voluntary treatment. Concerns may involve alcohol, drugs, or both.

Under Fla. Stat. § 397.675, a person may meet the criteria if there is good faith reason to believe the person is impaired. The person must also have lost the power of self-control with respect to substance use. Under Fla. Stat. § 397.6957(2), the petitioner must prove by clear and convincing evidence that the person is substance abuse impaired and has a history of lack of compliance with treatment for substance abuse, and that, because of that impairment, the person is unlikely to voluntarily participate in the recommended services or is unable to determine for himself or herself whether services are necessary. The petitioner must also prove one of two alternatives: (1) without services the person is likely to neglect or refuse to care for themselves, that neglect or refusal poses a real and present threat of substantial harm, and there is a substantial likelihood of serious bodily harm to self or others in the near future, as shown by recent behavior; or (2) the person’s refusal of care rests on judgment so impaired by substance abuse that they cannot appreciate their need for care or make a rational decision about it.

Involuntary treatment. The court can order treatment for up to 90 days. The provider can be publicly funded or, in some cases, privately funded.

The court, not the family, makes the final call. A Marchman Act attorney handles the filings, notices, and hearing preparation that move the case forward.

Who Can File a Marchman Act Petition in Florida?

For an adult, a petition can be filed by a spouse or legal guardian, any relative, a service provider, or an adult with direct personal knowledge of the person’s substance abuse impairment and prior course of care, under Fla. Stat. § 397.68112. For a minor, a parent, legal guardian, or service provider may file.

The petition must name the respondent and the petitioner. It must state their relationship and the respondent’s attorney, if known. It must also set out the facts. Those facts must explain why the petitioner believes the person is impaired and has lost self-control. Fla. Stat. § 397.68141 sets out these requirements.

Families usually gather dated incidents, specific behaviors they saw, and prior refusals of help. A recent assessment helps too. A report from a qualified professional who examined the person within 30 days before filing may accompany the petition. If the person was not assessed, the petition must say so.

Petitions are filed with the clerk in the county where the person is located, and the clerk may not charge a filing fee under Fla. Stat. § 397.681. In Miami-Dade, the Miami-Dade Clerk’s Mental Health Court page directs adult cases to Probate Court and minor cases to Juvenile Court. Filing in the wrong county is a venue problem, not a loss of jurisdiction, as J.P. v. J.N. explains.

Whether a particular family member qualifies, and how strong the petition is, depends on the facts. Those facts are reviewed at the start of the case.

How Does the Marchman Act Process Work, Step by Step?

The process starts with a petition filed with the clerk. The court must schedule a hearing within 10 court working days unless a continuance is granted, under Fla. Stat. § 397.68151.

Consultation and fact review. The family explains what is happening. The attorney checks eligibility and collects dates, records, and witness names.

Filing. The petition goes to the clerk in the county where the person is located. The court then decides whether the person already has a lawyer or needs one appointed.

Notice and service. The petition and hearing notice go to the respondent, the respondent’s parent, guardian, or legal custodian in the case of a minor, the respondent’s attorney if known, the petitioner, the respondent’s spouse or guardian if applicable, and anyone else the court directs. For a minor, the petition and notice must be personally delivered to the respondent. The clerk issues a summons for the person.

Assessment. A person generally cannot be ordered into treatment without a clinical assessment. The person must be present at the hearing unless the court finds that the person knowingly, intelligently, and voluntarily waives the right to be present or, upon receiving proof of service and evaluating the circumstances of the case, that the person’s presence is inconsistent with the person’s best interests or is likely to be injurious to self or others, under Fla. Stat. § 397.6957.

Hearing. Testimony is taken under oath, and the proceedings are recorded. Family members familiar with the person’s history may testify. The respondent may refuse to testify.

Discharge planning must address follow-up appointments, medications, living arrangements, and recovery support.

Throughout these steps, the attorney handles notices, gathers evidence, and prepares the family for the hearing.

Have questions about what happened?

Ask our team directly.
